Prank Call
Have received calls non stop for the past 3 days.  I have recently been looking into car loans.  Most of the calls I receive are from foreign people that I can barely understand.  (727) 242-7919
FL, USA

This number called and said he was from CashNetUSA.com and I have been preapproved for a loan.  I advised him I didn't apply for a loan through Cash Net and he said I was lying and playing games with him.  He said he has my social and bank account number etc.  I said I again I didn't apply for the loan.  Basically he said for my to cancel this preapproved loan was going to cost me $20.  I said that is absolutely insane!  He then said he will deduct it out of my bank account and he was calling the FBI on me. I told him that I was going to call the FBI on him and file a claim with my local police for him harrassing me.  He said do what you have to do and then hung up.

Today is Thanksgiving and so far I have received two calls. I called them back and it's a magic phone jack line.  They can't buy 800 number lines anymore in the USA so now they are purchasing the magic phone jacks for their scams.  I answered the second time and said do not call my cell phone anymore and they hung up.  Wish I could say I know this will end it, but we all know how that goes right.  At least reporting we got them to not be able to buy anymore 800 corporate lines.

Start the day off with three calls from a "Private number" no one there? Then another call from 727 242 7409 this morning. They are offered "to give me a loan up to 10k for the car I was? Is that a new car or used?" I am not looking to buy a car? Insisting 4 or 5 times that I am and asking new or used? Then he said he can give me a loan for whatever amount I want with the money I have in hand right now? NOW the scam shows itself. I give him access to my bank (cash) and he will give a loan? Yeah right. Got him off the phone finally with a no thanks. 10 mins later 727 242 5678 calling, didn't answer but left a message. An hour later different number different guy (both Indian) I said I already talked to someone about it and no thanks, He kept pushing the loan and I stopped him with No No you listen to my words, I do not want any loan. goodbye. 2 hours more (just now) Different number 361 237 4338 (but knew who it was), Hello... hear phone dialing... Hello is this (me) I call from bla bla bla, I went nuts on him, Listen 4 f'in times I have told you f'in guys, I don't want a f'in loan stop f'in calling, click.  Hope not to be continued.

Called FIVE times on Friday and would just keep saying hello. Called twice within 1 minute this morning same thing. I called back and they where like we haven't had any calls today. I told him BS! He wanted me to verify my SSN I refused several times and demanded to know who they were. Finally he said that he was a paprleagal with something line legal and was calling about a lawsuit against me. I told him I knew this was not true and that it was a scam and to stop calling. He persisted I told him to remove my number he said he was going to proceed with legal action against me. I said bring it and hung up. This is so annoying and has to be stopped . Plus this is my cell phone stop wasting my minutes!!

Debt Collector
This is totally a scam.  Even if you owe someone money, any professional business would answer your questions and have respect that you want to verify a debt.  I asked them for a transaction number showing a loan deposit to my account and they dodged the question no matter how many times that I asked it.  They have a script that they go by and they are not in this country.  Since I get these calls every so often, I have come to the conclusion that they can only run a credit card through and do not have the clearance to debit your account through a check clearing house.  Therefore, they are not a ligitimate business.  They just want you to be scared because they have your checking info. If you owe someone money, hang up with these criminals and call who you owe directly.  At least check it out before you give your credit card information.  But these freaks are not ligitimate at all!  They will change their number and call back with a different name in a few months so just be prepared.

EVERYONE KINDLY READ THIS ARTICLE FROM FBI NATIONAL PRESS OFFICE
Extortion Scam Related to Delinquent Payday Loans
Washington, D.C. December 07, 2010

FBI National Press Office (202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Some fraudsters have instructed victims to fax a statement agreeing to pay a certain amount, on a specific date, via a per-paid Visa card. The statement further declares the victim will never dispute the debt.

If you receive these calls, do not follow the caller?s instructions. Rather, you should:

   Notify your banking institutions.
Contact the three major credit bureaus and request an alert be put on your file.
Contact your local law enforcement agencies if you feel you are in immediate danger.
   File a complaint at www.IC3.gov.

