I just got a phone call from these people and said the same things to me about owing them money on a payday loan that I never made through them. Told me my bank rejected paying them $450 because I did not authorize them to deduct the money. Scary thing was they had all my information. They got upset and said they will send the police to my home and workplace since I did not pay them the $450 they wanted by today. Funny thing was that as we were talking they kept saying there is a payment plan and when I said I wanted more information on that they still said the full $450 was due plus an additional payment made out to th Federal government but paid on a green dot card. I told them to send me the court documents and I will see them in court. They were really rude and kept getting upset that I kept asking them to repeat themselves cause I couldn't understand them through their thick accents.

I do not know if this was the number as I am at work today but a gentleman with a foreign accent stated his name, PETER COLLINS, of the State Attorney's Office in CA is suing me for something. He had the last four of my SS# but that does not mean he had my full SS#. He asked for my attorney's phone number. I did not admit I was the person he was asking for and actually told him he had the wrong person.

I went through this back in 2011 when I applied for a payday loan. All of a sudden I was getting threatened with arrest, cops coming to my work or home, etc.  This month I had to apply for a payday loan but did not actually take it and now I am getting harassed.

The biggest sign is someone who barely speaks English, with a very American Name calls you, it is not real.  American collection companies will have a valid number to call back, it usually is the same as what appears on caller id.  All I can do is take their calls and hang up.

I can't believe these people they so fake it's sad. I sat on the phone with them just for the hell of it cause I work for the Sherrifs Department and I'm at work right now and they saying all this stuff and the Sherrif is just writing it down. And he stated that they are fakes and that we will fill a report on them. So who ever else gets a call on them just fill a report with the local Sheriffs department so we can get these frauds out of the way.

Some of these scammers are over in foreign country's.. Thats where the FTC, FBI and the federal agency's come in.  A good state attorney general will take this info to the news stations and papers and get the word out about these scams.  However, if say your state catch's them, then he can prosecute and so will the feds.

As for the ones in foreign country's, thats a lot of red tape.. its only going to happen so fast and things really don't get solved in a hour like CSI..

Make sure you file complaints with all the proper authority's, not just one.

A guy with a heavy Indian accent keeps calling my work phone representing a Starks Law Firm stating that I received a loan from them and when they went to get the money back it wasn't there.  So the company decided to make this a civil matter. REALLY!! and he needed to verify some information. I asked him not to call my work phone and this fool told me he will call 100 times and he's 80 away. I explained that I will take this to the company's attorney and did. He called twice this morning. I know it's a scam so KICK ROCKS!!

These guys are ridiculous and will not stop calling. First of they called claiming to be a loan company named Assured something or another and I told them I was not interested in getting a loan through them. First off the guy had a thick most likely fake Indian accent and claimed his name was Johnny Foster which threw up red flags right off considering his accent. He claimed that I had been approved for a three thousand dollar loan but they would need a security deposit of one hundred eight something dollars, Scam companies like these will say things like this to get your bank account info and once they get that they can and will clean out your bank account. He said that I needed to call this verification number so I did just to call them out. The man that answered the phone kept talking ninety miles an hour so it took for ever to get a word in, when I did I asked him if they were an accredited financial institute through the Better Business Buru (which you can find out on your own by going on to www.betterbusinessburu.org) and he said yes like four times so I told him I was going to look it up and call back. I did and surprise surprise they were not listed and I told the man that he then proceeded to curse me and ask well do you want the f****** loan or not and I said no. These morons then began calling me from the same number claiming to be a law firm named Stark and Associates and said that there was a case being filed against me under my social security number and they read it off on my voicemail and then went on to say that the information that they had was being sent to my attorney generals office and my employer (contact your place of employment an let them know that it is a scam because THEY WILL call your employer) and that if I got arrested not to blame them because they called me to warn me. They want you to pay them a "settlement" DO NOT GIVE THEM MONEY OR BANK INFO. You can and will not be arrested for any of this, the companies they claim to be do not exist! To get these guys to stop doing this and make it so they do not scam any one else contact your STATE attorney generals office, the phone number that is calling you is a Indiana number but unless you live in that state they can not help you so get the phone number for YOUR states attorney generals office call them and ask for the Consumer Protection Department and tell them what is going on in as much detail as possible and DO NOT delete any voicemails that they leave you until this issue us resolve. Also to get your states attorney generals office number google it! Hope this helps, together we can stop these little creeps from getting any one else's hard earned money and causing us issues! REMEMBER if you do not report it they will keep calling and can steal yours as well as others identity, IF THEY CALL YOU THEY HAVE YOUR SOCIAL SECURITY NUMBER SO REPORT THEM BEFORE THEY STEAL YOUR IDENTITY OR WORE!!!!!!!!!!

