DON'T DO ANYTHING.  Certainly, don't make a payment arrangement.  These guys are obviously not for real.  After i wrote this post back in September, I got another call from the "paralegal" Keith Miller.  He promised to serve my subpoena at my place of work, but he never showed up.  He gave me this bs about requiring a direct supervisor to witness the service.  In my profession, I work closely with the court system and I know how process service works.  There is no witnessing process service. In fact, in my state, the recipient doesn't even have to sign acknowledgement of receipt.  Mr. Miller told me he lives in my town, but I know that is a lie, because I am familiar with most process servers in my very small town. Furthermore, they don't call first, they just show up. I came back into this forum, because I received another call from him today.  It has been 3 months since I was originally supposed to be "served".  Since legal action is time sensitive, there is no way they would take that long.

I had taken out a cash advance over a year ago, and for unrelated reasons my bank account had to be closed before paying the loan off.  I tried to find contact information so i could resolve it, but was unable to.  So when I received the call from the "3rd party paralegal" (it should have occurred to me at the time that a paralegal is not necessarily a process server), and then i spoke wiht David, i thought it sounded legitimate.  I made a payment agreement (that i really can't afford).  THis all happened yesterday.  He did tell me that i was being charged with fraud and check deception because the account had been closed.  Luckily, I talked with my husband about it and he told me to withdraw the money from my card before it was to be taken out today.  I did that and sure enough David called me.  Before I called him back i googled his name and found this site.  I asked him for the name of the company that had given me the cash advance, and all he could tell me is that it is an adverse cash advance.  That is not a company name.  Also, when i asked him what iaa stands for, he said International Account Arbitration.  I cannot find that anywhere on the internet. I asked him to send me a statement or letter of intent, and he said that they had already sent one last month to the address on file (which was my old address). I gave him my new address and asked him to send it there. He refused to resend it, saying he would just send me a summons.  

I'm a little concerned, because he had my social security number, previous
address, work number and work email.

Everything that caller says is a lie.  He cannot send a third party to your work.  He cannot serve you with a summons.  The only thing he can do is call.  

He is trying to scare you into paying a debt you don't owe.  Hang up on him.  Blow an air horn in his hear.  Invite him over for a nice, juicy steak.  (He's probably Hindu and they don't eat beef.)  Have fun with it.  Insult him any way you can think of.

Tell him you sent the money but don't send it.  He'll ask for the number for the Western Union or Green Dot receipt.  Give him a fake one.  If you can't think of one try NCC-1701 or R2D2. Or 555-1212

If there's any chance he knows where you work print this thread and show it to your boss and the Human Resources people where you work.  Similarly, if he knows who you are related to show this thread to your relatives.  If he has your street address tell your neighbors.  All those people need to know that he's a scammer and is to be lied to, insulted, and deafened.  

Play with him any way you want.  Just don't give him any money.

Thank you so much for replying back to me he also said that he will send 3-rd pardy to my work even that person called me some Mr. Miller at work stating that he has to serve me summon i am sorry for my spelling but this is aufol i am so scared what is this what can i do to protect my self thank you very much for replying back to me ..

Only scammers and very shady debt collectors break the law by threatening people with lawsuits and arrest if they don't pay a debt they don't even recognize.  Even if you do owe a debt, odds are these callers do not have the right to collect that debt.  Again, it is a violation of federal law to threaten alleged debtors with arrest for failing to pay a debt.  Debt is a civil, not criminal matter, so there is no way you'd be arrested for failing to pay back a loan, even if you did owe it.

Another sure sign of scammers is the fact they refuse to MAIL you documentation proving that you owe a debt to them.  The FDCPA states that anyone who attempts to collect a debt is owed NOTHING if they refuse/can't/won't provide proof that the person they contact owes the debt to them.

Report the caller to the FTC, the FBI and your state's Attorney General.  Do not pay the caller!  You should also know that no one is given a heads up that they'll be arrested.  When "David" calls back, tell him that you've reported him and that your attorney (even though you don't have one) has said to record all calls made to you, for multiple violations of the FDCPA.  Do not let them scare you into paying a debt you don't owe!

some one by the name david called me telling me that i owe some money to them which i do not know what it is and i will be arrested if i do not cooperate with them i just got a call from him sounds very threthful to me.. i am so upset can any one do anything about it?

I got a call from 716-402-1404 A David Reno said he was from a debt collection agency.  I would be arrested if I didn't settle the debt.

This number is calling and threatening to arrest me if I do not give them money to drop the charges against me. They said They are from a debt collection agency for a loan that I never tried to apply for.