Tips to avoid becoming a victim of this scam:

Never give your Social Security number?or personal information of any kind?over the telephone or online unless you initiate the contact.
Be suspicious of any e-mail with urgent requests for personal financial information. The e-mail may include upsetting or exciting but false statements to get you to react immediately.
Avoid filling out forms in e-mail messages that request personal information.
Ensure that your browser is up-to-date and security patches have been applied.
Check your bank, credit, and debit card statements regularly to make sure that there are no unauthorized transactions. If anything looks suspicious, contact your bank and all card issuers.
When you contact companies, use numbers provided on the back of cards or statements

Debt Collector
How often can a debt collector call me?

That depends.  Under the FDCPA, a debt collector may not call any person repeatedly or continuously with the intent to annoy, abuse, or harass them.  In practice, though, it can be difficult to determine whether and when a debt collector has crossed this line.  According to the Federal Trade Commission, a debt collector may almost certainly call you more than once, but six calls per day is probably too many.  Between these extremes, it depends on the facts of your particular case.

Know Your Rights!

Debt collectors violate the FDCPA when they make harassing, threatening, or misleading statements in order to trick you into making payments.  Don't be fooled!  Learn to recognize when debt collectors cross the line, and stand up for your rights!
Harassing and/or Abusive Statements violate the FDCPA:

Threatening to have you arrested or jailed
Threatening to take your SSI or other protected income
Threatening to take your household furniture
Threatening to cause physical injury to you or your property
Threatening to send false information about you to the credit reporting agencies
   Using obscene or profane language

False and/or Misleading Statements violate the FDCPA:

Misrepresenting the character, amount, or legal status of the debt
Making empty threats to scare you
Pretending to work for a credit reporting agency
Pretending to work for a government agency
Falsely claiming to be an attorney or to work with attorneys
Sending you fake legal papers to confuse you, or telling you to ignore real legal papers.

Abusive and/or Unfair Practices violate the FDCPA:

Calling you or any other person repeatedly with intent to annoy, harass, or abuse you, or any person at that number
Calling you after you have sent a cease letter.
Calling or contacting you without disclosing that they are debt collectors trying to collect a debt
Collecting interest, fees, collection expenses, or other charges that are not authorized by your original payment agreement
Soliciting postdated checks with the intent to threaten to expose you to criminal charges, or soliciting postdated checks and then threatening to deposit them early.
Contacting you by postcard, or contacting you in any way that would disclose to a third party that they are debt collectors.

I have been receiving calls (looking for one of my employees) from various company names and law firms etc... all, if asked are associated with Advanced American Cash Advance.  The men who call always have thick accents but very american names like Mark Wilson, Tom Jackson, David Miller, John Cooper, Tom Brown, Shawn Martin, Mike Peterson, Jason Miller, Steve Williams and now Ricky Nunez.  I do NOT believe that these people are actually in the United States, I believe they are using ghost phone numbers.  They are most definetly breaking credit/collection laws but they know that they can get away with it.  I finally installed a tape recorder on my phone and I tell them I am recording the call.  One of my most recent calls told me to "F*** You" repeatedly when I told him he could not speak to my employee and that I was recording the call.  DO NOT, DO NOT, send them any money.... it is a scam!!!!  Just hang up on them.  They will eventually move on to a new victim.

Oh yeah, one time I got them to give me a mailing address... I sent them registered letters from our company as well as from our employee telling them to cease and desist.  They didn't sign for the letters, so I did a Google map search on the address.  Turns out the address they gave me was for the Supreme Court of the State of New York!  Now that was amusing.

Many months ago I paid one of these scams. They were calling my place of employment, my home and my cel. I finally pulled my credit report and looked back thinking maybe I owed something from years back or identity theft. I even spoke with a lawyer. I was told they are all scams! If you truly owe anything (and it happens) it will be on your credit report & they do not call your friends and/or family leaving these threatening messages. The advise i got was to simply tell them "send proof in writing" and if they threaten to serve you with legal documents tell them "perfect, we will settle this in court." I actually have been taken to court by a credit card company and they do not harrass you this way. Once in court settlements are made and off you go.

They just called me and said that I owe a cash advance 300 dollars.  That supposedly I took out two years ago.  However when I asked him how he got my phone number he said that he got it off the original application from two years ago.  Funny thing is I didn't have this number two years ago.  So he is a scammer.
