Per the FDCPA, you should not pay any caller who refuses to MAIL - do not accept email or fax - proof that you owe a debt and proof that your caller has the legal right to collect said debt.  Refusal to mail this documentation is a violation of federal law.  Making threats to an alleged debtor is also a violation of federal law.  As is claiming to be an attorney, when in fact, your caller is not.  Attorneys working as or on behalf of debt collectors must also comply with the FDCPA (Fair Debt Collection Practices Act).  More info on this type of scam here:

Follow the steps in what you need to know. A legitimate debt collector agency should not have a problem with giving you a real business name and address you can google and verify via google street view, BBB etc.

He claimed to be a lawyer with Edmund Recovery and he made some threats and said I was being sued for $2679 but they would settle out of court for $2000. When I asked for a copy of any paperwork or notice he said his secretary would email it to me but never did! Now I keep calling and no answer. What should I do because I do not want to get sued!......I indeed this is true!? Please help.

I'll file.  To quote an ex of mine - "if they could do it - they already would have"

Said he had a merchandise pick up order for me and needed to confirm the address-- sure.  What these fools don't realize is that a lot of us know skip tracers or ex skippers and know all their tricks.

The best line is that they have paper work and will need me to notify my supervisor of the situation and everything I've done wrong in my life.  Or better, yet, they will serve papers and I need to  have a witness and 2 forms of ID.  Fools.

Relax John! You may not be the only person in the world with this name..  Most of these calls are spoofed names & numbers, the scammers will make up any name at any given time! For example, I've noted a few posts where they claimed to be Special Agent "Gibbs" from CSI..   Most Americans know that it is a TV show and Gibbs is from NCSI..

So as you can see, the first poster was given a name at the time of the call, unfortunate same as yours! Generally a middle name is the difference. I know of at least 6 other people with the same name as me in my state alone..   Two I went to school with, the report card mix up wasn't funny either!

A quick search of your name reveals at least 4 people with the same name residing in the states of Colorado,Texas, and Florida. Rest easily. This is most likely a different person with the same name.

My name is John Swanagon. I am not, nor have I ever been, affiliated with Admin Recovery. The "wrong person" post at the top of this page is, at best, inaccurate (i.e. someone falsely using my name) or, at worst, libelous. I am a law abiding citizen and my profession is Engineering.

Yes, I too have gotten calls to my cell, work and friends and family. They do mislead you into thinking they are an attorney office and have filed a case against you in your home court house. They also have threatened to garnish wages. Has anyone ever been taken to court by them? They do practice strong arm misleading tacktics and all of them are illeagle.

I read that a class action suit can be filed for up to 2% of companies value.

Food for thought if anyone cares to join in.
