I received threating phone calls from this company trying to collect on a past due pay day loan.  The guy's name is Roy Franklyn, calling from 347-497-7437 and 347-347-1122.

From Friday, November 2 to Wednesday, November 7, 2012, I received a total of 100 phone calls from these people.  I called my attorney's office and they called also, but they continued to call.  My attorney advised me not to make any payments.  I told them what my attorney stated to not answer any of their calls.  When I told them that I did not have the money, but I could pay something on it, he asked me the following questions:
"
What do you mean you do not have it.  You agreed to pay $264.00 and $40.00 is not acceptable.  On Monday, he said, "You have until the end of this day to pay the amount agreed.  Don't you work?  Those people don't pay you?  Let me speak to your manager?"

I have been getting fraudulant calls from numbers like this over the past few years - stating that I am part of an investigation and that if I do not call them back right away to take care of the matter that they will suspend my social security number, that they will send investigators to speak with my manager... That I will have to face $5000 fines. ..That I will be arrested. It is extremely frustrating being someone that does not even have a face book account ... but, all of everyone's information is just floating around on this internet for people to look up and use to commit fraud themselves. I reported these calls to the police agency about two years ago ... which takes some time in itself and after about two months I got the report sent back to me and told that it was the wrong agency to send it to. I wish that it was passed off to the correct agency at that time but, instead of getting the "it's not my job" type of response .. because if more were working together to catch these scumb of the earth.. maybe it wouldn't be something that is growing like wildfire vs. the rare occasion. I know a lot of people that have had calls like these, or avvon fraud, or car sales fraud... and the list is just growing.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I have been receiving harassing calls at my place of business from this person caliming to John Smith with American Legal.  Stating there is a legal case against me.   When I call this scam back, they cannot provide me with any information.

I informed this person NOT to call me at my place of business any longer, and flat out said NO, we will call where we want.

This appears to be a scam.  Im reporting them to the National DO NOT CALL list.

This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information from unscrupulous websites like the one you may have filled out an application with, and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

ABC News released an investigative report on this scam in June. The FTC has indicted one of its ringleaders for criminal fraud:

I rec'd a call from a David Stevens - hard to understand, very thick accent. He stated there was a fraudulent case with my SSN and to call back immediately. Otherwise, they were not responsible for having to contact my boss, loss of job, and loss against my credit. Said they were with BCS.

i received 3 calls from a "david stevens"  about a lawsuit they would file. Obvious ripoff and scam. these call began after I asked for some information online about a short term payday loan which was never applied for.  I asked for a call back number and he gave me 347-242-xxxx (I will not post her last 4 digits) . The lady started cursing me because they stole her phone number as a call back. There are 3 or 4 of them. one claiming to be a supervisor. all of them curse and swear like it is the funniest thing in the world to them that you are upset. DO NOTgive these fools any personal information as they have obviously stolen it and all they need is a little bit more to rip you off. They previously were using numbers out of the culver city california area code.

they called me left a message stating that i need to call immediately as there was a fraudelent case against me and i will be handed a subpona. he had a very bad accent and he stated he was from pcs law & investigation at 1001 e queen st in Ithaca NY (which he could not pronounce the city) he then proceeded to tell me that i would have to hire an attorney and my credit report would lose 300 points, my supervisor and manager will be subpoena.
at the end of the conversation he stated that he would drop the entire case if i just paid the $300.00, i told him i would have to check and see if i would have any money in my account, he stated he would call me back and i was not to talk to anyone regarding this matter
