This debt has expired. It crosses the line when they start harassing me at work.

The simplest remedy:

Step 1: Don't panic.
Step 2: Ignore them when they call.
Step 3: Repeat.

As was said above, IF the debt is beyond the Statute of Limitations in your province of Canada, they no longer have legal claim to recovery, so they try the intimidation and harassment angle instead. They're entitled to do for a few more years, until the debt "expires" completely.

Smile, realize you made some mistakes in the past that had repercussions (like racking up debt and not paying it off), and then exercise one of the following two options:

Option 1: Offer them 5% of the amount they're trying to collect to clear your credit rating immediately, and request a crystal clear "Final Settlement Offer" be signed and faxed to you within 48 hours, and then pay it when it arrives, releasing you from the debt and these phone calls forever.

Option 2: See the 3-step method above.

Hope that helps.

In the meantime, pick up a copy of the book "The Wolf At The Door," it changed my life when it comes to worry and anxiety about debt collection, and helped me to deal with my own situation head-on. And no, I'm not the author. Just a guy who read it, loved it, and feel the obligation to pass it on to others in a similar predicament.

Regarding the calls on behalf of Bell it sounds like it may be legitimate. Companies like Bell will hire collection agencies to try and collect bills that have not been paid for a certain period of time. If the first company they assign an account to is not successful within a specific period of time they will assign it to another agency. That is what seems to have happened with your Bell Mobility bill, starting with Integrity First and then being transferred to EOS NCN. If you think the original bill was overcharged or charged you for things you did not order/use then you need to go to Bell Mobility, in writing, to dispute the bill. Once you have done that when you get a call from a collection agency just tell them that the bill is being disputed and that they cannot call again or you will report them to the ministry (your provincial ministry that governs collection agencies).

Lastly, if you tell an agency they can't call you because you disputed the bill, be aware that it sometimes takes about 24 hours to get your number out of their automatic dialer system. In this example, if you received a call the following day you should just ignore it. If the calls continue past that point then talk to the ministry.

You can quote the FDCPA, FTC, FCRA and any other US legislation/regulation all you want but unless you live in the US it does not apply. If you want to know what your rights are in Canada check your provincial ministry governing collection agencies. In Ontario it is the Ministry of Consumer Services, use this link   https://www.sse.gov.on.ca/mcs/en/Pages/Person ... n_Agencies.aspx

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Now they are saying that they are calling about my old MBNA mastercard and how i owe $2096.74. That is a lie. They are saying that because they are trying to cover up there story, they work for Bell Canada. I know it. Bell Canada is the one who told Integrity First Telesolutions to collect money from me. I know there plan. They are not calling about my old MBNA mastercard that i had in the past if they were i would of recieve a letter by now. They are calling about the money i owe at Bell Mobility which it isn't true. They could bogged me all they want but i am not paying anything. I am glad that i reported those lying idiots. There other company is EOS NCN is very annoying too. They could stop calling also. I just hope i don't have to hear from these people by next year.

Most of the time they leave messages that they don't want to cause any trouble but they want to offer me a deal yeah right. All they want to do is collect money from me. I ain't paying a dime. They could write this off. Now they took the phone calls to a new company called EOS NCN. The EOS NCN has been calling my phone to many times. Now i learned that i should never give out my phone number. That EOS NCN has been calling me mostly every single day. Since EOS NCN wants to work with Integrity First Telesolutions they could have eachother. I just hope that both of them can go to hell. Bell Canada cellphone service is the devil all they wanted to do is overcharge people with there phone bill. I just hope that i don't hear from them again.

This is a debt collection company who calls looking for my x - girlfriend daily.  They have tons of #'s that they call from including  855-204-3008  and also 855-326-5195.

They keep calling even though I have told them she doesn't live with me anymore, which is a true story.  Additionally, I have never shared any type or form of credit  with my x - girlfriend.

I guess this company recorded my home # somehow.  Very frustrating for me.

As well, they continuously resort to deceptive lies on my voce mail, claiming that my x - girlfriend has won some sort of a prize or that there was a change on her Equifax report.

Somebody should report this company for using outright deception to collect money, which is considered a crime in Canada.  (Verifiable)

The bottom feeders will creep you on facebook and google your name. They will contact everyone linked to you to try and get your number.

REMEMBER with debt over 2 years old (after 2002) the matter cannot be taken to court, meaning they have no legal tools (garnishment, ect) to be able to collect. Only hope it that you pay up.

Paying them WILL NOT HELP YOUR CREDIT SCORE as they claim, this is a lie. The debt is already recorded as an R9 by the time they get it. They are not the original lender so they cannot make changes to that statement on your credit report. PAYING THEM DOES NOTHING TO HELP YOU.

To get rid of them, you send them a registered letter telling them to stop calling and contacting you unless in regards to court action. Since the debt is over 2 years old, they can't do anything. They now can't call which was their only means to collect.

If they do choose to call you again, contact the Ministry of Consumer Services and report their actions.

