I was contacted by Maurice Jackson at Cawley and Bergman. He called my 3 times in a row and then proceeded to call my boss twice (all in like a 2 minute span). He was very aggressive (no big surprise) and I told him I would call him back in 20 minutes because I was not comfortable discussing in front of my boss. I did call him back and he insisted that I tell them how much I could pay. I told him nothing. He agreed to send me a letter with all the info but they never sent it.
First he tried to build rapport and find common ground. Like I am that dumb. Once he could see he was getting no where he got really aggressive again and shouted at me. Then he put his boss on the phone and he gave me the same "We just want to help you" BS. They asked me for a post dated check to show good faith, but there was no way I was giving them anything tied to my bank account. They kept pushing me to agree to a number that I could pay, but I refused because in CA after 4 years they can no longer sue you. The 4 year period starts over again if you agree to or send a payment.

The people that actually make the calls for these scum sucking, bottom feeder collections attorneys are mostly drug addicts and alcoholics working in a smoke filled phone room with 20-100 of their ilk. They work there because no one else will hire them. They are the losers. The "managers" are just like them and are only people that have been there for more than a few months (high turn over, the drug addicts and alcoholics don't stay for long as when they get a little money together, they slink off to some dung heap to get high, drunk and dead). Don't expect anyone there to do anything about the behavior. They treat people like this because that is the way mommy and daddy treated them. And they treat everyone in their measly little worthless lives like this.

The verbal assault is very typical of ALL these types of groups. This is fun for them. Probably half a dozen of them laughing when the person assaulting you hangs up. Plus they will lie to you. Threaten all kinds of actions that they legally cannot do (like "The sheriffs deputies are on their way to arrest you, kiss your doggie goodbye because you're going to jail and they will be there any minute" and other similar threats) (it's b***s***). And some are brash enough to claim to be, or to allude to being, law enforcement or represent some actual part of an Attorney Generals or other legitimate government office. If you can catch them (as in a recording, or with witnesses) actually claiming to be a law enforcement officer, you might own them. You may be able to win a lawsuit and THEY will pay off all your debt, past and for the foreseeable future. And they may then be facing criminal charges. State laws will govern this, they are complex and vary from state to state. Probably going to take an attorney to really be able to get any real recourse, but it is possible sometimes. Mostly they are LLCs and don't have any assets just to isolate the real boss/owner from getting THEIR bank accounts emptied by civil suits.

The call centers are likely pretty removed from the bottom feeding attorneys that contract with them. So don't expect anyone to really give a rats backside even if you can contact the actual lawyers office.

The best way to deal with this, if you do have the financial means, is to try to settle the debt. But don't just send the bottom feeders money. The one that contacted you may NOT have a legal right to the debt they are claiming to be collecting. There is A LOT of scammery going on with some of these bottom feeders. Contact the original financial institution and find out from them who legally has the right to the debt. They don't want you to do any checking (that's why they will say just about anything and threaten just about anything to get you to give them money right then, right there, they want you scared and uninformed). A legitimate collector will be glad to get money (cashiers check, money order) through the mail. They will have a REAL office with a REAL mailing address. Never give them access to your accounts or a credit card number. Even the more legitimate ones will empty your account given half a chance. They don't care if your kids go hungry, they have a Mercedes payment to make.

Other than that, don't get too wound up, if you haven't received any paperwork/documents from a real court, there isn't much that they can do. And there are laws about who they can call, and when they can call. Again, these laws vary from state to state. Some internet reading my provide you with the information you need and procedures to follow to stop them calling other people and your work place. And in some instances people have won civil suits against some of these companies. Some for a lot of money. But then, you still have to collect (see above paragraph).

I am not an attorney/lawyer. So take this information as being worth what you paid for it. ;) For real legal advice, contact a real lawyer. It may save you some money. Maybe.

Also a note, blowing a whistle, or air horn or other annoying/loud noise into the phone, is not going to make their ear ring. May make you feel better, but that's about all it will do. The phone systems have signal limiters and filters that limit the loudness of sounds going through them. It may sound annoying at the other end, but that's all it will do. (I AM a communications technician)

Oh, also another note, the DNC (Do Not Call list) doesn't apply to political parties (note that the a$$hole politicians exempted themselves from this law like they are a ruling class, Atypical behavior), some nonprofit charities, and political action committees, Also entities (businesses/institutions) and their "affiliates" that you have done business with are exempt. So don't cap on the DNC list when you get these calls. Oh yeah, and scammers/criminals don't care. Since they are operating illegally anyway.

