BBB offers the following advice to consumers if they receive a suspicious telephone call about an outstanding debt:

? Ask the debt collector to provide official documentation which substantiates the debt.

? Do not provide or confirm any bank account, credit card or other personal information over the phone until you have confirmed the legitimacy of the call.

? File a complaint with the Federal Trade Commission online if the caller is abusive, uses threats or otherwise violates federal telemarketing laws.

This company calls people who formerly used a payday loan service to obtain a loan. The information they give you is "real" enough to bait you....then they represent themselves as "the united states task force division" (now that's illegal and ridiculous) and proceed to tell you that if you don't pay them by * o'clock that a warrant will be issued for your arrest, (also illegal). When you call them back they continue with the ridiculous hardcore scare tactics and tell you that your banking institution has filed an affadavit of fraud against you through the "FDIC" (now that is also a lie and also ridiculous) long story shorter...this is a scam. Stop freaking out, calm down and file a police report, a complaint with the FTC and a complaint with your attorney generals office. Also notify your bank of the situation. Do not fall for this crap and NEVER give them any account info. These people are the lowest common denominator of scum. Shame

How to file a complaint:

Visit ftc.gov/complaint, click on the FTC Complaint Assistant icon, and answer the questions. The Complaint Assistant works best from a computer (it?s not optimized for mobile devices).

What you'll need:

The more information you can provide about the situation, the more useful your complaint will be. If possible, be prepared to provide:

Your contact information
name, address, phone number, email
The type of product or service involved
Information about the company or seller
business name, address, phone number, website, email address, representative?s name
Details about the transaction
the amount you paid, how you paid, the date
The FTC cannot resolve individual consumer complaints, but we have tips to help you get your money back.

If you think that a caller may be a fake debt collector:

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

If you think that a caller may be a fake debt collector:

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

If you think that a caller may be a fake debt collector:

Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

caller may be a fake debt collector if he:

Is seeking payment on a debt for a loan you do not recognize;

refuses to give you a mailing address or phone number;

asks you for personal financial or sensitive information;

or exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number.

The ultimate solution to dealing with bad debt collectors is to only communicate with them in writing. "I just don't answer my phone, communicate with them in writing and that is best.

Tactic No. 5: You haven't been answering the phone or responding to collection letters. They are now calling your neighbors and your employer and leaving messages. Calling to verify a person's location is not illegal, but calling a neighbor or employer to harass or disclose personal information about your debt is.

Solution: "It's not proper for a collector to call a neighbor unless it is only to verify a debtor's location," says Markoff. "If a collector calls a third party and reveals any of your personal information, it is an illegal practice." In this instance, you can file a complaint with your state's attorney general's office or the Federal Trade Commission.

Tactic No. 1: A collector refuses to send you a statement or proof that you owe the money. Maybe the collector even makes threats of bodily harm or jail time. All of these actions are forbidden. A creditor attempting to collect a debt must send you written proof that you owe the debt. Also, collectors may not threaten you. Debtor's prisons do not exist. You cannot go to jail for not paying a debt

Solution: Knowing your rights gives you power. Obtain a copy of the Fair Debt Collection Practices Act.  In addition, many states have their own laws in place. If a collector is breaking these laws, you can file a complaint with your state attorney general's office or the Federal Trade Commission.

Prank Call
Part 1 - I have been being harrassed for over 2 years by these scam artists. Back in the summer of  2011 when they1st called i fell for it. They called my grandmothers # looking for me. They claimed i owed on a payday loan & they were going to take me to court so if i did not want to end up paying the debt plus all court costs i better settle it up w/ them now so unfortunately i paid them. They said i would receive paperwork showing that i paid in the mail. I never rcvd anything then a year later i got another call same thing thats when i realized it was a scam & i didnt give them any $ & i called my local police dept & was transferred to fraud unit & spoke w/ an investigator. Basically he said unfortunately i would never get my money back but now i would need to protect myself. He said never ever give anyone $, your ss#, or personal info over the phone & to Tell the caller they need to send you something in writing within 5 to 7 business days. If they do not they are illegitimate & part of a scam.

A Theresa M. called my place of work that I only visit once a month, said she was an investigator that I needed to call back and gave a County Court Case number to one of my employees.
I do not live in AZ, have never lived in AZ, have never conducted business in AZ  and therefore do not know how I could have county case number. I have called the number back but only get a recording.

Is there any difference between a collection agency and a crooked collection agency?

'Legitimate Debt Collector' is the epitome of the oxymoron.  'Crooked collection agency' is redundant.
