A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

When you do pay them tell them that you want the pay off amount because they won't included that in your last payment. I had 9.62 in interest and they charged me 768 dollars because I didn't pay that amount.

Call came from 888-242-2591 to family members who told me the caller was "very threatening".  Family was so concerned that they contacted me with number and name of the caller.  It is the name of a famous football player- likely chosen to be fictitious.

I got an answering machine that sounded like someone's personal answering machine. So I do not think this is legit... and esp if many other people are getting a similar phone call.

This number called me 12/31/12.  I didn't pick up so they left the same message as other reports- "This is an important business manner, not a sales call." I called back the number on Caller ID and not the number on the message and a woman answered the phone with no company name.  I asked what this was recarding and she said, "Let me know which number that called you and I will let you know what this is regarding." And when I asked any questions at all as to who they were, she said, "Have a nice day ma'am" and hung up.  I don't have any debt so this is total scam.

Okay..it is a collection agency. They are idiots who do not follow the law. We filed our debt under a chapter 7 Bankruptcy. These idiots think that they can still call and the average person will not take action. Ask to speak to the manager. He did listen to me and I am off their list. We do not owe anything yet I did have to trace the call from 702-944-4130 to 702-944-4117 which is their main address and phone number. The receiptionist told me that it was in error. The manager told me he had no debts showing. Plus by law they have to provide you with the original creditor in writing giving you the chance to dispute any discripencies within 30 days. Problem solved!

A lady left a message on my voicemail today(call time stamp was 10:50am). I couldn't understand the first name(I played the message over and over again but couldn't make out the lady's first name) but her last name is Alvarado. She said that she has information in the office about a warrant for me and my husband and asked to call by 5pm today. She said she can be reached at 702-944-4130. I was curious who called me, so I called the number back and I got a voicemail saying, "Zoraya is not available, please leave your message!" The first name of the lady who was calling was definitely not Zoraya, it was different. I searched for area code 702 just to check where the call was coming from. Then, there was a site where you can type the telephone number to check who it belongs to..then this website came up with all these comments about this phone number.

Got a call from 702-944-4111 and received the same message as Ashley when I picked up.  I used my work phone (which typically appears as a blocked number) to call 944-4130 and the call first went straight to voice mail with the message "Sorry, 'Mariah Alverado' is not available, please leave a message..."  This is a very suspicious response, and I do not suggest anyone answer the call or attempt to call the number back.

Received a call from 702-944-4130 on 1-21-10 around noon.  When I answered a man came on saying "This is an important business matter, this is not a sales call, please call us back at 702-944-4130."  The called ID said "Sentry."

I received a call from this 702-944-4130 and when I tried calling it said that "unable to complete the call as dialed" which it only means that this number has a different area code of las veegas (702).

Got a call from some lady at work.  Did not identify where she was calling from.  Said we owed money from breaking a lease from a rental which was not true.  Tried to call back and got no answer.  Then received a call from a man a week later saying the lawsuit for this was already filled and I would have an officer coming by to serve me the papers and if I refused the papers I would be arrested.  Never saw a cop. Funny thing about all of this nothing in the mail about any of this or did they ever call the house.  If this was legit they would have tried to contact me at the house.
