have been harassed constantly by Stellar Recovery, Incorporated
They call multiple times throughout the day. They have been harassing my family members, even my ex-husband for over 10 months and calling my work.  This agency is ruthless in trying to collect on a payday loan that I defaulted on. Yes, I owe the money and want to pay it back but not like this. They have threatened me, with being served to go to court, threatened me with possible jail time, check fraud and wage garnishment?.seriously!!! After two weeks of this harassment from Stellar Recovery, Incorporated, I finally got some help from a company called Consumer Credit Helpers.  They?re a not for profit organization and never asked me for a dime.  CCH helped me file a complaint with the States Attorney General Office, the Consumer Financial Protection Bureau (CFPB) the Federal Trade Commission (FTC) and finally the Better Business Bureau (BBB).
Next they put me in contact with an attorney, who feels we have a case against Stellar Recovery, Incorporated for several FDCPA violations. They were great to talk to, with wonderful advice and information. I recommend anybody getting harassed by Stellar Recovery, Incorporated

Thanks for the good info on Stellar Recovery.  Especially the extension numbers.  I don't owe anything and a few direct extensions can make the difference between my being a rash or a seething boil.  I will call them tomorrow and I guarantee I will have more fun than they will.  I love this stuff.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

They ARE criminal. Last year they called and told me they were going to help me with the money due on my son's ATV, which we used on the farm, not for recreation. They had all my information and set up a payment plan using my bank account. All late fees would stop and my account would be marked current. I had no reason to suspect and was just glad they were willing to work with me and relieve my stress. BUT when I got my next statement from the ATV company there was no payment credit and the balance had increased with late fees. I called the phone number on the statement and, you guessed it, they had no idea what I was talking about and had received no payment.
I went to my bank to cancel the auto withdrawals but they still accepted one and charged me for overdraft (WAMU). When I went back they gave me all kinds of BS. I had to pay the fees, withdraw my funds and close the account. I opened another account at our credit union. THEN these people had the nerve to call me and tell me they were having trouble getting money out of my account!! Duh. I gave him a few choice words and when he realized that I had figured them out...he hung up. Learned my lesson.

Maybe this is a fluke BUT I just talked to GE Money Bank about an account of ours. I called them on my cell phone because we had our land line changed due to dozens, yes dozens, of calls every day from robots for many people. Same kind of calls as those listed above. Anyway, within 5 minutes after hanging up with GE Money, a got a call on my cell phone from this number! Is that strange or is that a connection? Any ideas??
I believe that calls to cell phones are more strictly restricted than land lines. Does anyone know if this is true? Thanks. Happy New Year.

406-755-9522...These people called me today looking for a Regina.  I am not Regina and don't know a Regina and the man kept asking me who I was. I refused to give out my personal information because they are fishing for information. That man got rude with me demanding to know who he is speaking too. So I hung up on him. Please ignore these people if you don't have any business with them. They go around trying to strong hold and scare people into payment. This is illegal! Bloggers know your rights!

I just got many calls from them as well. They are Stellar Recovery Inc. on my caller ID. I also spoke to Justin at extension 1228, yesterday and he must of had a good day, he was nice. BUT I do not believe a thing these people say. They twist your words and threaten if you do not pay by Friday they will have to advise "their client" to take further action. I think they are somehow connected to Vion Holdings LLC ? Jessica Harding ( 888-613-0237 extension 1275), a manager claims that Vion is their client. And that Vion is a lawyers office, I can find NO information on Vion or proof of what she tells me is the truth. I read the post from Feb 27, 2009 that says they are ARS Recovery Services, out of Montana. This really concerns me, did they recently change their company name!? Shady! My next move it to check the rip off report site for ARS. I owe a large sum of money and a clear title to the item I owe for hangs in the balance. I would like to settle up, but these people want check by phone or payment with a credit card (which is a big DO NOT DO)with collection agents. Before you know it your account is drained. It is a tricky situation. Get everything in writing.  Speaking of visit Clarkhoward.com for helpful advice on how to handle things like these people. There is a drop dead letter you can send to stop the collection calls.  Anyone know about the above company I posted about please share. thanks and good luck to us all!

I recieved a call today from this agency and the guy was looking for nicole johnson which does not live at my address or have my phone number. I told the guy he had the wrong number and he ask could he speak to Mr. Johnson which is our last name but he wasn't home then he demanded me to tell him when he would be there so he can discuss the matter which is so annoying when he clearly have the wrong person. I just hung up on him and hopes he never call here again. Wrong number Wrong person get a life.

