The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. I keep having calls from this number sayin it's Jeremy he's called my dad my uncle my grandma that lives over 200 miles from me my dad stays on fl I'm in nc and my friend messages me on fb not 1 but 2 of them saying this guy name Jeremy calls my phone asking for you and harassing them and he's apparently going thru my friends on fb bc one girl I never talk to since high school but were on fb now I call him he telling my something bout a loan?!?! Then tells my dad saying it's a bad check I don't own checks bc I rather use my card anyways then he tells my friend I have a debt from a bill and my other one it's about a credit card ok I never had a credit card anyways he said I owe over 700 but will settle for 450 and then I ask for the company so I went ahead and paid some and we'll my card got broke so I went to cal then to let then know it was cancelled guess what a number disconnected. So I called my bank told them what happened and they filed a report and guess what they calle back cussing me out and told me I did something illegal I said what taking my money back for my kids from greedy scammer alike y'all he got mad and cussed me out i told him keep on bc my phones wing traced he hung up people plz beware don't be scammed I was scammed 2 years ago and can't get my money back :( over 700 ask questions do ur research

I received a call from 713-568-4554 that I need to call them regarding a law suit!  I knew it was a scam but since it was a local number I called anyway!  When the person answered the phone she asked me for the last 4 digits of my SS# and i told her that s he should have it since they are suing me!  She said hold on let me get a hard copy of my documents from the attorney's office!!! Then she comes back and says that I need to speak to the legal assistant Monican Harper regarding my dept!  Since I knew it was a scam I just hung up!!! Less than a second Monica Harper called me back from 713-893-8906! I declined the call but when I blocked the number and called back she just said hello!  I will report these numbers to FTC and these are not the only numbers hat they call from!!!!! SCAM!!!!

i received the same call from this guy Jeremy Swiat, and he advised that i owe from a payday lone online and that he is going to summons me paper. I called the sheriffs department they called and send a fax form to their office and when i called them they are not answering at all. Thanks for all the feedback people...watch out for these people..

Ok so I got a call from Jeremy Swiat, he is by really rude and claims to be from a law firm dealing with a payday loan from 7 years ago that I did not pay. claims he is going to come to my state that I live in and " Serve me" really ? Come on up Jeremy we can have a date ay my local police office for the herassment and the scamming you are trying to do. lol

I would like to say that this is a SCAM!! Here are the red flags:  (1) Calling from a restricted number (2) using a companies name that can not be located on Google...if this were a legit firm please know the company would have a website (come on it is 2013).  (3) If these people are located in Texas...and we all live in other states...how are they going to locate you and serve you, they don't have that right! And all of these "positive story" reports are probably people within that organization posting fake stories to get you on their side. Let's be real, if 90% of the posts say scam...it is in fact a scam. Don't send them any money!!

I have been receving threatening and harassing calls at work and on my cell phone from this guy.  I don't  know who this guy is or what's this all about or how he got my number. He has threatened me said he was  taking me to court he would be filing all the required paperwork on July 23, 2013... Is this a Hoaxs?! He doesn't even say what company he is calling from. Who he works for!! Someone needs to put a stop to this guy!!!

I just got a call yesterday from a Marshall Barone stating I owed money and he would be here between 4 and 5 pm today. Well its 6 pm now and nobody showed. I called the number he gave me 713-893-4340. They said I didn't pay a payday loan for $500 and I now owe $2,098. I said take me to court as I never had the loan. Beware of this scam.

This is a bogus company.  The people calling you are reading from a script, and they don't have any idea (or maybe they just don't have morals) they are breaking the law.  They probably saw some ad on the side of the road about working from home and making big money.  They file as a FOREIGN LLC... that should put up a red flag immediately.  If you pay them, you're only helping to fund FOREIGN criminals and DOMESTIC criminals.  

To the people that keep calling and using false names and threatening lawsuits:  Get a real job, even if it's working at McDonalds.  You are just helping fund a FOREIGN organization that thinks they can make money like the MOB.  STOP making these stupid and illegal threats!

I got a call from this company from a processor that said I would be served with papers between 4:00-5:00 tomorrow. I know that you don't get a courtesy call from processors to set up an appointment to get papers served so this seemed fishy to me. I called the company they referred me to and said I believed this loan to be paid off. I also asked for validation of debt and they said they couldn't provide me with any validation of debt on a payday loan. I asked them for their physical address and they said they didn't provide it because of shooting and bombings. This company and their representative definitely seemed off. I plan to report them to the FTC, BBB, and my state attorney general. I will send them my paid in full paperwork and see what response I get.

Really?  The first you heard from a debt collector about this was a phone call about a lawsuit?  Sorry but I don't believe you.  You mention nothing about them sending you the required debt validation letter, so I'm assuming there was one.  That means they are a scam company and that you are a shill for them.

I don't know why all you disgruntled people post all these bad comments about Mr. Swiat. He called me about a lawsuit that was being filed against me for an unpaid loan. I told him I got way behind because I lost my job and he said I could make $50 payments till I got back on my feet. I was skeptical when I read all the comments here about it being a scam but I took it with a grain of salt. My first payment ran today and I got an email conformation right away. I will have my account paid off in 4 months and I'm happy to have it off my shoulders.

When you get calls of this nature, report it to the FCC. That's what I did. Then I informed the caller that they had been reported to the FCC AND offered to give them the reference number. The calls stopped after that.

Received a call at my work from a Jeremy Sweart, claims to reppresent Advance America (payday loan company) i have never had a loan with this company, threatended ot have me served at work with a summons, i asked for the company name phone # address, and a copy of the loan and he became agressive and advised if i was going to employ "stall tactics" he would do the same and have me served.

So not give in to these people they just want to collect money from anyone they can whether is it your debt or not.
