I recommend that you don’t even pick up the phone and talk to them.  We can send the Cease and Desist Letter to them.
If you happen to answer the phone, FIRST ask them for their address.  Don’t validate that you owe any debt.  Don’t offer any additional information.  If they don’t offer you their address, then tell them you have contacted an attorney and have been informed that their address is 4244 Ridge Lea Rd. Ste 6, Amherst, NY 14226 and that your attorney has instructed you to tell them that they were mailed a Cease and Desist letter and that they are in violation of the FDCPA (Fair Debt Collection Practices Act) and that you have a log to write down every contact they make with you from here on out.  Tell them your attorney is going to file a complaint with the FTC regarding their illegal acts and will also file for sanctions if they do not comply immediately.
They should hang up on you at that point

They've repeatedly called both myself and my daughter and say they're lawyers collecting a debt for a pay day loan I had taken out. They have threatened me with arresst. Can they actually have me arressted or are they lying to me?

I was just harrassed by a representative of this company..  Think it's a debt collector, but called me looking for my older brother whom I haven't seen in years.  Don't even know where he is..  When I told the rep that, he kept trying to get a tn out of me for him.  When I asked for his supervisor he laughed at me and when his supervisor (ya right) got on the phone his name was Mr Buster, he defended the rep and wanted to know why I was so upset about his re laughing at me..  When I asked for his boss, he hung up on me..

Keep the message, take it and any repeats down to the police station and ask them to have him picked up. If he lives out of state, too bad. It'll be a FELONY warrant that goes out.

You can also report this to the FCC. I have.

I live in WYOMING, not NY. I don't have any loans out so I'm not sure why they're calling me or how they got my cell's number to start with. I just reported them to the FCC and filed some paperwork on them at my local copshop. I don't believe in warning perps.

Hi.  They can't do rapid fire calling like that.  It is a violation of the FDCPA.  And, if they've called relatives about it, its a violation for each seperate call.  I am taking action with regard to this outfit- already- they have to been held to account for their inability to follow the letter of the law.

I have filed complaints with the FTC and have engaged an attorney about Eagle Asset Recovery and Unified Asset Solutions.  I HAVE HAD IT!  I was laid off 2 years ago and the pickins in the job market are still slim.  These b*****ds are beyond the pale!

I just got a call from a lady saying she was with VCS and Associates about a payday loan over a year old. She said I called them in March and made arrangement which I never did. The phone call I made was directly to the payday loan company and they would not work with me. I informed them that I had thyroid cancer surgery and have been out of work and still have not returned. I have no income coming in and they had the nerve to ask me how I was living. Even though this is none of their business I told them my husband receives a disability check which they can not touch. I asked for them to send me something in writing and she said they have already sent me several letters and when I told her I never received any letters she called me a liar and said I called their company in March which I did not and she called me a liar again. I told her that I did not plan on getting cancer and not being able to work and when I got back to work I would be more than glad to make payment arrangements. These people do not want to work with you, they just want to threaten you. Sorry but you will not be making your Christmas money commission off of me. They stay months without calling then they begin the calls again when they need the money. They are not the original company I owe and I will not pay anyone unless it is the original company. I don't care if you bought the debt from them or picked it up from my credit report. I do not owe you the money. If the payday loan company wanted their money they should have worked with me when I called them and told them the situation.

Recieved a call from this crazy lady threatening lady saying that we have this complaint against us and she was being rude so I hung up. She called back like two & three times when I finally answered she went off on me again so I preceeded to hang up again. I received a call from a different number answered it - it was from a man with the same company saying that he was an officer and that me and also my husband were going to be arrested. Ok so I went off on the man stating that he and the previous lady before were rude and I was not going to be talked to like that. He ask me if I had socks on my feet because I needed to go to Pets Mart and buy a muzzle for my mouth! I hung up! Pissed off I called back to speak to someone in charge and got Mr. Paul Brewer stating that he was the director. I started explaining to him what had happened and than he starts in saying that I am threating him and all this bull. He stated he had a docket number and all my information. When I question both people about the information they had they could not give me any information but stated a birthday that was not my or my husbands than I ask for documentation - they said I had received all the documentation that I was going to get! These people are crazy - DO NOT TALK TO THEM!