I could not understand what the woman was saying, horribly slurred speech. She was asking me personal questions (birthdate, ss#), would not clarify WHO (said the NAME - think it was Collee Bergman??) she was representing or WHY she was calling. I simply hung up on her, clearly some scam.

I have had ones like this call me before. I just find a quiet time of the day, call the # and pound them to immediately send me a docket # or get on with my manager. I inform them I am a stock broker and hold a license. If you really have a bad debt of mine with a docket #, and this is not a scam, then I will be fired as a stock broker. I am not allowed by law without compliance to compromise with creditors outside of work. I will berate them, and tell them to look at their childrens eyes tonight with their cowardly eyes.

After hearing a message from this firm 3 days in a row I decided to call back and find out what they want.  Unlike most others being harrassed I suspect that my husband's son by previous marriage( 53 yr old Jr) has once again managed to get some fool to sell him something and then failed to pay them. We are old and do not need any more stress.  I explained to the caller and asked him to please leave us alone...we do not owe anyone anything!!!  I can only hope.

This is real simple.  Just tape record the calls.  Let them rant and rave, use profanity, call you names, etc.  Don't retaliate as you are 'playing' to the tape.  After they have called four our five times, google a local fair debt collection lawyer, send him the tapes.  You will get $ 1,000.00 in damages for each call and your lawyer, your new best friend, will get a boatload of attorneys fee.

Recording the calls is actually a way to make good money.

I reeived the exact same call this morning, the caller was a female, she said she wanted to speak to my manager or someone in a higher position, I tald her to never call me back here again and if she need to get hold of me she need to contact me by mail.B@@#%$@#% I wonder if it is legal for them to harrasse us at work like that.. I have to investigate in case she call back again..I'm sure she will.

Keep calling for some lying deadbeat that we had never heard of until the liar gave our number as his number for his unpaid debts!  We just keep filing FTC complaints reporting this debt collection firm and the other two debt collection firms that call our number hundreds of times a month for the past year looking for the deadbeat liar.  The lying worthless deadbeat and these debt collectors who keep calling, even though we are not the deadbeat and do not know him and do not know where to find him, need to be locked in a room with a thousand ringing telephones that harass them from 7:30 a.m. in the morning until 9:15 p.m. at night, calling six times a day some times from just one firm, sometimes three times in five minutes, just like they've done to us.  It's to the point that it's not even our telephone any more--it seems to belong to the lying deadbeat and the debt collectors looking for him, as they talk on it more than we ever do.  Hundreds of FTC complaints filed, nothing accomplished.

These people are scum bags , they call my home looking for someone that does not live here , then the nasty so called little man wants to get rude with me , you called my house A***OLE I don't owe you s*** I have no doubt ,why don't you scam bags get a real DAM JOB , you only earn b what you collect from others that's why you like to make threats to try and collect , people be very careful paying any collections agency make sure you have copies of everything , money you paid them and any type of communication with them , I have seen people pay all the doubt off and the collections agency took the money and did not report it was paid off , All they want is your money, try and work the doubt out with the person you owe the doubt to . Oh by the way hang up on them and BLOCK them .

In May, I received a letter, so I called back.  This is a law firm of Cawley and Bergman.  The gentleman was very nice, and I agreed to a 50.00 per month payment plan, which was deducted monthly. After 5 months, I got a threatening letter, which I immediately responded to.  I received a call from a "Mary", who was rude, crass, and obnoxious, who kept reminding me that my calls were being recorded. I too recorded the call, which I will forward to the New York attorney General.  The original debt was only 300.00...this scum company purchases crappy little debts, then calls and threatens legal action.  This company has no jurisdiction in my state, which I verified.   The original plan was to pay the 50.00 payments, then they would contact me for a settlement amount, which I was led to believe would be a much reduced amount.  The "reduction" is 90.00 on a balance doubled due to their fees.  They are lower than pond scum, and unfortunately the ONE reasonable "gentleman" that I spoke with is gone.  I gave them the best phone number to call me on...they persisted on calling on my home phone, which is in number only, then berated me for "all the messages they left".   Again, I don't even have activated voicemail on that line.  Unfortunate that this form of highway robbery is permitted, to take a 300.00 debt, and jack it up almost double, then bully a sick woman into making a payment in full for more than the original debt AFTER the 50.00 per month "trial period" as they are now referring to.
And they wonder why lawyers are referred to as snakes....this firm definitely fits that description.

I keep getting calls from them...they are asking for a person with the same name only it's not me they are looking for.  I have a very common name, unfortunately.  They won't stop calling, even on the weekends!  Early or late - anytime of day.  They say it's an urgent business matter and that's it.  I feel very harassed with the amount of calls I receive.
