FTC Reaches Settlement With Home Security Company that Called Millions of Consumers on the National Do Not Call Registry

The Federal Trade Commission, with the assistance of the U.S. Department of Justice, has settled a complaint against a Massachusetts-based home security company that illegally called millions of consumers on the FTC?s National Do Not Call (DNC) Registry to pitch home security systems.

According to the FTC, Versatile Marketing Solutions (VMS), under the guidance of its owner, Jasjit Gotra, called millions of consumers whose names and phone numbers VMS bought from lead generators. The lead generators claimed that those consumers had given VMS permission to contact them about the installation of a free home security system, but in reality, they had not. In its complaint, the FTC alleges that the defendants? tactics violated the Commission?s Telemarketing Sales Rule.

The sales leads were obtained by illegal means through rampant use of robocalls from ?Tom with Home Protection,? fake survey calls, and calls to phone numbers on the National Do Not Call Registry. According to the complaint, VMS subsequently called these consumers without first checking to see if they had registered their telephone numbers on the DNC Registry.

In addition, the complaint alleges that VMS ignored warning signs that the lead generators were engaged in illegal telemarketing practices. For example, many consumers contacted by VMS complained that they had not given the company permission to call, nor had they given permission to receive a robocall. Despite mounting complaints, VMS continued buying leads from the same lead generators, and calling consumers using those leads.

?Companies that use lead generators must exercise due diligence when they buy lists of phone numbers,? said Jessica Rich, Director of the FTC?s Bureau of Consumer Protection, ?or else they can be on the hook for illegal telemarketing. Relying on a say-so that the numbers were obtained legally, or that the consumers have agreed to be called, even if their numbers are on the Do Not Call Registry, isn?t enough.?    

According to the complaint, between November 2011 and July 2012, VMS made more than two million calls to consumers to try to sell home security goods and services. Of those calls, at least one million were to phone numbers listed on the DNC Registry, and more than 100,000 were to consumers who had previously told VMS not to call them again ? another violation of the DNC rules.

The stipulated final court order settling the charges prohibits VMS and Gotra from making abusive telemarketing calls and from calling any consumer whose number is on the DNC Registry, unless they can prove that they have received written permission to make the call or that they have an established business relationship with that consumer. Further, it bars defendants from calling any consumer who has previously told VMS not to call them again. The order also places restrictions on how defendants can obtain and use lead-generated phone numbers in the future.

Finally, the order imposes a $3.4 million penalty judgment against the defendants, with all but $320,700 suspended due to their inability to pay. The entire amount will become due if the defendants are found to have misrepresented their financial condition.

The court settlement announced today resolves the FTC?s complaint against Versatile Marketing Solutions, Inc. also doing business as VMS Alarms, VMS, Alliance Security, and Alliance Home Protection; and its owner, Jasjit Gotra.

The Commission vote authorizing the staff to refer the civil penalty complaint to the Department of Justice, and to approve the proposed consent decree, was 4-0. The DOJ filed the complaint and proposed consent decree on behalf of the Commission in U.S. District Court for the District of Massachusetts on March 10, 2014. The proposed consent decree is subject to court approval.

NOTE: The Commission authorizes the filing of a complaint when it has ?reason to believe? that the law has been or is being violated, and it appears to the Commission that a proceeding is in the public interest. Consent judgments have the force of law when signed by a district court judge.

Well, one thing that is definitely clear is that is one big gob of non sequitor nonsense and with, I suspect, large amounts of outright fabrication thrown into the crap.  

Incidentally, if you are an "ex worker", as you claim, then you would be referring to your association with this "legit company" in the past tense rather than present tense as you consistently do.

The issue isn't that "we call who we are supposed to call" (assuming that any of those actually exist); but, rather that you are apparently calling hundreds/thousands of numbers that you are NOT supposed to call.  A "legit company" would not do that.   A "legit company" would make sure acceptable procedures were in place to prevent it and that it was following the law rather than attempting to nullify legitimate complaints with silly and pointless excuses.  

Besides that, I imagine a 1998 Nokia would be analog and not even work with today's digital wireless system.

