Called and said they were Brian and Benjamin Law Center.  I called back they said they never called us and our name was not in their data base.  I told them, "I just hit redial and you answered"  They said "thank-you" and hung up.  The phone reverse look-up says it is a landline in Buffalo, New York. There is no Brian and Benjamin Law Center in Buffalo, New York.  It doesn't even come up on Google.

I just got a call from this number.  Said his name is Mr (yup, he said Mister-weird) Willaim Ellington calling on behalf of Barnes & Stewart reguarding a physical complaint against my husband.  We need to call & make a statement  & they would give us a 'chance to make voluntary restitution'!  Said to call 877-285-4919 & Ext 108.  The call was made from Buffalo NY (we live in the midwest).  This is BU***HIT people!!!!

I got a call looking for my ex husband that I have even spoken to in nearly 30 years. I can't remember for sure (too flabbergasted at why they were calling me) but I remember Law Center and the Brian & Benjamin sounds right. They said they would remove my name as a possible relative.

These people called me and said I own money from a Sycamore company and I had to pay 1000 dollars today or there take me to jail I live in Nashville TN my account was frauded 2 yrs ago it was very bad

THey are fake, and jerks.  They threaten everybody with the same story.  It seems to be a new firm that was created by the fantasy network of criminals.  They used to be JW and associated, Law office of James Wheaton or Prescott James and Stewart, they are listing adds in monster as NRG and associates.  Report these troublemakers to your attorney general, and they are in New York.

Some woman left me a voice message at my work stating they have a legal matter that needs to be addressed with me. That Brian and Benjamin paralegals have called me numerous times trying to handle this situation. She stated if I do not call her back today then they were going to take me to court even gave a record number that make it seem like it is the court case number. I have no idea who these people are and can't find any information about them. Not sure if I should call them back or not.

Today is December 9, 2010...I received a phone call from Brian and Benjamin Law Center stating that they need my statement to put on file or something. They have to give me court date for me to go to court...because I owe some Payday Loan $500. It was a lady didn't get her name..I told her I was going to record the phone call she said, "Who gave you rights to do that"..I told her, I did..it's my phone and you're calling my home phone I can do whatever I want with this phone call. She said, okay, no thank you. These people been harrasing me...I want to report them. And they need to stop calling my house.

The Bryant and Benjamin Law Center is who they told me who they were. Referencing a payday loan from 4 years ago. They stated on my answering machine that they received a complaint from PaydayYes.com and it is being processed as bank fraud and passing a bad check. Also said that if I did not take care of it immediately I would be arrested and brought in front of a judge.

A few years ago I DID have a few payday loans. I got out from under it, which took me almost a year. So I did not know if there was one I missed, but I told her that I needed to protect myself. I am married with 5 children, and without some type of validation I was not just going to give them 1000 dollars. I asked for them to mail something to me, and she said that if they did that by the time it got to me house I would be in court. So they sent me an e-mail with a payment schedule. The email (I'm not kidding) came from bryantandbenjamin@gmail.com.

I also asked her straight if there were a law firm. She said yes. This is important, because this is a direct violation of the fair debt collections act. If these people call you, record the conversation and ask this question specifically, as debt collection agencies are not allowed to misrepresent themselves as law firms. I asked her for the name of a lawyer on staff so I could look them up with the New York State Bar. She said she was not allowed to give them over the phone because the lawyers would receive death threats.

I called the Attorney General to file a complaint, this is difficult because regulation of these companies is virtually impossible.

Register one anyway, with the Attorney General of New York.

Here is the scoop on them, though. They used to be Prescott Barnes, then changed their name to Bryant and Benjamin. they are NOT a law firm, they are a debt collector and are bound by the laws governing debt collection. That means they need to adhere to the fair debt collections act. Look it up. If they tell you that they will send the police to your house, do NOT be afraid. They CANNOT DO THIS. Debt collection is by definition a civil matter. People are not arrested for civil matters. The only thing they can do is file a lawsuit against you and sue you.

If possible, record any and all communications with them, as they will repeatedly violate the fair debt collections act, and you can use this to either reduce or eliminate any debt you MIGHT owe. I say MIGHT, because I found out later that I had indeed paid this loan off more than 3 years ago, and they were just trying to intimidate me into handing them money. Know your rights, and do not hand over your hard-earned money to someone who is willing to lie and be belligerent on the phone. That is how they make their money.

