Debt Collector
They call me multiple times a day. They're looking for someone named Spencer. I have told them over and over that they have the wrong number & that nobody is here by that name, yet they continue to call! Whenever I tell them this & to please stop calling, they hang up on ME, while I'm still talking, like I have inconvenienced THEM!! And what happens?! They still call ME!! I try calling back to speak to someone since THEY HUNG UP ON ME, but you can't call the number back!!!! They're idiots that can't put a simple note in their records to say it's the wrong number- SPENCER isn't here!! Morons.

I called Receivables Performance Management LLC, told them I was receiving calls, they mentioned some woman's name, told them I never heard of that person, they said thanks.  Hopefully that'll be the end of the hang-ups and getting put on auto-hold when they stay on the call.

I saw on the news that a new scam is going on, someone calls & lets it ring just long enough for it to show "missed call" if you answer or call it back they put you on hold then have a way to get all kinds of personal information. (DON'T CALL BACK OR ANSWER ANY NUMBER YOU DON'T KNOW)

Stop Debt Collector Calls

The Fair Debt Collection Practices Act (FDCPA) is the Federal law that says what debt collectors can and can't do. For starters, they aren't to call you about a debt that you don't owe. When a debt collector first contacts you about a debt, you have the right to request them to verify the debt is yours. If the debt collector can't come back with proof that you owe the debt, they're not allowed to contact you anymore. Make Debt Collectors Prove You Owe

Cease and Desist Letter Template For Debt Collectors

You can use this cease and desist letter template to stop debt collectors from calling you. Once the collector receives your letter, the FDPCA allows the collector to contact you one final time, in writing, to let you know what action, if any, the collector will take next. Customize the template letter to include your personal information.

This number has called me before, and twice just today. When i called them back the lady who answered the phone said something along the lines of them being a pharmaceutical company and asked me to hold on after I said someone had called me from this number. After I got taken off of hold the lady asked me if there was a "LeeAnn" there. I told her no, there wasn't, and she said "Put me on with your mom, I am NOT speaking to a kid." (Now keep in mind that I am NOT a kid/child, or anything in that manner.) They were very rude and hung up on me.

310-703-5785 debt collector. I get calls on Sunday morning. It is illegal for debt collectors to call on Sundays or holidays. You can save the recordings for an attorney and sue them.  Lawfirms will take this on a contingency because they can sue collectors for breaking the laws. Debt collectors are not allowed to call before 8am or after 8pm or again you can find an attorney to sue them. We sued sprint debt collector for calling about a lost payment some 5 years ago for calling at 7:30am and settled for $5,000.

I just got a call from that number and was curious who it was. I put the number in my search engine and found this forum , regarding the post above mentioning the national do not call list. I registered 3 phone lines and all solicitation calls on all lines registered stopped immediately , it's been aprox. 2 months since I registered my lines, this is the very first unwanted call I have received . The national do not call list has teeth. Today I'm going to file a complaint with them regarding this unwanted solicitation call, it is my understanding and I have met people to confirm my next statement " WHEN ACTIVELY REGISTERED WITH THE NDNCL , THE UNWELCOME CALLING PARTY MUST PAY YOU THE AMOUNT OF $500 FOR THE 1ST VIOLATION.

I disagree about just paying it. I got burned once doing that. Never again. Debt was over X-yrs old and did not have to be paid. Some of these collection agencies buy these old accounts and harass the living hell out of people, illegally as it turns out, so they can get paid.

Take no prisoners.  Listen up...

Receivables Performance Management LLC is a Washington state corporation whose named agent is Andrew Shafer of Simburg, Ketter, Sheppard & Purdy out of Seattle.  His telephone number is 206-382-2600.  I urge you to call him and light his a** up, let him know precisely how displeased you are with his client's harrassing phone calls.  He is a member of the bar and thus subject to adhering to some kind ethics.  He therefore has a vested interest in ensuring that Receivables Performance Management stops calling you.  If you try to reach Receivables Performance Management directly, you will not.  Every telephone number they have listed on their website or any public records is a deadend ...obviously by design.