They just called me and told me that they received a complaint with my name and SSN on it and it i don't call them back today they are gonna file charges of Fraud against me.  Please PAYDAY loans are not legal in PA.  Keep threatening me and I will never pay you back and there is nothing they can do about it.  I have no extra money right now.

i just got a call to my aunts house from these people. they threatened me through my aunt, who is elderly by the way and is a very worrisome person, by calling her and telling her that i had a fraud charge against me and they were taking me to court. i understand they want to talk to me about debt collection, but why not just leave it at that instead of bringing out the "fraud" card. especially when the person they are talking to is not even the person being named in there "case". i read some laws on payday loans...as a consumer you CANNOT be taken to court for fraud.....im going to talk to them in a bit using the info from the posts on here and not give them any info of mine and see what happens...ill post on here again once i do

I contacted an attorney reference to these idiots who advised me of the following:

This is not an incorporated company.  They are nothing more than commission-based wanna-be bullies trying to collect on debts that are often times past the statute of limitations in one's home state or have been written off due to bankruptcy, and the consumer is protected under both cases.  If they don't collect off you, then they don't get paid.

I had the woman who called me tell me that, "she didn't make enough money to argue with me."  Of course you don't!  I filed for bankruptcy, therefore the loans that she's trying to collect on are covered and written off under the bankruptcy protection, and therefore she doesn't get a dime out of me or the so-called "company" she works for.  She also told me that she didn't feel that anyone should be allowed to file for bankruptcy and that I was nothing but a "lazy thief" for doing so.  Ha!  At least I don't make a living by trying to collect on debt that could easily be written off!

I'm just curious as to whether or not they send these people to school to be such "bullies" or if it's a prerequisite for the job.  It's so easy to act the way they do behind a phone from a work-at-home station; I wonder what would happen if they came into contact with pissed off consumers like me and some of the others they have called and threatened.

Anyway, I was told by my attorney, who is not only going after the two that belittled me over the phone, but going after the company as well through the Federal Trade Commission, to spread the word to others to do the following if these people call you and either you answer or they leave you a message to call them back:

1) Immediately let them know that you are fully aware of who they are-that they are nothing more than commission-based phonies acting like attorneys and law officers.  Also let them know that you know that they are not represented by any bona fide attorneys that can prosecute you in your home state.  If they say that they are, ask them for written documentation and a copy of the law firm's license number that represents them like my attorney did. Not only will they start back-pedaling, they'll likely deny you the information, telling you that it's information you don't need, and they will likely hang up on you.  What they fail to realize is that an attorney can subpeona every last bit of it.
2)  Let them know that you have legal representation.  If they tell you that "you're too poor to have an attorney because you can't even afford to pay your bills," tell them they won't be singing that same tune when the Federal Trade Commission finds them and arrests them for being in violation of federal law, and that the FTC protects the rich and poor.  I promise it will shut them up, and again, you'll likely get hung up on.
3)  Whatever you do, DO NOT GIVE THEM ANY INFORMATION!!!!!!!  By you giving them your information, they are recording your voice, and can fabricate tapes to make it sound like you gave them suthorization to drain your bank account and max out your credit cards.  These people are NOT legitimate debt collectors.
4)  Inform them after you have told them you know all about them that you will be in touch with the FTC and, if at all possible, before you tell them that, try to get their name and as much information as you can to give the FTC.
5)  After all is said and done, FOLLOW THROUGH WITH YOUR THREAT!  Contact the FTC and file a complaint.  Let them know what all has happened.  My attorney called them and told them they were being recorded, and they were still stupid enough to belittle me and my attorney over a recorded line, and the tapes are being submitted along with my complaint to the FTC, but filing a complaint doesn't require the assistance of legal counsel.  It can be filled by anyone.  ***FYI-Don't try recording your conversation without them knowing.  It won't hold up in court and the FTC can't use it.  If you're going to record them, you have to tell them in order for it to stand up in court.***

Told me that I owed a debt for a payday loan. Said I borrowed $400.00 and now I owe them $1300.00 for being late on the debt for under a month. It is an employee from VCS (Vision Credit Solutions). DO NOT GIVE THEM ANY INFO. They pose as court employees, sheriffs, and the police. They also threaten that if you do not pay them the money your "docket" number will be forwarded to the appropriate authorities and there will be fraud charges placed against you.
