OMG i'm so glad I came across this. I got a phone call 9:30 this morning stating i had a legal matter that needed to be resolved. I talked to someone with the name John Harris whom didn't sound American anyway. He stated to me that they got me for fraud for not paying a payday loan, let me remind you the last time I had one was a few years ago and paid. So right off I didn't know what this could be and I even told the man who kept getting a attitude with me how do I know this is not a fraud. He kept going on saying well we have you in the system and you would have to pay for a loan that was 500.00. Yet again I never in my life got a loan that high usually was small loans. Anyway he said that for court cost and all other fees it would be 675.00 one time fee. If I don't pay that it will average over a 1000. Well I told him I need the paperwork because I'm not sure what this. He started to get real loud and told me do the paperwork want show up until is sent to the state of Missouri. Which he claimed he was already with Missouri when I first talked to him. Than someone else called from an anonymous number saying the were with state law enforcement. Told me to call him back for a settlement. Which again sounded like the same guy that claimed to be John Harris. I told the guy I was going to contact the courthouse and see for myself. All he did was get more of a attitude and tell me that this was a legal matter and if I don't want to take care of it thats my choice. He also told me the they will be at my house to pick me up within the next 20mins to sit in the jail for 3days. I told him thats fine I will do that if I was in the wrong but I need to know the paperwork that this is about. I told him he didn't sound American and I think this company is a fraud and he hung up in my face. This needs to stop with these scams. BBB will be knowing about this phone number today. What if they prey on someone that doesn't do research and take they money. These foreign companies is disgusting

Got several messages from this caller, United States Crime Bureau, (with a foreign accent) demanding that I owed money to a company that was going into bankrupt. Therefore I would need to pay $1836 settlement amount or be arrested for 9 months.  I am calling to report this number and the information received.  He couldn't tell me anything about myself and insisted that I pay immediately.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

It's a scam wherein the scammers attempt to scare you into giving them money. I know it sounds bad, but DO NOT FALL FOR IT.

From the FBI's "e-scams" website: http://www.fbi.gov/scams-safety/e-scams

New Variation on Telephone Collection Scam Related to Delinquent Payday Loans

02/21/12?The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

Callers pose as representatives of the FBI, ?Federal Legislative Department,? various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim?s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim?s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it?s the latter, the caller tells the victim that he or she is wanted for hacking into a business? computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim?s job. In another instance, a phony process server came to a victim?s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

 Contact your local law enforcement agencies if you feel you are in immediate danger;
 Contact your bank(s) and credit card companies;
 Contact the three major credit bureaus and request an alert be put on your file;
 If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
 File a complaint at www.IC3.gov.

A Denver news station did an article on it too: http://denver.cbslocal.com/2012/08/18/aggress ... ool-on-victims/

What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

 use threats of violence or harm;
 publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
 use obscene or profane language; or
 repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

 falsely claim that they are attorneys or government representatives;
 falsely claim that you have committed a crime;
 falsely represent that they operate or work for a credit reporting company;
 misrepresent the amount you owe;
 indicate that papers they send you are legal forms if they aren?t; or
 indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

 you will be arrested if you don?t pay your debt;
 they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
 legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.
