I got a call from southeren asset recovery saying I owed a payday loan from 2007 for 200.00 they said I had done a check fraud and could spend time in jail somehow they already new my workplace and bank accout and are taking out everypay 43 dollars I am going to change bank accouts once everything else has come through I am 53 years old and have a heart condition and this is very stressful to me every time I try to call them noone answers

I received a phone today from Mrs Reynolds telling me I needed to call by 5:00 today eastern time or I would be embarrassed at my place of business tomorrow and they left last 4 digits of a social security number that was not mine and she her extension was x105. I called back tonight when I got home after 5:00 but they were closed and I left a voicemail

I have a recent update I would like to share:
I just made contact with the internal collections department for the payday loan company and I have already paid the loan in full back in early 2012. This SAR has no authority for their claims and I can't wait to get started with my attorney!

I will be one of many to share my experience. The number calling is 678-436-8823 but they are Southern Asset Recovery--just like the number ending in 8822 is associated with them. They did not introduce themselves as a debt collections agency. This "company" seems to favor effective scare tactics, such as telling people they are going to have charges brought on them or their family for check fraud regarding a payday loan. That is what happened to me, anyway. They almost got me and I actually gave payment information to them. Then I talked to my brother; he flipped out and told me to cancel my card right away. They told me that one of the references I listed on the loan application can be charged as a guarantor on the loan. And that is a pile of horse poo because he did not cosign for the loan, in the first place. Today, it is almost 2 pm and they have already called five times. I have not received one iota of written documentation regarding the loan, even though I requested it be sent to me. Both times I asked, the company's hit-man changed the subject into another "you could go to jail" speech. This is not true and, if it were, I would be served legal notice from the court in my area and not insulted and bullied over the phone. I called once and asked for their address; I was put on hold and then this exceptionally rude female cretin answered, refusing to give me their address until I verified my dealings with their company for the "safety of their employees." I have wondered how anyone could do a job like that. Really, how does anyone go home and feel okay after spending all day being a bully over the phone? They must be spouse/children abusers! Maybe they wouldn't have to worry about the safety of their employees if they behaved like decent human beings. Anyway, that's all I have to rant about regarding this matter.

This guy called my wife's cell using her previously married name. She let it go to voice mail because she doesn't answer calls from numbers she does not recognize. As she was checking the message from a male claiming to be from SAR and needing to talk to her about a legal matter our home phone rang and the same number came up on the caller ID!!!  Our answering machine picked up and he started leaving the same message on our home answering machine. I picked up the phone and said "Hello!" in a very snotty voice. He stopped mid-script and said "Hello?" In the same snotty tone I said "Who is this? What do you want?" He asked for my wife and I said "Who? never heard of her, you have the wrong number!" He said "Oh, well I guess I don't have to call this number any more." and I hung up.  We will see if the do***e bag calls back again!

If you get a call from this company you need to know first and foremost that IT IS A SCAM.  Doesn't matter if you've had a payday loan in the past or not - it's still a scam.  If you have any doubts, call the original creditor or better yet - call your state's Attorney General office and they will be very quick to tell you the same thing.  

If you've already given them bank account info, immediately go to your bank and cancel your card/account and get a new one.  This way they won't be able to get any money from you. Check your credit reports for free at annualcreditreport.com and if your financial institution has a credit monitoring program, consider setting that up.  Do not sign or agree to anything.  

If you decide to continue forward with paying this bogus debt you think you owe, please know that under the Fair Debt Collection Practices Act (FDCPA) they are required within 5 days of first contacting you to provide the amount of the debt, the name of the original creditor and your rights under the FDCPA.  They will likely tell you that they've emailed or sent it already but do not do anything until you receive this.  It is what is known as a written validation notice.  If by some miracle they DO send it, then you should contact the original creditor directly and verify that the  involvement of Southern Asset Recovery is valid.  You might be better off dealing with them for payments, if they allow it.    

Under the law, they cannot threaten you in any way.  If they try to tell you that you've committed check fraud or some other crime that will result in you going to jail or taking you to court, tell them they are more than welcome to pursue those avenues.  The most they can do is send the account to collections, NOT court.  And they are certainly have no authority to arrest you.  If it makes you feel better, check your local/county court records online or call them to verify that there are no pending cases against you.  The case would go to the court where YOU live, not in Georgia where this company is located.

If you got as far as agreeing to pay and received a payment authorization form, they may have told you that they cannot accept payments directly and instead use a service called Payment Processing.com which is listed on the form.  The first clue is that this URL has a space between the two words so right off the bat you know it's not legit; if you do some checking, you'll find that URL doesn't even exist.  If they email you the form, it will likely come from an email address ending in remitnow.us.  A check of Whois records will tell you that this domain is registered to Southern Asset Recovery.  Interesting that they say they can't accept payments, yet they own this domain and its email addresses.  Big red flag there.  And if you do end up paying them money, you can expect to get more calls in the future because you're not paying a legitimate debt in the first place and it will therefore never be recorded as such.  Don't believe them when they say they'll send a letter after payment to say the debt is paid in full.