I can't believe anybody fell for this scamster.  I normally never give out my business phone, except that I gave it while applying on line for a loan and then got shunted to some payday loan sites.  Less than a week after that, I got the call from this huckster.  I now just the slightest about the law and the idea of arrest warrants going out for owed money sounded ludicrous.  I looked up the number and saw the 800notes webpage.  It confirmed my suspicious.

I returned the scamster's call just because I like to mess around with such idiots.  I raised my voice and interrupted him and yelled "WHAT CASE?!" at him.  He was flummoxed and said wait a minute and was unsure what to say next.  So I took over and said to him "ok.  now let me explain to you how it is.  I think you're a scamster.  You do not have permission to call me again and if you do I will contact the state attorney's office and report you."  During the last part he behaved like the call quality had dropped so I repeated myself;  at this point he hung up.  I called back on got his voice mail and left the following message "Hello this Adam *****.  You hung up on me and that is rather rude.  You do not have permission to call me and if you ever call me again, I will report you to the state attorney's office."  Hopefully he'll believe me and not harass me.  If he does, I'll have to get my office number changed and sick the company's legal department on him.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Same thing...I received a call from a john at 317-495-3707 stating he needed my attorneys number and that a suit has been brought against my social security number.  If I did not comply that a warrant for my arrest would be issues, and that the state courts have been reported to.  He called my work and thankfully my supervisor knew immediately it was a scam.  This is just day one for me, I am guessing they will continue to call....When does it stop?

I have been going thru the same thing, telling me that I was being sued for a loan, if I didn't listen, my job and the state attorney's office would be contacted and than I could be arrested. That they had my ss# and my phone #. So I contacted my lawyer and he contacted them, they hung up on him. He found out that it is a scam. You can put in a complaint at the Indiana Attorney's office on line ,request a form at 1-800-382-5516 or 317-232-6330. Now each time I was called it was a different name for the law firm. They were nasty, rude and threatening to me. I want to know how they got my cell number and my ss#. That scared me the most.

I received a call today from a guy named "John" Stark from a law office.  He told the same story as before.  He said there was a lawsuit pending against me and was going to be filed with criminal charges.  I asked him what we needed to do to settle this out of court.

"John" said he would talk to the client and would see what we could do.  3 to 4 minutes later, he came back on the phone and told me I owed $620 and the client would accept $320 today and the rest could be paid later.  I told him I would pay the $320 today.  Borrowing the money from my mother, I decided to pay $500.  This was my mistake.

When I realized it was a scam it was too late.  As such, I am out $500 but I will definitely report him to the FTC and to my Attorney General's Office.  Also, I am going to contact Indiana's Attorney General's Office. Can anyone think of anything else to do?

The Foreign Weasel(s), if I made a cartoon of them that's what I would draw them as, who use re-routed calls from overseas, supposedly from a law firm, called my wife again today.  This is the second or third time they have tried their scam on her.  Same "phony story," she was going to jail unless she satisfied some fictitious debt.

My daughter pretended to be the wife and she played "the little weasel" who called, like a fiddle.  He could stop the police, who were supposedly on the way to complete an arrest. Of course he could only stop the police if the bill was paid.

Long story short, he was such a greedy weasel that she kept him on the phone (speaker) for about 15 minutes, it was comical.

Now I am going to Tweet and Facebook this info and have it forwarded to as many people as possible.

I've gotten scammed by these people not once but TWICE!!  Shame on me!!!  I have done payday loans before but have ALWAYS paid them back.  I've talked to the same Indian people as listed below.  When I made the final payment, suddenly it's taking 24 hours to get this "receipt" mailed to me.  Kept saying 10 minutes, 10 minutes.  I have told them that if I don't get this receipt among other things that I would be contacting the State Attorney General's Office.  They gave me a 904-365-3707 that was supposedly the attorney's office.  Then they just gave me the 317-495-3707 number stating that it was the State Attorney General's Office and if I could give them 5 minutes, they would have them call me to walk me through getting the final legal paperwork.  I took it upon myself to call the number and it ended up being the voicemail for one of the "attorneys" that I had been talking to already!!  So they just wanted me to wait so they could make up more to the story for this "action".  I have kept everything with these transactions and will pursue whatever I need to and get this rectified!  Please, please, please.....don't be fooled like me!  THESE ARE SCAM ARTISTS!!!!
