Absolutely. If you have not already done so, send them a letter VIA certified mail (do NOT fax), with return receipt requested demanding validation of the alleged debt. Per the Fair Debt Collection Practices Act, they have five days to respond. Be sure to keep copies of everything you send. If they continue calling or attempt further collection attempts after you have proof they received your letter without validating the debt, they are in violation of the law. Below is a good example. You can fill in the blanks or use another template of your choosing:

Today's Date

Your Name
Your Address

Collector's Name
Collector's Address

VIA CERTIFIED MAIL

Dear {insert name of collector or company},

I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

In accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

I respectfully request that you provide me with the following information:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state)
Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

Because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense.

You cannot add interest or fees except those allowed by the original contract or state law.

You do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA.

Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

Debt Collector
I received a call from this number twice; it's been almost a month since the last time they called. They called me over a $300ish dollars that I owe while at hospital. They said it was for the care they gave to my son after delivery. The weird thing is that I don't have any sons, and I told them that already. I have only two daughters, and I have never been to the hospital they said. But they keep on sending letters to my home. they told me if the information they have is not true, to write at this address : 1825 Barrett Lakes Parkway, suite 505, Kennesaw, GA, 30144
Or fax it to a fax number they provided, and to who to send it to, and what's the person's #. And explain that this debt has nothing to do with me....
Should I do that or not? Because the person who was talking to me is the same one I should fax my letter to. Why should I explain it in letter while I'm already telling him every reason why this debt has nothing to do with me? Any advice pls.

COLLECTION AGENCY DEFENSE: 1) WRITE LETTER (SEND CERTIFIED!!!) 2) IN LETTER DEMAND THEY STOP CALLING YOU AS APPLIED UNDER FTC RULES 3) DEMAND THEY VALIDATE DEBT-VALIDATE DEBT-VALIDATE DEBT!(usally they can not) .WITH ALL DATES, CREDITS,CHARGES,ORIGINAL SIGNED CONTRACT AND ANY OTHER INFORMATION. THEY MUST ANSWER IN WRITING.4) DO NOT TALK THEM ON PHONE!! DO NOT SEND THEM ANY MONEY(THIS RESTARTS STATUTE OF LIMITATIONS CLOCK!) ) DO NOT SIGN ANY AGREEMENT TO START REPAYING! IF YOU ARE SUED..MAKE SURE TO APPEAR IN COURT(THEY WIN IF YOU DON'T SHOW UP. 5) MAKE SURE TO COPY & CONTACT ALL CREDIT REPORTING AGENCIES ON YOUR DISPUTE. IF YOU BELIEVE YOU ARE OVERWHELMED CALL AN ATTORNEY OR FREE LEGAL SERVICES. MOST STATES HAVE 6 YEAR STATUTE OF LIMITATIONS..THE AGENCY WILL TRY TO TRICK YOU AND STEAL FROM YOU. Fight back...don't let these crooks win.

I received an automated message and decided to listen through.  they told me they were collecting on a debt.  When i called they told me an amount I owed (small amount) from a hospital visit and wanted me to pay it right then.  I told them I needed to investigate it first.  When i called the dr. they told me i had a zero balance.  I called the number back again over 24 hours ago to tell them that they would have to provide me with additional information, account numbers, phone numbers, and fax me a copy of the bill.  They have yet to call again.  Wondering if I am being scammed and by telling me such a minimal amount of money $30ish dollars, that I will just pay it to get it over with.

I receive a call from this number once or twice a week. There is no option to speak with anyone to remove my number from their call list. When I answer there is a recording asking if I am (a name is given which I will not list here) and I'm given the option to hang up if I am not that person or hold for a message. I've only held for the message once because I'm usually at work when I receive the call. I could continue to ignore it, but I'm aggrivated that this automated system keeps calling at such an inconvenient time. I've added my number to the do not call list, but I guess this type of caller is not applicable. I've read that this is a debt collector. I've only had my new number for little over a month and these calls began within the first week. I'm very certain the debt is not mine.
