Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I just got the call myself literally minutes ago (at least the first one I have answered, Accent so thick I had to have them repeat things multiple times,He was of Cathy Woods Legal Associates. They said I had receipt of illegal funds, check fraud and credit card fraud charges against me (funny, cause I have no credit cards even in my own name and only about 10 checks in my possession which belong to me) I told them that this was bogus and if I was in any real trouble I would have been notified in writing or by a process server from the court long before things had come to this point, and when that finally happened then I would worry about it, he then told me that I should not think like this and that it was serious matter and that I could ignore it but it was not in my best interest and I would be rested tomorrow morning and had best have 9000 ready for bail. I told him I would get right on it and hung up as he yelled a me some more.
The part I dont get is what triggers these calls and what causes them to think people will believe these scams, if I have not had a large some of money deposited into my account or done any crimes of the sort then why would I believe their line of BS? What is the point or purpose?

Same thing here. They've been calling my POE lately. I told my bosses what it was and asked them to just tell them that they don't know anyone by my name and that they are not allowed to accepted personal calls for anyone that works there. I also routinely auto-forward these numbers to the local sheriffs department dispatch. That usually shuts them down pretty quick!

There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information and you need to do whatever you can to protect yourself. It's a scam - they're foreign extortionists.  There is no debt, there is no court or "charges".  Debt is civil, not criminal, so NO ONE is going to be arrested either!  This is the spiel they use to scare people into paying bogus debts.  All you can do is block their number or ignore the calls.

called at work I told them not to call me at work told my bosses it was an emergency I had to call them back within 30 minutes I called them the guy who sounded like he was from a third world country told me I owed a loan I had until friday to let them know if I was going to pay it back if not the case would be down loaded to the attorny generals office of my state I called them back and asked what law firm they were calling from and the guy said cathy woods law firm of NY I went on line and could not find any information on this company

I am with anybody on here...I have had enough of these calls. This time they say they are calling from my attorneys office  because someone has filed fruad of my social security number (yes they have my ss number) and who knows what else. I told them they are fraud and I am not talking to them. They call my cell phone all day long and my work phone!

I confronted "David Johnson" when he called my job. and when he "transferred" me to someone who is to give me more information i came to notice as soon as the person came on that its still "David Johnson" trying to act as someone else with a different name. I told him that if all this is true then i should have received the emails that has been claimed to be sent plus a state letter notifying me of the charges and he got upset and hung up.

they said that they have tried to contact me many times "my own fault for awnsering" they said its for an outstanding dept "i got a miilion of them" and I am getting a warrent for check fraud and thier mailing copies to my home and work they even had my worh address... kinda worried but I have been threatened by bill collectors before and i tried asking how much to settle but he got mad and asked if I thought this was a debt collection I replied "sounds like it" he laughed and said I will have a warrent fror my arrest.. only scary thing is he had address and my work address and he said a copy of the warrent will be mailed to both..

Sounds like you're being harassed by scammers.  Per the FDCPA (Fair Debt Collection Practices Act) you should NOT pay any caller who refuses to MAIL - do not accept fax or email - a debt validation letter showing that (1) you actually owe a debt and that (2) your caller has the legal right to collect said debt.  Refusal to mail this DV letter is a violation of federal law.  It is also a violation to threaten people with court or arrest in order to get them to pay money.  A bill or invoice does not prove you owe anything.

Ask yourself this: if the caller is legitimate, why can't they just mail proof to you that you owe them money?  The answer is, because they are either outright scammers or junk debt buyers who can't prove you owe zip!  You said they are calling about a loan that you never took out - so there's your answer.  This IS a scam.

Follow the steps in what you need to know. A legitimate debt collector agency should not have a problem with giving you a real business name and address you can google and verify via google street view, BBB etc.

i got a call from them today said i owe them money and they said they would take me to court. it was on a loan that i did not recieve and they said it was for 1,400. they called me 16 times today and im really scared i dont have really good health at all my heart and my lungs are bad, is it a scam please let me know , that is what they told me.
