Received a call yesterday from a Nicole Jefferies stating that I will be sued because of complaints filed against me.  They will be contacting my employer (HR) to establish any assets I may be getting in the form of wages.  They left the phone number and her name on my cell plus the information listed above.  I had my attorney contact this number and she indicated that she just got the run around.  I have received not documentation to appear in court or from any collection agency regarding what ever she was talking about.  All my pay day loans have been paid off ages ago.  However, she didn't say anything about a pay day loan just that I had a number of complaints filed against me.  Based on my attorney's recommendation I am treating this like a scam.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

They are calling me on a debt that was ACTUALLY PAID 2 years ago.  I have written proof of that and when I ask them to give me a fax number or email address that I can send the proof to all they say is too bad you're being garnished, call me a deadbeat and hang up on me.  I called her back 10 times in a row and told her I had the proof but they have no fax machine or email.  YA OK SURE.  I have yet to see a summons for court or a wage garnishment.  They can bite me.  I DID have bad credit and it took me 2 1/2 years to clean it all up and this is how I get treated.   Shoulda just left my credit the way it was because cleaning it up is giving me nothing but a headache.  They see I paid everything off and still try to scam me into paying stuff that's ALREADY BEEN PAID.

They call my husbands phone all the time. So far she has claimed I'm going to prison.They have a deposition on me (what ever that means). I'm gonna be served tomorrow. The list is endless. By the way did I tell you that they are calling my husbands phone and saying this not mine. My husband just says hold on a minute let me turn on the recorder and they hang up. :)

Received a call from "Nicole Jeffries" at RSB Equity Group this morning.  She said they have a complaint against me from a financial institution and are proceeding with wage garnishment.  This is total nonsense! This number is going on my "block" list!

Got a call today answered and she's goingona bout wage garnishment. I informed her that who ever she was calling on behalf of should cotnact my attoney as I fined bankruptcy 2 years ago and hung up.

Also found this for anyone who gets a call regarding a PAYDAY loan from any companies that fall under MTE Financial. Please note that this company is run by an American Indian tribe: The BBB could not find the actual business at the location the business is registered with. Also, the government has filed an injunction against them. This American Indian tribe does not follow any set rules, be careful and ask for verification is debt. Most collection agencies will not be able to prove the debt is valid.

Got a call from these jokers too, First call they talked about wage ganishment, verify employement, etc. I just took them to take me to court. Then I called back a couple days later, asked for their address and they would not give it to me. Then I proceeded to discuss how they got my information and to also verify debt. They told me my account balance was not large enough  to make it worth their time to do anything so they were going to close my account. So in other words, they don't have s*** for information. They could not give me the name of the person who they got my information from, they are not getting it from the original creditor (MTE Financial), if there even was one. They talk tough but once you know the right questions, they start hanging up on you and close the account. I do not expect another call from there crack heads again. I'll be waiting for the next company to do the same.

Yes i just got the same call - caller ID reads - RSB Equity Group and there is a garnishment suit against me for a payday loan about 3 or 4 years ago. Funny i tried to pay the payday loan back by offering money order or western union but said they didnt have an address to send anything to and to just give them a valid account number didnt even care if it was mine they just wanted an account number from someone to pay my loan. Now alll of a sudden they have a live person calling me suing me and going to place a wage garnishment against me unless i pay them right now over the phone. Got this call at work - i have been told in the state that i live in wage garnishment is only lawful if you owe the IRS or Child Support and i dont owe either. they cant do a wage garnishment for a payday loan.  She said she will keep calling me at work and will talk to whoever she wants until she gets money from me.  What is the number to the attorney general because this is ridiculous. Why dont they get a real job

I also received a call this morning.  Those people REALLY like talking "over" you when you are trying to tell them to stop calling.  Told her I was at work, she said she knows that.  Told her to stop calling, she said no, she said they will keep calling me.  Told me there is a "garnishment in place" to be filed against me.

Here's a newsflash for these morons...  1. I work for a collection attorney.  To file a garnishment, they have to first file suit.  2.  To file suit, they have to have a valid claim.  3.  The statute of limitation on the loan they are calling about expired three years ago.  4.  They can eat dirt.  5.  Sent out my cease and desist letter.  6.  If they violate the cease and desist letter and call me again, I will sue them and I will win $1,000.00 per violation.

BY THE WAY, IF THEY CALL YOUR EMPLOYER YOU CAN SUE THEM.  THERE ARE LAWS PROTECTING DEBTORS.  THEY CANNOT, BY LAW, DISCUSS YOUR MATTER WITH YOUR EMPLOYER, YOUR BABYSITTER, YOUR FATHER-IN-LAW, YOUR GERMAN SHEPHERD.

She has called me several times and I stop answering. She now has begun calling my mother.  Its a scam phishing for info.  She claims she is going to garnish my wages but I dont have any wages.  Im going to  call her everyday all day until she  stops calling  people. Posted this on facebook and all of my friends will be calling  as well.

I got a call from this number today, the lady was rude and hung up in my face. When I called back a guy answered and he said I owed  $1000  from a pay day loan and they would begin garnishment on Monday, but if I would pay $375. they would settle it today. FRAUD!!! I reported it to my Attorney General's Office.

I keep getting calls from this number --today at 11:08,11:12,11:20 and 11:21 plus my place of employment got 8 calls from that number. My HR manager said the woman was so rude and was screaming at her.  I sent a registered letter out today and told her to stop the calls--she has been calling me for a month and wants my Credit card info.