My wife and I got a call from Justin at this company.  He had all sorts of information on myself and wife.  He tried to threaten my wife with taking over her families LLC which by law he cannot do.  I called him and asked who he was and why he wanted my home address which of course we did not give him.  I told him that I had just lost my job and he asked if it was a company that I worked at over 10 years ago.  I asked him where he got his information and then he asked me again if I worked at another company that I had worked at before the other company over 11 years ago.  We are declaring BK and I asked who do I have my attorney call when I hire one he just hung up on me.  I have worked with collection agencies before and no one has ever hung up on me like this. I can yell and curse and they will just take it this guy however hung up on me twice.  I normally do not even take these calls but something about this company was not right.  They have a ton of personal information try to tell us that they have some decision to make like taking legal action of somekind.  When he found out that we were declaring BK he tried to talk us out of it saying we are not in that much debt.  Who is he to tell me what I should do. I think this is a collection agency but after reading the other posts it sounds more like a mortgage company trying to get business.

A Statute of Limitations Letter is a letter one would send to a collection agency if the debt that they are trying to collect upon is past it's Statute of Limitations... meaning that the debt is so old, different states have different rules, that you no longer have any legal reason to pay the debt. The letter informs the collection agency of that fact and also requests that they no longer contact you except to let you know that they are terminating their collection actions or are taking specific actions allowed by the FDCPA or your states laws.

Audrey, that garry  must have given out your number to someone  and now they are trying to collect. I get a call from one service looking for a micheal kirkland. I got a call from this stellar recovery yesterday looking for my wife, all they did was use the robot message. I've called some of these agency and talked to a human to tell them to stop calling but it never works.

I think I know what your pattern is.  My husband and I just applied for a refinance on our mortgage.  We also have no bad debt on our credit report but have gotten the same automated call that all of you have.  Since we have an unlisted number and have had for many years, the only way they could have gotten our number is through our mortgage app.  Sounds kinda fishy to me.  Our current lender is Wells Fargo and I suspect that is where they got our information.  

By the way, what is a Statute of Limitations letter?

i am looking for a pattern here. I googled their address, name, etc and come up with listings for Real Estate Attorneys, Mortgage refinancers, ect. Maybe they are advertising on that page - or maybe that's how they are getting our info. When we apply for mortgages?

They called my cell looking for my husband. By his nickname! As in the name that is short for his middle name. Now, when he applys for anything, he uses is first name. So, I'm still not sure how they would have his nickname. Sounds fishy...especially since we don't have any bad debt - which we learned when applying for the mortgage.

I am getting calls from 406-755-9522 for Shannon (last nanme) Mumble Mumble- ( can't understand)  Messages left on my answering machine state that if I am not the person they are calling disconnect - if  I do not disconnect they wil assume  I am that person.  If an answering machine picks up - NO ONE WILL respond. This is the collection agency, ARS Recovery Services, out of Montana. Their calls generally come from their from their 866-552-1377 number. In my experience of receiving their calls during the past 2 months, all but one have been robot calls with an automated message for ONLY a specific person that they name. Their message, depending on the version, requests either that THAT PERSON call them at 406-755-9522 (their main number) to retrieve their IMPORTANT message OR the robot requests that you hang up if you're not that person - giving you no opportunity to question their call nor advise them that they have the wrong number. Even if the call goes to an answering machine, the robot message will continue with something like, "if you continue to listen to this message we will assume that you are (so-and-so)". They have only called me once weekly - but, as bill collectors go, that will probably get progressively worse. Bill collectors are prevented by law from discussing the specifics of their call with anybody other than their target but they are allowed to question 3rd parties for any information that they would provide. Today was a little different. This afternoon I received a call which the Caller ID identified as ARS Recovery Service but it was from their main number, 406-755-9522. I answered hoping that a real person was calling this time so I could tell them that they had the wrong number. However, when I answered, all I heard was a male mumbling, "mocha coffee, iced blend". Maybe he thought he was calling Starbucks to place an order or perhaps someone was taking his afternoon coffee break order. Apparently that was more important than talking to me in real time because he hung up on me. AND THEN, 1 minute later, their robot called with their automated message from their toll-free number 866-552-1377 ... and SORRY, I had to hang up.
