Yes, they are scum!  I've been victimized by them as well.  Please DO call / file with all the agencies listed above.  WE HAVE RIGHTS & it's a shame we have to do all this to protect ourselves, but it's the remedy we have!

First of all, you can relax. Law enforcement agencies, such as a sheriff's department, don't run errands for debt collectors. What you described is an illegal attempt at scaring you into divulging information about your daughter; I say illegal because debt collectors are forbidden by federal law to divulge anything about a consumer to a third party -- even if that third-party is a relative. Also, it is illegal under federal law for a debt collector to make false threats -- such as falsely threatening to sue or subpoena a person.

Secondly, Amy McDonald is a shyster who's in cahoots with a particularly sleazy debt collection operation called Beck's Creek Industries. Beck's Creek is not a law firm but has, according to other reports, falsely represented themselves as such; impersonating an attorney is also illegal. There's a good chance that the call you received was from Becks Creek and that they were just using Amy McDonald's name.

Here's what you and your daughter should consider doing:

1) File a complaint online with the Federal Trade Commission at https://www.ftccomplaintassistant.gov/FTC_Wizard.aspx?Lang=en

2) File a complaint online with your state's attorney general, the contact information for whom is at www.naag.org

3) File a complaint online with the California Attorney General: http://ag.ca.gov/consumers/general/collection_agencies10.php

6) Alert the FBI online at https://tips.fbi.gov (These people used a phone, which is a federally regulated utility, to violate federal debt collection laws. I'm sure the FBI would appreciate a heads-up about this.)

7) Sue for damages.  Many consumer law attorneys work on contingency, so don't worry about not being able to afford legal help. There are many such lawyers who practice in this area and would, I'm sure, be very interested in pursuing the matter on your or your daughter's behalf. I eceived a call from 714-579-3139 stateing that his name was Mr. Ric calling from the Law Office of Amy McDonald and that they wanted to make sure I was here because they were going to send a sheeiff to subpena me to Court. He asked several questions since I did not give him my real name and information.  He wanted to know about my daughter, how old she was and when I could be reached.  I am very ill and have sever anxiety issues as well as on oxygen.  This man scared me half to death and wqould not give ma a straight answere. He said that he is just foing his joib, they give him a file , he calls the phone number and informs the person that they are sending the Sheriff to my residence to subpena me for court.