If the call, you should immediately send a cease and desist letter by certified mail. This means they MUST stop calling you. Your debt (if it is real) will still be owed, but they are bound by law to stop the phone calls. They are also not allowed to contact you at work if they know it will be detrimental.

Keep track of your credit report, and always ask for something through the mail. If they are unwilling to send you something, or unwilling to give you information about their company, something is up!

Chris, you cant write a cease and desist letter  to a company that wont give out their address.  You were smart to report them immediately.  Please report them to the FTC as well, and to Attorney General Cuomo's office.  Your help is appreciated in helping us with this investigation.  There are currently hundreds of complaints against Bryant and Benjamin Law Center, and you are not the only one that was told that they cannot name the Lawyer in charge for fear of death threats.  That is proof that they are full of it.  You did your homework, and your information is useful.  Make sure you look them up and make comments on other blog sites like this one.  You can google the name to lead you to 1-800 notes. It helps consumers beware of their intentionally fraudulent bill collecting practices.  They have at least 10 different numbers, and change the names of their "investigators" frequently.  They were jw and associates, and NRG out of buffalo.  The FBI is all over this company, and most of their #'s are being recorded daily by the FEDS.  Thank you for your help.  God Bless

I received a call from this number and was threathened I needed to pay $800 to these people in an hour or I would be arrested and taken to jail. I have MS and do not need this stress. After more investigation we found out they are fraud. My credit report is good. Has no debt owned to anyone. How do I stop the calls? They have now started to call my parents phone trying to get monies. Finally got Jan Allan, the caller, to give us a name. It is Brian and Benjamin Law offices. To me, they are the criminals.  Stop harrassing honest people.

Suzanne,  remember that in America you have certain rights and obligations.  I would ask you to please join the rest of us by making a complaint to the NY attorney generals office in Buffalo NY, and the FTC.  Your complaint will help them with the investigation as I understand is already underway.  Any victim of their fraud is eligible for up to 1000 dollars in damages if any monies are seized by the FEDS.  The FBI is currently wire tapping these idiots, and so the case is developing smoothly.  If you register your complaint, you may be eligible for the damages sought after they are captured and prosecuted.  GO to the attorney general's website for the NY state, and notice that Cuomo has shut down dozens of illegal collection agencies and confiscated bank accounts totalling millions of dollars.  They are currently being prosecuted in NY, and it doesnt matter where you live to be eligible for a complaint.  Calling across the state lines has caught the interest of the US attorney's office as well.  So please make your complaint official instead of just blogging it here.  I hope this helps you.

I received a call today from this number. They did not give me their company name and went on about personal information about a payday loan from 4 years ago! They told me I had 2 hours to pay them or they were going to take me to court, file a

against me for fraud, and have me pay double the amount that they said I owed. They refused to mail me anything in the mail as they stated they already had done so 30 days ago. They gave me an address that I lived at 4 years ago! Also, they said they were going to have to contact the post office to get a copy of an address forwarding..?? What?? I talked to a woman named DEBBIE SMITH at extension 124. She kept telling me that the business was not a collections agency, that it in fact was a law office. I probably talked to the same front desk guy who changed his voice 3 times, and then talked to 4 other women who kept transferring me. Debbie refused to send me conformation via MAIL of my account and proof that I owe money.. I then asked for their address. She kept asking me if i just wanted her fax number. FINALLY she gave me an address. 252 Chippeawa Buffallo NY 14202. She was very rude at the end and was stuttering after I told her she is in violation of the Fair Debt Collections Act.  I asked a friend to investigate and it turns up that this place called BRIAN AND BENJAMIN LAW office is a SCAM!

I recieved several calls in one day . Ireturned the call and finally got an answering service which asked for my ss#  no way did i leave it duh. They returned my message a week later only to tell me the was huge late fees and to pay over the phone they would not take pnt via the mail . hmmmmm makes you wonder what lengths will some go to to scam others . They will get theirs in the end .

someone with this same name gerald stone who states he is a PI called my home too, he was a total jerk and did not give me much info. he wouldn't even repeat his name or answer my questions. apparently its a collection agency, i tried to call back they did not have record of it the number it's like a main number they said there is a law office there but they didn't know who called i did some investigation myself and alot of people get the same call . I wonder if anyone else had similar situations.

