I agree. The loopholes are a huge problem with this law. The law is near worthless when you consider all those who are exempt and the fact that scammers don't follow the laws in the first place. It may have been good to help it's cosponsors get reelected or it may have been intended as a good thing, I don't know but it hasn't solved the problem of telemarketers for companies you have shopped with in the past (in my case the phone company), charities, scams, polls or surveys. Weren't those the ones who were the problem to start with? Oh well...

You are confusing who they're calling on behalf of and who they are, as in what telemarketing firm under what telemarketing license they are using. Associated Community Services aka ACS aka AC Services out of Michigan have many call center affiliations. "Vanessa" called saying she was a non-profit organisation raising money for children with cancer. For a change this caller was actually nice when I informed them I don't donate to anyone that calls over the phone. She said "i understand. have a nice day". I usually don't answer calls that I don't recognize, but this one had the same area code as mine so I gook a chance.

Called about 830 tonight asking if I would make a donation, pledge, whatever. I asked how much of a donation actually gets to the kids. Reply was that 15% goes to the children, while 85% goes towards administration costs (payroll, bills, etc). I said "so basically the kids are getting squat from your organizition, huh?". She tripled that they have to make their money somehow. Told her to remove my name from call list and do not call again.

The comments about charities being exempt from the Do Not Call list are partially correct. Based on the below, it appears that they can call you a first time (i.e. exempt from the National List) however, you may request that they remove them from any further contact from that charity or its representatives. If they call yet again, then they can be reported and possibly fined. I have created a simple spreadsheet to document callers, the organization they represent and the date on which the were notified not to call again.
The following is copied from the National Do Not Call Registry website consumer Information section:
"Are calls from political organizations or calls soliciting for charities covered?
Political solicitations are not covered by the TSR at all, since they are not included in its definition of ?telemarketing.? Charities are not covered by the requirements of the national registry. However, if a third-party telemarketer is calling on behalf of a charity, a consumer may ask not to receive any more calls from, or on behalf of, that specific charity. If a third-party telemarketer calls again on behalf of that charity, the telemarketer may be subject to a fine of up to $16,000 ."

I have been getting calls from this number ever since my child's school fund raiser for St. Jude's. i am not sure this is why...but I will no longer donate to school fund raisers as I wonder if this is how all these other charities got my name. I am not interested in supporting charity CEO's salaries that are multiples of 6 figure incomes!

256-867-2478 calls my home every night after 8pm....sometimes as late as 9:30! I am a teacher and go to bed early, so this is unacceptable....anybody know who this is? The caller ID says Children's Cance....that's it....help!

I get calls like this constantly, and my home phone service provider only allows me to block a maximum of 10 numbers. So -- I've started forwarding calls from these lowlifes to my cellphone, where I have an app that will let me block an infinite number of numbers. I love the smell of a blocked call in the morning.

Last week, early one morning (before I had my first cup of coffee,) the phone rang and and a female asked for me by name (disturbing that this scum has my personal information.) While she neither clearly identified herself nor the organization she was representing, she launched into her spiel: a spiel that sounded oddly familiar! When asked if she could, "send me an envelope for a small donation," I responded, "sounds good" (by the way, NEVER say, "OK" or "Yes" when speaking to these rodents.) She then continued on, with the excuse, "they make me ask this" and tried to elicit from me how large a donation I would be making, concluding with the comment, "the usual donation is 75 to 100 dollars." At that point, I said "Bye Bye."
After hanging up, I reviewed my records and discovered that a female had used this same spiel twice in the past two months: first incident representing "Breast Cancer" and the second incident representing "Leukemia." Further research revealed all three calls are connected with an outfit going by the name of "Associated Community Services." Here are some of the other names (subject to change as federal regulators close in) of "charities" ACS solicits for:

Those who are Exempt from the Registry are not loopholes. Exemptions were not provided by the FTC as a "Loophole". They were intended to be exempt.

I asked if I give $100.00 to this, how much would go to help a child with cancer? The answer-15% goes to help a child and 85% goes to pay salaries, pay bills to keep the organization operating. No thanks, keep your card. Not a non profit organization at all.

Solicitors for charities are not required to abide by the Do Not Call list. Only calls offering the sale of goods or services are covered. Also, the allowed timeframe for these types of calls is 8am - 9pm local. However, they are required to maintain an internal Do Not Call list of those who request not to be called for that charity. If they handle more than one charity, you have to request to be placed on the Do Not Call list for each charity as they call you.

Called at 9 pm, well past the normal time. Like other posters, I am on the "Do Not Call" list, but they do not respect that. My standard response when asked for donations is: I don't give to any organization that solicits over the phone.
