This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

Hundreds of thousands of cash-strapped Americans have been targeted by abusive debt collectors operating out of overseas call centers suspected of links to organized crime in India, law enforcement officials told ABC News.

The calls are part of a massive scam, one that appears to target struggling Americans -- especially those who have gone online to apply for payday loans. Armed with personal information from those pilfered applications, the threatening callers, who claim to be debt collectors poised to initiate legal action, have managed to pry loose millions of dollars from their victims -- even when the victims never owed money in the first place.

"This is what we call a phantom debt collection scam," said Jon Leibowitz, the chairman of the Federal Trade Commission. "It's a very pernicious and innovative new fraud."

Working through call centers in India, the commission estimates that the criminals have dialed at least 2.5 million calls, persuading already cash-strapped victims to send them more than $5 million. Some have reported receiving dozens of calls per hour. They are victims like Cindy Gervais, of New Orleans, who went online for a quick loan when her husband's car was hit by a driver who didn't have insurance.

Even though she paid the loan off, the so-called "phantom" debt collectors with Indian accents began calling to say she still owed money.

"He more or less told me that if I didn't pay, they were going to have someone on my doorstep to arrest me," she told ABC News. "And that they were going to contact my place of business, and tell them what kind of person I am."

At first, she said she resisted. Then the calls became more frequent, and started to ring on her cell phone, and at the grocery distribution company where she had worked for 27 years.

"I was more or less in panic mode because he told me there would be someone before noon at my place of business to arrest me and take me to jail," she said tearfully. "So I agreed to pay him."

After receiving scores of complaints, investigators with the FTC said they began tracking the calls, and following the payments. They alleged the payments led them to a California company run by an Indian-American named Kirit Patel, and that such scams would not be possible without American front men.

"I would say that all roads of this scam, or many of the roads of this scam, lead back to Mr. Patel," said the FTC's Leibowitz.

ABC News tracked Patel for weeks, from the suburbs of San Francisco to Austin, Texas.

Patel refused to talk. But his lawyer, Mark Ellis, said he believes it is far too early to pass judgment on his client. Ellis, a Sacramento-based attorney, told ABC News that Patel was hired for a nominal fee to set up an American shell company, and had no idea what the call centers in India were doing.

"I can tell you, he was as snookered by the people in India as anybody," Ellis said. "He's a 69-year-old man who is nearing his retirement who thought all he had to do was set up some corporations and everything was on the up and up. He's completely dismayed that he has become the lightning rod of this entire problem."

A close friend of Patel's also defended him in a brief interview at his home, saying Patel was not trying to defraud anyone -- he was just an unwitting, bit player in a larger scheme.

This company called my personal cell and work numbers, stating it was a legal emergency and I was about to be arrested, lol.  I asked the name of the creditor, etc and they could not provide me any info.  The person calling had such a thick accent I could barely understand him.   I told him I knew it was a scam, and to remove ALL of my numbers from their database.  They then advised me I would be arrested tomorrow morning if I didn't pay (hysterical!!).  He hung up on me, and I then decided to turn the tables.  I started calling them every ten minutes and telling them they owed my money and if they didn't pay they were going to be arrested.  The fourth heavily accented person I spoke with told me to go F*** myself and hung up.  Hopefully I wont hear from them any more.  Wouldn't it be funny if all of US started calling THEM and keeping their phone lines tied up for days????

This wacko just called me and I told him to stop playing on my phone and hung up on him! He doesn't even speak english! No one has time for this crap and if he calls me again, I'm going to tell him I've traced his call and now have his address in Dubai. Now I'm going to post his number on my FaceBook so all of my friends and family can play on his phone. :)

Just received a call from  the same number.  They have been calling me for days.  Even called my work.  So I called them back and was told that I am being sued and that tomorrow I would be arrested.  Wouldn't give me any information on who they were or the "Law Firm" issuing the warrant.  The caller got very irate when I told them that I would have my attorney get in contact with them.  She said "so you just want me to issue the warrant?"  I responded, "Go ahead.  They won't have to look to far.  I'm a deputy sheriff and work in the county jail."  She hung up on me.   And about 20 minutes later I get the same phone number calling me on my cell phone.

They called my work and left a message and threatened me in the voice mail.  I called back and asked what kind of business they are, what country he was even located in and to stop threatening me, he then said my name and with in 48 hours he was going to push me in front of a bus., Umm...?  Then I told him he didn't even speak english so how was he going to find me and then he hung up on me!

Don't know how he obtained my # but calls me on cell and at work threatning me about a lawsuit against my ssn. I called him back and asked for information and kept trying to transfer me & I told him no. He has the most horrible accent there is. Next time he calls he will get cussed out!

I got a call from some alleged law firm, but there was so much background noise I couldn't understand him.  I also was told I had a lawsuit against my social security number (but never against me...why is that? LOL), and I would be arrested.  I told him to memorize his script better than hung up on him.  I have an app on my phone that blocks unwanted calls and also lets me file a complaint if I wish.  I file one on every one of these calls.

These idiots have been calling me for months now. Everytime they leave me a message I call them back, tell them to stop calling me, they say Im going to be arrested. haha. Ok I tell them, But i have finally figuered out how to have them stop calling me. I called the guy back. Told him to take me off his phone list. He said I was going to be arrested, bla bla. I said first your a scam, and the FTC knows about you, and if you call me again im going to start calling you every hour on the hour. He goes just get off my phone. then hangs up on me. So I called him back, He says please stop calling me. Nope not how that works. I called again. got busy signal. I have reported to the FTC. Be firm with them, never give them any money. They are dumb enough to use the same phone number. They just will stop for about 2 weeks then start back up. So I will do the same thing again.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
