Debtor's prison?  Please list the states in which people are currently being imprisoned for not paying their credit card bill or a loan.

The poster you are replying to DID talk about asking for validation of the debt -- why are you saying otherwise?

While some of the advice is good, some of it's really bad. You can be pursued for money's owed. Some state still have debtors prison for pete's sake. Verification and the laws must be followed by the collection agency, but seriously telling people to chance it instead of confirming the money's owed and taking responsibility is awful legal advice. Also, why would a professional attorney tell people to tell the collectors to **** off? That's your advice? Please be careful sir when you are representing our profession, oh and here's my info by the way:

Sir, if you were a real atty, you would have given truer advice.  They are a real law office, I had an old charged off account from Wachovia Bank.  After my business failed because of the economy and other reasons, I lost everything. I just walked away from the bank account and at that time 8/8/2009 I owned just 2500.00.(much of it was bank charges)  After my account had passed several hands it ended up with this law office.  I ignored all their calls as I did with the other collection agencies unbeknownst to me they were getting my account ready to be taken to court. I appeared before a judge, he added other costs to the amount all I could do was cry and shake my head to the Judge as he explained how much I owed and how much I will be paying,  I am a single mother working at a low paying job but I STILL have to make a payment each and every month.  I understand that I DO owe the bank for the over draft fees, but those other charges just seem so unfair, but I still have to pay because of the judgement.  Just wanted to let you all know what happened to me.

Debt Collector
I was just called this morning saying that I had an outstanding debt from 2004 which initially was in the amount of $250.00.. Due to my moving around several times and changing of my numbers I thought that this was legitimate. They told me that this was a courtesy call (mind you they called my office line) which is NOT registered anywhere! They said that it was their last attempt to get to me before my court date. They told me that they had tried to serve me twice with court summons but were unable to reach me.. They even went so far as to ask if I lived in a gated neighborhood (which I do.) And that could be a reason why I was not able to receive it. They said that if they have note that I did not receive the summons they could try to settle the debt for the initial amount which had turned into $900. I am leaving the country in a few days and they sounded so legit so I like a moron, paid with my debit card. IMMEDIATELY after paying, I googled the company and saw these posts.. I IMMEDIATELY then, called my bank and cancelled my debit card and as well disputed the charge.. They are taking care of it, and they no longer have access to my bank, but I even called the superior court to make sure that there were no summons, and of course nothing. This company is not accredited by the BBB and is B***S***..

if you pull your credit reports you will notice that this company has done an inquiry on you recently. they are fishing through a pool of dead accounts and pulling your credit reports to see if you have anything they can get from you - recent car loans or home mortgages. i enjoy screwing with them - make a game out of it and see how long you can keep them on the phone and how mad you can make them - they are just crooks

Dear Readers of these posts,

The attorney who posted on Feb. 2012 IS SO CORRECT!!!  PLEASE HEED HIS ADVISE!!!  I have some victims who have endured this same abuse.  My advise:  1. label phone number " DO NOT ANSWER" and save yourselves from stress.  2: report to the FCC 3. report to your Attorney General's Office.

Thank you for your excellent advice on these people.  I have read the other comments from concerned people.  My father received a phone call from a "Mr. Rockwell" looking for me, he asked my dad if I was still employed at a previous company, dad told them he does not give out any information to anybody, especially people like Mr. Rockwell!!  They've called me at work, but the message was pre-recorded, needlees to say I did not answer the phone, but they left a message, deleted it off the phone.

Prank Call
I got a call from these people earlier today. The call showed up as "Restricted" on caller ID. A female who obviously was from another county left a voice message. The message basically said I had better call them back or else and then wished me "good luck" if I failed to call back, implying that terrible things were going to happen to me.

This is nothing but a scam. No one should ever communicate with these people (criminals). Don't encourage them by calling them back. But if you must, feel free to unload on them for harassing you and let them know that's how you will respond every time they bother you until they stop calling.

"IF they do not provide you with the verification of the debt, the debt is invalid and not subject to collection.  PAY NOTHING TO ANYBODY UNLESS THEY PROVIDE YOU WITH WRITTEN VERIFICATION OF THE DEBT, AND ONLY THEN IF YOU FEEL THE DEBT IS VALID - otherwise, let them sue you for the debt, as a real law firm will only bring a legal action on a truly valid debt".

This should be "The Eleventh Commandment".

Great advice. Thanks for sharing.

Dear Readers of these posts.

I am writing at the request of my client, who has recently received several calls from the number 718-732-0174.  The caller said that he was Justin Brooks, and that he could be reached at extension 389.  When I called on my client's behalf, I got the person who called himself Justin Brooks directly (thus, no extension number - this is a red flag, as that indicates the phone number is his direct number - also 718 prefix is a cell phone).  The man who called himself Justin Brooks had a very distinct accent, of the type where they do not name their children "Justin" - another red flag.  He said that he was calling from the Law Offices of Richard Ross and collecting on a debt owed to a payday loan company called Americash Advance. My client has never had an account with that company.

I told the alleged Mr. Brooks that I was an attorney calling on behalf of my client, that I was disputing the debt and that I was going to give him an address to send verification of the debt, if any.  He just hung up.

These calls are scams, and this is how they operate.  First, they get a pre-paid cell phone, which is not traceable.  Then, they cold call people who fit poor credit profiles and badger them into paying something, either by an electronic check, or payment on your debit or credit card.  The badering usually is by threats of criminal prosecution.  Then, once they have your account numbers, they will drain your account.

IF YOU ARE EVER CALLED BY THESE TYPES OF SCAMMERS, DO NOT FEAR THEM, AS YOU CANNOT BE PROSECUTED IN THE USE FOR OWING MONEY - REGARDLESS OF WHAT THEY TELL YOU.  THEN, you need to first tell them that you dispute the validity of the debt.  Under the Fair Debt Collection Act they must provide you with written verification of the debt within a short period of time.  IF they do not provide you with the verification of the debt, the debt is invalid and not subject to collection.  PAY NOTHING TO ANYBODY UNLESS THEY PROVIDE YOU WITH WRITTEN VERIFICATION OF THE DEBT, AND ONLY THEN IF YOU FEEL THE DEBT IS VALID - otherwise, let them sue you for the debt, as a real law firm will only bring a legal action on a truly valid debt.

The other thing that you can do, of course, is to just tell them to "p****off" and hang up on them, as there is nothing that they can do to you.

PLEASE SHARE THIS WITH YOUR FRIENDS.