I am an ex worker for alliance security and I'm definitely going to clear a couple of things up. First of all we've been giving security product award of the year in 2011-2012 ok. Unlike ADT since it's "the number one system" out there ... We don't bang on your doors and harass you in person to buy your system. Secondly we have over 3 million committed satisfied customers and because we get so many leads a day sometimes the system can get nuts and sometimes the DNC list doesn't go through. We mainly work with the people who press 1 because they WANT IT... We don't know how you were selected we don't stare at phone books calling whoever WE FEEL LIKE. I bet half of you pay for a cell phone maybe $60-100 a month right? Depending on what you have but I bet some of you are paying $40-45 a month for a piece of s*** phone with minutes that run out... No camera limited texts !? So you'll pay $40-45 MONTHLY ... For a crappy phone that def doesn't look sexy on your ear when you go out .. But for $36-46 you can't pay for an upscale 2gig system that includes free fire detectors thermostat color touch screen glass breaks for windows key fab not to mention this system is $1500 and your getting it for WHAT ladies and gentleman !? Free ! To protect your family I think is more sensible and maybe the unselfish thing then pay up to $60 on your crappy 1998 Nokia you still have since you left high school ! We call who we are supposed to call. Apologies for those who've had different experiences but we are a legit company and only want the best protection for you. First I'd like to say that Alliance Security of AllianceSecurity.com is a legitimate company.

Its not a fake made up company where all there employees have very American names and very Indian accents.

That being said they are still a bunch of scumbags. To them its a numbers game call 100 people 1 or 2 will buy what you're selling , they don't care if you've chosen not to have your life be interrupted by endless solicitation calls from masked and even fake numbers. You are just a potential dollar sign to them , so if you want to make them stop you have to hit them in the wallet.

Here's how they make their Money

They generate a call list containing your personal information.
They get you to sign-up for a free alarm system which costs them $30 or less, which they claim is worth $200.
In return for the $30 alarm system that they are giving you they make you sign a monitoring contract for 3 to 5 years at $25~30 a month if they think you're dumb enough to fall for that. Otherwise they'll sign you up at $45~50  month. The monitoring company Monitronics pays them a commission for signing you up.

How to make them lose Money

First never give them your credit card or checking account information over the phone , but go ahead a schedule an appointment for an estimate. When the guy comes make note or take pictures of the vehicle he's driving and the name and # of his installation company (it'll usually be on the side of his truck) Then just tell them you changed yer mind and send him on his way.
Goto  https://complaints.donotcall.gov and file a complaint. You can potentially get a settlement of up to $1000.
Call them at his work # listed below. Don't threaten him don't harass him , its legal to call a business # an unlimited number of times so long as you don't cross the line. In fact,  call them and try to sell them a dirty diaper or an sold sock. If you are gonna call his Cell , make sure he's not on the National Do Not Call List , I know its ironic. FYI , Google voice is the easiest way to track someone down thats how I tracked him down, so don't get any smart ideas.
If you live nearby as I do drive down to his office and interrupt the work day, personally I like to ask to use their bathroom and then piss the toilet. Some of you will have to fight the urge to go all Carrie Underwood on his purdy white truck parked right in front, but don't.
Call his family members tell them what a Douche-Bag their Brother, Son, Husband or Cousin is. I honestly have found this to be the most effective tactic. It doesn't really cost them money but at least their family knows how he gets all his SWAG.
Call the Monitoring service provider Monitronics @ 800.447.9239 give them the name and # of the company posted below , eventually they'll cut ties with them if they get enough nasty calls. You can also call their corporate office @ 972-243-7443 give them the names and numbers listed below you might get better traction than just calling Customer care.

Alliance is owned and run by Jasjit Gotra, Ricardo Diaz, and  Jody Patterson. They got into some legal trouble and decided to break off their sales force to help minimize their legal liability. Despite what Alliance says to the BBB he is on their payroll , with the exception that he's 10-99'd.
Last year Keith decided to move operations to sunny Florida. I've done some mission impossible style sleuthing using a fake name an an elaborate disguise I managed to get Keith Kayton to implicate his partner in crime as :

I have resorted to the following:
Press the required digits to get them to call back. In the past few weeks they have upped their game to have random "press 1 for more information" "2 to be taken off the list" and change out numbers. Now they even make you press two or three different numbers saying "Are you sure?"