As collection agencies go, Receivables Performance Management is real beauty.  These people are absolute scumbags, and no mercy should be shown toward them, becaue they will show you no mercy.  So if you want to help yourself, contact Andrew Shafer at 206-382-2600 to let him know just how you feel.

You would not be the first debt collector to assume that your own employer's protocol somehow matches your industry's controlling laws. The FDCPA does prohibit annoying and harassing call patterns, but *does not* set any numeric benchmarks. "Annoyance" and "harassment" are subjective emotional states. FDCPA claims of that sort depend entirely on the frequency and context of collection calls. Three calls a week with no other factors would simply not be enough to win an abuse claim. Three would be plenty if, as you've suggested, the agency was already on notice (preferably written) not to call.

You would also not be the first collector phone jockey to assume that all debt claims are valid and owed by someone. Your industry must be taught over and over again to "bite the bullet" and take properly sent disputes and cease-comm orders seriously, with *no regard* to whether a consumer can be held liable for some moldy account. The last time I tangled with one of your peers for ignoring my rightful demands, they were ordered to "just swallow it and pay" *ME* handsomely for the grief they caused.

Try learning more before the "hard way" bites again. The only "time limit" is the state Statute of Limitations, which is not fixed by federal law. SoL is determined both by state law and by one of four account categories. SoL periods range anywhere from three to fifteen years. The SoL sets a ''shot clock'' for litigation to collect on an account, a clock which devious collectors try to trick people into winding back. (a trick you say once worked on you)

As you've just done, SoL is frequently confused with the seven year FCRA time limit for reporting of accounts to the credit bureaus, which has *NO* bearing on the ability to collect any debt. Curiously, not one state has a seven year SoL on any form of debt, putting the lie to any confusion of SoL with bureau reporting.

The term you wanted was "original creditor", who lent to you the debtor. The OC does not have to wait years to sell off defaulted accounts. This can happen right after charge-off at six months. An OC can hire a collector anytime it likes to chase delinquent debtors, even before charge-off.

Whether you are called a debtor or some collector thinks you can flush one out, you have rights and options. Many are simple to exercise if you only learn how. You are granted control of how you are contacted, the right to dispute debt claims, and the means to sue violators at low cost. The FTC and the CFPB can start you on your homework. See also if your state laws grant additional or stronger rights.

Your callers do not maintain this site or this web page. Your callers cannot magically determine which numbers should not be called based on anonymous comments. You cannot expect compliance with your orders until, if possible, you deliver them *directly* to your caller.

You and M DesSoye are advised to get off the phone and use USPS Certified with return card as your method of choice with debt collectors. By the way, calls on weekends are just fine unless your state law limits them or *you* give notice of inconvenient times and days.

You omitted the fact that there is a time limit on old debts. I believe it is 7 years. I learned this the hard way by simply complying and paying a really really old debt. The original debtor doesn't get paid, they turn the acct over to a coll. agency. After the time limit, they dump these accts to these other agencies who try anything to get you to pay what actually is no longer a debt.   Caveat Emptor!

Just because a person is getting calls from a debt collector does not mean that that person actually has any outstanding bills so "swallow it and pay it" doesn't apply.

Thirty years ago I was briefly married. I haven't seen or spoken to the ex since then or used that last name (I've been remarried for 28 yrs so not even using my maiden name). The ex remarried and divorced. I know way more than I want to about the ex and HIS ex because I get at least 4 calls a week for his ex. Apparently, MyLife.com strips data from county courthouse records and creates 'profiles' on its site. Since there were divorce records listing all 3 of us at the same address, MyLife decided to list me as a "Close Relative" of the ex's ex. Many of the calls are automated with no way to tell a person you've got the wrong bloody number. Yesterday a woman called who told me which state she lived in and birth date (about 2 yrs after mine) and then was upset that I didn't know who she was, she thought I was her mother! She got my number off the same worthless website that sells info to bill collectors. MyLife.com reps offered to transfer my call of complaint to a sister website that would remove internet references to me (that MyLife put out there) for a fee!