And one other thing to consider even if you pay a legitimate debt to this place or any other - if you "settle" for a lesser amount than what you actually owed in the first place, you will receive a 1099 form the following year because you have to claim the difference as income.  So you're actually losing money by agreeing to settle.  If you incurred the debt in the first place, do the right thing and pay it in full even if it means making payments over several months.  Most places would rather see the money slowly coming back to them rather than not at all.  

The reason these scams keep going on is because places like this are really good at intimidating people into paying.  Your best bet, and the advice that your Attorney General's office will give you, is to ignore their calls.  Don't waste your time or energy on trying to argue with them or even give them a piece of your mind.  They don't care and they'll just move on to the next tactic.  You should also register for the Do Not Call List (donotcall.gov) and file a complaint with the feds (https://help.consumerfinance.gov/app/debtcollection/ask#currentPage=0).

By not handing over money or playing their game.  Once you make your company aware of this scam,  your inability to stop it, and that it is interfering with your duties,   then the ball is in your company's corner to advise them to cease and desist.  Your termination without cause due to this illegal harassment  is illegal.   Unfortunately,  there is nothing much the authorities can do about the little South Asian Boiler Room Thieves who are one of the primary rings using this method to extort money from people.

FYI: I have been a collector well over 15 years and very successful let me help some of you:
1. By FDCPA- you can be called up tp 3 x in your time zone between the hours of 9am-9pm
2. They can threaten to do something that they can not do.
3. Pay Day Loans especially in the southern states ARE NOT BINDING BY LAW!!!
4. You can report all day long, the company will receive your complaint and answer it, and its over. Star recording your calls especially at work. They can not call you at work, if they have not made proper effect at your home. Last but not least, its not that serious, its a pay day loan, that you did up to 3-4 years ago, pay it or did not pay it, so what, unless thst company have put that debt in writing and have sent it to your current address, do not give them you information and tell them do not call , if they continue, just block their call. I had the something to happen to me, and I am a collector, blocked them and live to answer another day. Do not give them no info, let them tell you, better yet, wrong number and hang up, they skipped you down anyway to get your info, they have to get you to admit that they are calling the right number, so do not answer, good luck

These people keep calling harassing me. They accused me of owing a E-payday loan from God knows how long ago. These people were so rude and disgusting. They were using this scare tactic. I know I do not owe any payday loan. the scary thing is that they have my address and social security number. Can anyone tell me if they know a company by the name of Southern Assets Recovery. They keep calling me and harassing me. I need an opinion on the steps that I should take, considering they have my address and social security number.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or

?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I just recieved two calls back to back with the second leaving a message, Stated I had till 2pm EST to contact them back. I have been caught in this type of scam before but not again. I had Payday loans severl years ago and payed them all off. Now every year about this time I start getting calls herassing me. They do the same thing over and over, tell you they are sending a person to arest you and so forth. I called and have no charges against my name anywhere. So, their little game is called.

From what I understood when I read thru the "Fair Debt Collection Act", or something like that, I can't remember the exact name of it for sure...anyway...
Any collections Agencies are NOT allowed to "Legally" threaten any consumer with "any" actions they do NOT "Intend To" &/or are NOT "Prepared To" ACT UPON!
ie: if they threaten to take you to court or put you in jail, whatever threat they are making... they better "Be Able To" &/or "Fully Intend" to follow through with whatever threat they have made!  If they are merely using the threats as a "Scare Tactic", and it is brought to the virus or the D.A.s attention, It could mean sizable fine(s) for the person &/or agency!
But Please, don't "take or rely upon my word" for the above information justvin case I have misinterpreted any of what it states in that particular act, incorrectly! Rather, use this information as a place to start "Your Own" investigation as to what "Your Legal Rights Are" when it comes to "Debt", "Collections &/ or Collection Agencies", etc... and what they "Legally", "Are & Are NOT" allowed to do when trying to collect a debt!

Repeated calls to the company with the name Jozita Williams involved in the recording.  This person has not worked for the company in quite a while.  Also when opting out of call, it is ignored and the repeated calls have been regularly received.  Would like to place a stop calling request as I read that these calls are scams

If you are wanted for passing a bad check, county authorities will contact you through the mail. Do not believe that you are going to be arrested for this based on a phone call. I've gotten the call from the same number, and I'm not in any kind of financial trouble.

County authorities would be the ones coming after you if it were a bad check, debt, etc. And if they were, it would NOT be through a phone call, and DEFINITELY not without a letter in the mail. If you haven't gotten a letter, you probably don't have to worry.

Either way, if you have outstanding debt, you should still contact the county prosecutor to see what charges (if any) have been filed against you.

This number, however, is an obvious scam. So don't sweat this one.