Considering their own method to collect is harassment,  if they get too much attention from the Ministry of Consumer Services they loss their only tool to collect. They will leave you alone and move on to the next account they purchased for 5 cents..

Glad I found this site.  They called 'us' meaning they called me on my mobile for my husband.  No idea where they got my number but are calling for him.  Anyhow, they are telling me that he has a debt that he truly doesn't have and this happened 8-10 years ago (can't give us a date).  Anyhow I've phone a guy there (the only number I have) and he won't call me back.  How is a collection agency not calling me back?  Isn't it usually the other way around??  I've called and left 3 messages... still no call back.

I told them it wasn't on my husband's credit report and we went to see our bank about this as well.  They said... yeah it wouldn't show up there because the debt has been sold.  Um... ok... not sure what that means for us... it's not on our credit but we should pay it??  PLUS... it's not his.

Would love to know more about this statute of limitations... has this expired?  This is all strange to me.  Would want to know more about this registered letter too.

Seeing as this guy is not calling me back I was googling to see if I could find another number to call them at.

Any help would be great!

I ASKED FOR A MANAGER TO TALK TO AND THIS GUY NAMED ""NEIL"" IS APPARENTLY THE MANAGER - HE ANSWERED AS HE WAS SARCASTIC AND KEPT REPEATING THE PHRASE - COME ON JUST PAY YOUR DEBT AND STOP MAKING EXCUSES - AND COULDN'T REASON WITH HIM.
GUYS WHO EVER GET THESE CALLS REPORT THEM TO THE POLICE AND ONCE ENOUGH CALLS MADE THEY WILL INVESTIGATE THEM FOR SURE.
I ASKED FOR THEIR ADDRESS AND THEY REFUSED TO GIVE IT TO ME EVEN THOUGH I KNEW IT.

These people have anything but integrity. I checked and they alternate between having Integrity First, unknown and Global Connect as their Caller ID

If you are a legit firm, and have any intergrity, you dont need to play games with your caller ID which this firm seems inclined to do. Based on what you have written about statute barred debts they are just short of con artists. In fact I would wonder if the firm that sold them the debt could not be sued. Knowingly selling something that cannot legally be collected smacks of Fraud to me

I suspect they also call the number of the person ont he debt, I would have to guess less than 50% of the people would have the same number as in 1996 in fact it might be less than 10%

They never leave a message call once per day.

I know my credit cards, l of c and everything is upto date since yesterday the bank tried to increase my credit. Apparently they didn't get the Bank of Canada's memo on rising debt but I digress

I finally got annoyed and decided to google the number, and well here I am.

If you need to name your firm "integrity first" I would say that speaks volumes as to your action "integrity"If you have it you don't need to include it in your name. Based on the post's here I guess I was on the money

I forgot to mention:

The statute of limitations on consumer debt incurred on or after 2002, is two (2) years. This means that if you acknowledge -- either in writing or by making a payment -- the two-year period is reset.

Debt incurred BEFORE 2002 has a limitation period of six (6) years.

"Integrity First Telesolutions"

This "collection agency" called me about a debt from 1996. A debt that is *not even listed* on my current credit report. Moreover, the statute of limitation would have expired in 2002. Where they get off even calling me about an expired debt, is beyond me.

Not to mention that there's NO company website, no interwebs home...seriously??

Do you due diligence. If you send ANY collection agency / debt recovery company a registered letter requesting (among other things) proof of: the debt, the contract with your name on it, the right to collect the debt, and (proof) that the limitation period has not expired -- I would also add that you want the matter taken to court (if, like me, you're 100% certain the debt is null and void), since doing so means they cannot contact you by phone AT ALL.

If you legitimately owe something, then that's your problem. My experience with this company, was one of entertainment. The best part about my phone conversation, was that the guy I spoke to was VERY CONFIDENT he'd "be calling me (again) next week" .... except, no one from this company has contacted me since my registered letter was rec'd. I'm so sad. :'(

Considering that they called me about a debt from 1998, for which the limitation period (six years) has long since expired, I would say this is a questionable company, at best.

1. What the total debt amount is
2. A detailed calculation as to how that debt was incurred
3. A copy of the documented signatory evidence of my commitment to this obligation, with the complete contract
4. Prove that you have the authority to collect the debt, with license numbers
5. Prove they you are licensed to collect the debt
6. A copy of any judgment if any
7. Identify the original creditor.
8. Prove the Statute of Limitations has not expired.

I also included the following:

[quote]
Please note that any unqualified action may result in legal consequences for which I will use all remedies available at law to protect myself.

If you cannot verify the debt, you are obligated to clear my record AND inform all three credit bureaus to remove any delinquent or negative reports pertaining to said account.
[end quote]

Do your due diligence when it comes to knowing your rights as a consumer. If the limitation period has expired (two years for any debt incurred on or after 2002 -- or two years from the date you acknowledge the debt either in writing or by making a payment; and six years for any debt prior to 2002 .
