Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

After a time companies write off unpaid accounts for tax considerations. The debt is then sold to collection companies. The collection company will accept payment of all or part of the debt from the debtor. A percentage of the collected amount is paid to the original company. The remainder stays with the collection company. Collections contact may be by postal letter, phone or email. In all three contact methods the collection company has no legal standing and need not be responded too in any way. To complete the collection the collection company must file suit in the debtors local county court, A summons listing court hearing date will be delivered by county sheriffs office. Collection companies will not complete this procedure due to lack of legal standing in the debtors state of residence.  Never provide any personal, family, friends, neighbors or business information to a collection company. Block the callers number if number blocking is available. Never answer if it is a know collection company calling. Never call back to a collection call voice message, Do not respond the postal letter or email.

They are a debt collector and call five times per day. That is not legitimate practices. I have already sent them my letter and request for a payment plan and they wanted to see my paystubs and tax records -- by the way, you dont legally have to provide that to a debt collector and you shouldn't provide that. They wanted my husbands paycheck information and SSN and I said no, because the debt isn't his and we weren't even married when that debt was accumulated -- therefore they have no legal right to collect from him or ask for his information. These people call with threats and constantly call and call. I wouldn't call them "legit". Yes they exist and they aren't scam artists, but they dont have good practices either.

It is a debt collector called fams. They would always call me when I was at work and could not answer my phone and never leave a message. Finally I got to talk to a lady named Leslie and she was actually very friendly and helpful. They are legit and the woman I spoke with only wanted to help my situation and was very understanding. If they are calling you, then you owe money. Just identify yourself by your name and they will tell you what it is for.

if you all have a smart phone download the free app called truecaller and it gives you a way that you can spam the call and your phone will not even ring the next time they try to call, it sends it straight to voicemail. even if you call and report them, they will find a new way to harass you, they will call from a different number. even if your debt is valid it is never okay to be harassed! sometimes life throws a curve ball like losing your job. do not let these creditors make you feel bad for things that are beyond your control. i urge you to download this app, if it is your home phone then change your number and unlist it.

My lawyer said never to respond to unknown callers like that,  as  a reputable debt collector will identify the debt and the creditor.  
Never give out information such as address, ssn, etc.  They are robo callers who call from a list.  BTW, your address and info show up on their screen when they are calling you.  They don't even need to ask you.

After the first day I activated my phone I've had this number call me multiple times!! At first I rejected the calls, but after numerous attempts I called back to find that this debt collection agency was looking for a woman named Rachel... I tried to calmly let them know that I wasn't Rachel and would appreciate them removing my name and the man I spoke to apologized for the mistake. HOWEVER the calls have NOT STOPPED! Last time my phone auto answered one of these calls, I cussed the woman out who wouldn't kept asking for Rachel!

All this number does is harass people and I'm sick of it! I've added them to an auto-reject list as of tonight, so now they can call me all they want. Stupid people.

Wishing is effective if you had a Genie. Chances are you..you dont. Your complaint forces me to assume that you've NEVER answered the phone when this number calls or any other number you dont know calls. Why do you refuse to just see what they want. Is it because you owe several agencies and you know any out of town number calling is going to want some money from you? Collection agencies collect on DEBT. Assuming that is your debt (which neither of us can confirm because your scared to answer the phone), what stops you from doing the right thing and making payments on something you owe OR answering to find out if they have the wrong number?

Some people get on here and exhaggerate due to frustration they have because they may acutally have to pay a loan back one day. This entire story is completely made up. The company doesn't even collect medical debts and their name is FAMS. You may have heard "Sams" by mistake but you imagined that she said Club. This company has been around since 1993 with the same name, a website with full contact information, and they are a member of the BBB. Every single call that comes out of every collection agency has to be recorded. There is no way a respectable agency that's been around more than 5 years would let their employees get away with behavior like that. Of course I can't prove your lying...and you can't prove your telling the truth..I'm just saying it's unlikely.

...Just a couple facts: (1) The only way someone "steals" your tax return is if they hold you up at the atm. They OFFSET your taxes because you didn't pay your student loan which technically means that YOU stole money. (2) Someone calling to collect a valid debt doesn't "pester". You clearly admitted that you owe money so they are just doing what is expected. (3) Your policy of not answering the phone is IMO childish. Your basically scared that you may actually have to TALK to someone to whom you took money from with no intention of repaying..once again..stealing. (3) If they are calling for a student loan it's likely that you owe WAY more than 600 so they are still calling because your not done. (4) They will continue to take taxes and eventually garnish your wages until it's paid off. It will cost you a lot less frustration to just call and set up something you can afford before they "steal" more money from you. IMO.

I am reporting an unwanted phone call with this number that appears on my cell phone. One guess would be that it's a debt collecting agency pestering me even more about a student loan or something. I lost $600 in a federal tax refund that they stole from me when I filed my taxes last year. They didn't leave a message, but they still keep calling, and I have this policy that when I see a number on my cell phone caller ID, I don't answer it. Sometimes I get messages stating that it's a "personal business matter", so they tell me. But this number doesn't leave any messages. So what gives?

I just got a call from this number, I answered and the lady said this is Adrian from Sam's club and I am looking for Jaci. I said this is she...she then proceeded to say she was a bill collector and I had a medical bill out standing. I said to her "you just told me you were with sam's club" she said "we just do that so you will answer us".  I told her I would not talk to her anymore and I hung up. I have not been to the doctor or hospital in 20 years, so i know it was not for me.

A reputable debt collector will provide proof of debt owed.  If this is not provided to you, it is possible that it isn't your debt and never was.  Its just as stupid to pay it without asking questions.

I have been getting this number on my cellphone, and there was no message left whatsoever. I wish that whoever is calling me with this number would stop calling me. Perhaps if I ignore them, they would never call again. But I guess that's wishful thinking, because if there was a way to pay these yahoos some money via debt collection, then they wouldn't keep aggravating the hell out of everyone.
