I received a call from this number and said they were division one looking for me . They said they were serving me papers but didn't say what for. The girl on the phone said not to have any big dogs on the premises . Now they said they were coming to my home or work environment to serve me papers today well they said between 9-5 and to have my state I'd ready. Now I've had papers served to me for a different thing and never once did they ask me for my state I.d . Back in April I was a victim of scam and the lady on the phone sounded the same as the lady that left a message on my phone. Well I dialed the 18006281460 number they gave me I blocked ny number out and they just answered " how may I help you" they didst state the company's name. Now I find that odd. Don't return their call. Its a scam to get money.it is now 6:40 pm and no papers were served. And if I recall they seem o always call on a Fridaywhich is stang. And at the end of her message the lady says best of luck to you. Now that's what's weird. Ya don't answer this number they say they serving you papers to call them so they can get money out off

I got a call from a Martha Wagner of Los Angeles county stating she had some court papers from some attorney filed against me or was unsure if I was from my attorney but to let me know they will be sent out next week I have to sign them, she gave me the number to call and the case number, we'll Then I called the phone number and spoke to a Susie Meadows from Segal, Bennett and Assoc. She told me this was a cash loan from company called Cashline I applied online that I borrowed back in 2008. She only had my ss number and email address. So tell me does appear a scam because the phone numbers are from the same area code 716-568-7613 and the other number is 855-657-8580. They started calling me this past Friday. I don't ever remember this loan I borrowed. They even emailed me a statement letter to my email showing me the balance. What can I do to find out if they aren't scams

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.
*********************************************
Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Be sure to save all your contacts with these frauds. Record all your calls. Save all your voice mails.
Not only are they in violation of the FDCPA, they are in direct violation of state law as well. Impersonating an officer of the court is a felony. If they are operating in the US they can be brought into court. It sounds to me like you have a slam-dunk case.
Retain a consumer attorney. They can be easily found and many will take your case on contingency. No money up front. Inform your employer of what is going on. He may be entitled to damages as well.
If you just want the reptile to go away, simply tell him that all his efforts are for naught. He'll never get a dime from you and that you're aware of your rights. Once they're made aware that they are being recorded, most will burn your number. Frauds hate to be out-witted.

Was called by the "Comal County Representative" that they are trying to serve me paperwork. They gave me the above number and said it was the Law Office of Segal, Bennett, and Associates. I called the above number and spoke with a Jessica Ortize. She stated that the charges that I was being charged with stemed from a loan I took out in 2010 from a pay day loan company (which I never did). She stated that she could stop the charges and stop our scheduled court date if I payed them $5,900. I said no, take me to court. She said fine and hung up on me. I waited to get served my papers by the sheriff and nothing. I was called at 2pm by the same person who claimed to be with he sheriff's office and when I told her I had called the sherriffs department and they had no record of any papers that I was getting and that the charges that were being filed would not be with them anyways. She told me that the processer was actually a private company and that they tried to serve me today but that since I refused the papers she had no choice but to get a warrant issued for my arrest but........if I called the so called Law Office again that it might not be to late to get it taken care of out of court by paying the $5,000. Again I said no, take me to court. I asked them what my court date was and she said that she couldnt tell me that. I asked for the number to the person serving the papers so I could get them. She stated it was to late unless I agreed to pay the money. I then hung up on her and called the Comal County Courthouse and spoke to the County Clerk who looked up my name and I was not on the docket in any County or City Courtroom and that there were no charges filed against me by anyone. This company is in New York and can't even serve anyone papers with a court date unless charges are filed with the county clerk. So this is a scam, DO NOT GIVE THESE OR ANYONE WHO REFUSES TO GIVE YOU INFORMATION ON THE CASE EVEN OF THEY KNOW SOME OF YOUR INFORMATION!!!!

I got a call from this office several days ago. First they called a family member stating that if I don't call them back they had someone standing by to server me with legal documents. I'm suppose to make a payment by yesterday in the amount of $1,026 if not they will server me papers to show up to court. I called the number that they called me from and was told that no one by the name of Patrick works there... They did say this was for some type of payday loan over the computer. First of all I did not make a loan and second of all they are harassing family member to get a hold of me. Not sure what to do now as I'm stressing.

GOT A CALL FROM SEGAL, BENNETT, AND ASSOCIATES stating I missed 2 court dates and a warrant would be issued for my arrest. I have never heard of them. He threatened me and said some things I don't repeat. This also happened to my son a week ago the supposed people he owed said don't give them any money. If you owe a debt like this go back to the place and make arrangements. They have called over 10 times and are rude and obnoxious. They even called my friend I think they got her info off Facebook. Got calls from Stacey Bush of Segal, Bennett and Assoc saying that they would be serving me papers. Somehow they also called me from a number that seemed like it was from the county courthouse but when I called the number back it was a non-working number. I guess there is a way to do this. Anyway, my friends and family have told me that they have received calls and messages from the same number 1855.497.4105 stating to them that I'm going to be served paperwork on my job. My friends and family have nothing to do with co-signing or anything so I'm not sure how they got their numbers and I don't think it is legal to be divulging private information (true or untrue) to anyone who is NOT involved. A gentleman called my place of employment (a school) and told the secretary that he needed to speak to me to serve me papers. I don't exactly know what to do but I feel like my rights have been violated specifically since I don't owe some debt that they can't even provide me proof of. I don't know how I got tangled into this web of decit but I wouldn't wish it on anybody. Somehow private information is out to the public.

I received a message on my cell phone and place of employment from a Jada Dawson.  She claims to be a legal courrior.  She sais I had 72 hours to return a call or she was going to serve me.  I returned the call and some guy who didn't give his name answered.  I asked to talk to Jada and he had no idea who she was.  He asked who I was and I didn't give him any information.  I told him I was turning this number over to the FBI.  He didn't have anything else to say.  The number that called me was 855-693-7745.  When he answered the phone he just said law office..........what attorney answers the phone like that?  He did say the law firm was Segal, Bennette & Associates.

He then gave me a number to call 1-855-693-7745 and a case number, and told me to ask for a stop order. I called number and spoke to a person stating if I paid $619.00 on a payday loan I supposedly defaulted on, they would activate the stop order. I asked them to send the documentation to my email address and still have not recieved anything at this time. I could also hear a lot of people talking in the background, sounds like a complete scam.