So I take the time acting stupid, order service - TO MY STATE GOVENOR's address and name.  
Then I add the number to the blacklist. - - which forwards back to their own number!

I figure the only way to fight is to waste enough resources and use the technology back on them.

Everyone needs to waste the callers time. That is the ONLY way to stop them. I talk to them everyday...sometimes a dozen times a day if the robodialer goes nuts. Basically every time I have some spare time and can multitask I will waste their time. My personal best record is keeping one scumbag on the line for 45 minutes because of my 'stutter'...lol.

Sue them  in small claims instead for violation of state or federal do not call laws.  Minimum claim of $500 per occurrence, check legal parameters in your locality.  The principle of law known as Respondeat Superior means let the higher up be responsible.  A company is responsible for any conduct of its employees or agents.  Alliance has been running this "program" for too many years to claim they are unaware and it is their responsibility to know what their agents are doing.

Hey guys,

I just wanted to post a comment on here. I am a technician that works for this company. I'm really sorry this has happened to you. It really shouldn't but unfortanately in this economy up and coming companies like Alliance we don't have many viable options in the marketing areas. Alliance deals with outside telemarketing companies to get work and sometimes those guys tactlessly and foolishly violate things like the do not call list. The guy on the first page "Jay" from alliance is my boss and an all around good guy. When I first took this job I specifically asked about these DNC issues and he explained why it was and how unfortunate it is. I'd advise to email the address he left and ask him to fix your situation. I apologize on behalf of my company.

I have been getting tons of calls every day (and all night long). So finally I acted as if I were interested and they said I would receive a call back within 60 seconds. The company that called me was Alliance Home Protection AKA Alliance Home Security. There is a very slight possibility that the calls are being made by a sales generating company feeding security companies with hot sales leads. Since I have left a voice mail with Sunny expressing my frustration of these calls and making him aware this does not reflect a positive image of his company and he did not call me back I expect this company is actually behind the calls. I hope collectively we can all give them as much hell as they have been giving us!

I've filed several complaints about Alliance Security on the Federal No-Call website and never got a response of any kind. I also filed a complaint with the BBB, but they rejected it for "lack of information", probably because I didn't have a street address (none on their website...). Sooooo...I like DIY - here's what I do: follow along with anything they propose (taking as much time as possible), set up an appointment, then DON'T BE AT HOME WHEN THEY COME. Apparently the FNC list is a joke to them, so the only way to stop them is to COST THEM MONEY. It does take a little of your time, but they got you to drop what you were doing and answer the phone - may as well take some time to help better society by hurting the law breakers. If enough folk did this, they would eventually dry up and blow away OR start obeying the law by using traditional, non-invasive marketing strategies like the vast majority of companies do. HAVE FUN!!!

this number called my phone several times and I ignored it, so a company called security alarms just showed up at my door and had all of my information and said he was here to install an alarm.;when i told him I was a cop and wanted all of his company's info and how they got my information which is confidential.....he took off in a hurry with me getting no information......wonder whats goin on here and where are they getting the info

This all started because I was a dumb*ss and answered question to get a free cruise (the phone call that starts off with a ship's horn) and didn't get all of these bizarre questions they asked. All of a sudden I start getting calls about finishing my degree and home security systems and all from different numbers! Today's calls were from 678.804.4024 which was automated and said I'd get a call back, which was from 214.452.0007 - a call from a live person who told me she was with Alliance Home Security. All for a cruise from Miami, which I didn't receive, but am still getting these annoying calls. I'm actually thinking of changing my mobile number.

Well folks, I finally got them to stop callilng me.  I gave them all the information that they needed to setup a consult with a technician.  He cam by (although 2 hours late!).  When I saw him coming up the walkway I let my 175-pound Neapolitand Mastiff out on his butt and he made a MAD dash back to his vehicle.  He called my  house and left a REALLY obscene message.  They called 3-4 more times and the was the last I heard of them.  I did some checking and found that they had made unauthorized charges on people's credit cards.  DO NOT give them any information that they could  use to steal from you.  As for the technician, you are in the wrong business, buddy.....you should definitely try out for the Olympic track team.  HAHAHAHAHAHAHAHA!!!!!
