ok i got a call from a man with an Indian accent whom left a rather rude msg on my voice mail stating i needed to call them as soon as i got the message and if i dont call them back that they wished me good luck.. the number was a unknown number every time they called. when i answerd the call they did asked for me and veriffied that it was me, they were able to verrify my SSN#, my bank acct# routing#, my address, as well as my brother and sisters full name. i then asked him how he got that info and he stated that i was commiting fraud through my bank acct and my email. He stated that i was commiting the fraud from my bank acct since march of 2007 although i didnt open my acct or move to the current state that i am in till november of 2008. when they called me back my sister had done all the research on the number they provided to call back as well as the bank they stated i was commiting fraud from which was "First Years Bank" which DOES NOT exist. when they called me back again i was already aware of this info and advised the india guy that the FBI was monetering the call as well as tracing the call down. when they heard that they then said that i needed to have my lawyer call them and then hung up. He also stated that they were going to have one of there officers come and arrest me well i have been home for 4 hours now and no one has showed up. when demanding to speak to their supervisor they will get extremly upset and most likly say that they are not your servent or start to curse at you. WHO EVER READS THIS PLEASE CONTACT YOUR LOCAL AUTHOITIES AND REPORT THIS!!!Also, consider filing a complaint about 4088867091 with the FTC.

Contact the FTC at 1800 382 4357,also call the consumer fraud division of your state's attorney general's office and equifax at 1800 525 6285. They'll put a fraud alert on your credit report and alert the other credit bureaus as well.  This call completely freaked me out; I even called my local FBI office.

I can't believe this didn't occur to me sooner.(I was too busy panicking) If anyone had actually owed any money, the company would have called within days,not months, and given people the chance to pay. Also, a collection agency would have been involved if payment wasn't received. No legitimate company's "legal department" would call this far after the fact,threaten to arrest you and not give any information about the alleged case.

Don't verify anything! It's obvious that they intend to use stolen information to apply for loans, etc! Also notify the FTC, your state's attorney general's consumer fraud division and the credit bureaus.

Obviously, the best thing to do is absolutely NEVER apply for an online payday loan; even if the site is legit, you never know who else is looking.

This is absolutely a scam. According to the BBB website, the address this "company" uses is the address for Anaheim CA city hall. The profile is interesting reading.

The real American credit services in CA is aware of this scam and has posted a link on their website with phone numbers/links etc. I don't know how authentic the website is;the link with the scam info is written very poorly with many misspellings, but it's there. americancreditservices.org

this happened to me, just like you said. i did as he said but now i believe i am going to call the fbi. he told me from march of 07 from us dollar bank for the amt of 545.00. the took it out of my bank acct and have no inquiry of who took it. pleae email me at beresh@pti.edu and tell me if you did the same.

There are no debtor's prisons in the US, and the most one of these companies could do is sue you in court or garnish your wages. Also, if this were a valid debt, don't you think you'd have heard from the company you allegedly owed money to sooner than this?  If you pay for a report on that phone number you will find it listed to MIKE. That's it. No address or anything. ACS, american credit services is a real company, with three locations in INGLEWOOD CA, not San Jose where this number is from. I'd advise you to check your credit report, call the FTC, and FBI.

I too this evening at 4:49pm. I had just sat down to dinner with my kids. This man leaves a voice mail. SO I go outside to listen. It said: In strong ACCENT that you can't understand... This msg is intended for Misty B- This is to inform you we must hear from you or your attorney immediately regarding a serious matter. Do not disregard this phone call Misty he proceeds to say and left his number and name Mike Brown 408-886-7091. So I call  back and he hangs up. Then I call back again and can't hear him. I ask him what this is about. He starts out, there is a Affidavit against you. He read my ss number, address, checking account, personal information. He then said that First something couldn't hear Bank was coming after me for monies deposited into my account etc. He then told me they were offering to settle out of court. Sound familiar? He too gave me specific instruction on how to write out a fax cover letter and apology letter. Now come on I have never heard of a business asking for an apology letter before.

This is what he wanted me to write similar to the other guy:
Page 1 he started he said this is payment form. On left side write date.

He said to print in page 1 I misty authorize ACS/American Credit Services/DTECH/Default to debit $410.00 from my card for outstanding balance.

He said to write on the letter to affirm it my card number,Type, 3 digit code, exp date billing address and full name. Then to sign it with my name on the right side.

For the second page as he called it he wanted an apology letter:
Right side he said: Name and Social Security number (hello he already has it he read it to me). Left side Date.

Body of letter was to read:
To Mr. Mike Brown Head of Restitution Department

Subject:
Apology letter

I Misty never did this intentinally, but wan to resolve this debt and make restitution out of court.

By paying settlement so that no further legal action will be taken against me and to have the case froze.

Sign name on right side.

Ok so, after this he then asked me to give him my card number, full name, etc. I told him I wasn't comfortable giving this information over the phone. He said when you are ready to fax call me. I told him no i wanted the fax number now. He became angry and snipped out the fax number he gave me two of them (949)682-4841 and same prefixes with 4891 for additional fax and said to call him promptly after sending and to do it promptly by 11am.

Naturally I was scared to death. THen started looking on here and the odd thing was he called my cell phone number. He was very adimit about wanting that money and card number and to sign the document or he said he couldn't help me and then when I began asking questions he said he needed my attorneys information. I have one actually and gave him her name and said look her up.

So, he said he would be filing the case at 11am tomorrow if pmt was not made. I am still freaked out. Is this guy gonna steal my money, come rob my house or what!

So I've been getting a call that shows up as unknown. I answered the call and it's a guy in a indian accent he claims that i've commitedd ilegal activity with not paying a payday loan. He says if i have an attorny and that i'm in big trouble and that his officers were going to pick me up at work or at my house. Whats surprising is that they know my adress, social, where I work, and refrences. I was so freaked out I didn't know what to do, then I calmed down and relaized that they just wanted my money. They wanted me to pay them 500 dollars so that I would be cleared of all charges but i had to fax them a letter stating that I authorize them to take it out of my account. I almost gave them the money but just little hints. They were extremly rude and would get irritated when questioned. Perfessionals answer every question in a proper manner and if it were something so big as they are going to take to jail I think their would be documentation sent out to you prior. Don't fall for these people

Unfortunately, no, but do call the FTC at 1 877 382 4357 and file a complaint. They'll also direct you to your state's consumer complaint division. If you know you did nothing wrong, don't worry.  If you can, find the customer service numbers for the payday loan companies you use to make sure all's current.

I received the same message yesterday. Do you have anymore information on this person??? They left no reason for this call. I have had several payday loans in the past but are in contact with all of them and have paid them and some are still paying but they are all current??? Help!!

I received a call that showed up 1224 on my caller ID. And told me to call the number because of a legal matter. When I called the number a man very rudely told me to call back in 30 minutes. Started to think something wasn't right so I called my cell phone company. They also called the number and was told the same thing. They asked what legal firm it was and they hung up on her. They told me just not to call back again. Then my phone was ringing off the hook with the same thing. When I told them if it was a legal matter they could call me they would hang up on me. Everytime all it showed on my caller id was a 4 digit number. Each time it was different. Still don't know what it is about but pretty sure it is a fraud of some kind.

Can you tell me what they said to you because I got the same call this was really very sesitive stuff. They were accusing me of criminal acts which I have no idea what they're talking about. I called again tonight and I also got an answering machine. This is not right. I am still going to consult a lawyer because this is causing me pain and suffering. They can't just do these to people....intimidate and harass me like this.