I am in Ohio, got this call on home phone and cell phone, asking an out of state  relative to call. Sounded legit, gave the name Gerald Stone, of Bryant-Benjamin, gave this #, claim # & knew where relative worked. Don't like the idea that someone has all of this information!

Googled this number trying to get info on these folks....looks like alot of questionable stuff here.  I did receive a message both at home and at work which was not necessarily threatening but it scared me none the less, a bunch of legal words i don't really understand.  I called my attorney before I called these people back.....I let my lawyer do the work, after all thats why I pay him.  After going back and forth for a couple days with them, my attorney determined that their claim was legitimate, that they were within their legal rights to file a claim against me in my county and garnish my wages.....can you believe it, they wanted to garnish my check after getting a judgement against me! My attorney advised me to nip it in the bud before it got crazy expensive and just offer to pay the principle balance. Thats what I offered them, just what i owed, no court cost, no attorney fees, no interest or penalties. They actually accepted my offer and gave me until the end of the month to get the funds in.  All in all I think it worked out in my favor!

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

There?s no doubt about it: you are responsible for your debts. If you fall behind in paying your creditors ? or if you dispute the legitimacy of a debt ? a debt collector may contact you.

?Time-barred? debts are debts so old they are beyond the point at which a creditor or debt collector may sue you to collect. State law varies as to when a creditor or debt collector may no longer sue to collect: in most states, the statute of limitations period on debts is between 3 and 10 years; in some states, the period is longer. Check with your State Attorney General?s Office to determine when a debt is considered time-barred in your state. You can find contact information for your State Attorney General at www.naag.org.

Federal law imposes limitations on how debt collectors can collect debts, including time-barred debts. Under the Fair Debt Collection Practices Act (FDCPA), a ?debt collector? generally is any person or organization that regularly collects debts owed to others. The term includes lawyers who collect debts for others on a regular basis, but it does not include creditors collecting their own debts.

Collecting Time-Barred Debts

Most courts that have addressed the issue have ruled that the FDCPA does not prohibit debt collectors from trying to collect time-barred debts, as long as they do not sue or threaten to sue you for the debt. If a debt collector sues you to collect a time-barred debt, you can have the suit dismissed by letting the court or judge know the debt is, indeed, time-barred.

Whether a time-barred debt ? or any debt for that matter ? can appear on your credit report depends on how long the debt has been delinquent: debts that have been delinquent more than seven years cannot appear on your credit report, with certain exceptions. In addition, a debt collector may not try to collect a debt that has been discharged in bankruptcy, no matter when it was incurred. Contact with Collectors

Can a debt collector continue to contact you about a time-barred debt you don?t think you owe? According to the law, if you send the debt collector a letter stating that you do not owe some or all of the money within 30 days after you receive written notice of a debt, the collector must stop trying to collect until you?ve been given written verification of the debt, like a copy of the bill for the amount you supposedly owe. The collector can renew collection activities once you?ve gotten proof of the debt.

You can stop debt collectors from contacting you about any debt, regardless of whether you owe it, by writing a letter telling them to stop contacting you. Once the collector gets your letter, it may not contact you again ? except to say there will be no further contact or to let you know that the collector or creditor intends to take some specific action. Sending a letter doesn?t absolve you of the debt if you actually owe it; the debt collector or creditor still could sue you for the debt.
Future Collection Efforts

The best way to protect yourself from future collection on any disputed or partially settled debt is to get a form or letter from the creditor or collector that releases you from further obligation. I just got a call from this number.  Said his name is Mr (yup, he said Mister-weird) Willaim Ellington calling on behalf of Barnes & Stewart reguarding a physical complaint against my husband.  We need to call & make a statement  & they would give us a 'chance to make voluntary restitution'!  Said to call 877-285-4919 & Ext 108.  The call was made from Buffalo NY (we live in the midwest).  This is B***S*** people!!!!

A man calls (MR JAMES) says he works for Prescott & Burns keeps calling even after I sent cease & desist letters.  I looked up an address that he uses and called one of the companies in the same building and the man that answered stated that that business is not in that building.

Keeps calling asking for someone who never worked at our company.  Last call received 5/11/10 after I've asked them previously to stop calling the business line for someone who never worked here.  They continue to call and harrasing the business,  Claims to be a law firm but can never provide a legit manager, address, nor fax number.
