Just got a call saying something about a warrant for me on her desk.  I have no idea what this is about, but the scary thing is they call my family members.   One of my family member is a police officer and was mad that they were calling her.  I have never gave out her number(s) to anybody.  They have ways to find you.  Pretty scary.  I just delete the messages.  I do not owe any money, because my normal bills and i pay all of them on time.

If the supposed bad check is from a payday loan, according to Mississippi law,  it cannot be handled the same way as if you wrote it to a grocery store.  The law states no criminal prosecution allowed.  Also if the loan company does business with you in Mississippi, they are required by law to be registered with the Secretary of States office and have a business license or they are considered to be illegal.  What do you have to say to that Brandy?  I think you are on the losing end.  People aren't as easily intimidated as they used to be in times past.  I also think that it is illegal to leave a message about having a warrant out for someone.  When a true law abiding debt collector calls and leaves a message, they will state the persons name they are trying to reach and ask that they return the call at a certain #.  That is all that is allowed to be said unless they are actually speaking to the person they are trying to reach.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Received a missed call from 770-322-1741 (Fraud investigation) I returned the call officer Meg answered (snotty attitude) and I told her she called the wrong house, I don't use my house phone. She puts me on hold and asks for my ex, mind you my phone is in my name and I don't have as much as a hang nail. Didn't seem legit, he doesn't break laws but she asked that he give them a call. He will never get the message because I am not his personal secretary! Str8 Bull!

there is a difference  between the verification  notice which they must provide within 5 days of initial  contact and the validation letter that the consumer needs to ask for preferably by registered  mail.  this halts all collection activities until  the dca is able to legitimately validate  the debt.

Legitimate debt collectors can call, yes - however, the FDCPA makes clear that they "shall" provide a WRITTEN debt validation notice within five days of their first call to the alleged debtor.  No ifs, ands, or buts about it.

My sister got a call from this number asking for me, which is odd because I've had my phone number for 15 years and never changed it. Same as everyone, the caller stated that there is an outstanding warrant in my name due to check fraud.

1. I have perfect credit and I pay back all my debts.
2. I've never been to Georgia, so, I do not understand how I could have an outstanding warrant in a State I've never set foot on.
3. I work for the government. A department where you need complete FBI background check and extensive credit check. With that said, if I indeed have an outstanding warrant, they would be the first to know.

There are a few things I was able to find out regarding this "so-called" company. I took the liberty into doing a background check on them. They're business front is called Orthop Alliance and they are located in Lithonia, GA. Per the Better Business Bureau (BBB), there is no company in their database called Orthop Alliance. They're business is set-up in a residential home per BellSouth Telecom.

Please do not give any of your information to this company. Their business is fraudulent. They scam for credit card information and checking and savings account info. Please be diligent and protect your information from people like these.

Heads up to these people (which called me), the state of michigan law is: (this is taken right out of the state of michigan web site: http://www.michigan.gov/ag/0,1607,7-164-17334_17362-171016--,00.html)

8.         State law prohibits us from using any criminal process to collect on this agreement.

which shows that your law stating is actually you lying. Anyone in the state of Michigan is protected by this law. No crimal charges can come out of a payday loan (including the check that was written). Also if the payday loan is done via the internet, no actual "check" was written, so under Michigan law, your claims do not stand. Also in the state of Michigan by liying to me and stating that there is a warrant for my arrest for this, claiming that to me on the phone, my debt to you is now $0. Threatening criminal is a big no no in Michigan.

So I hope that this info helps people out there that these people are trying to scam you.

Most of your more credible and reputable collections companies will attempt collections of valid debts by first mailing invoices and collection notices although nothing says that they can't call you.  And if these attempts fail,  they will ususally follow up with Telephone calls.   However the calls are non-threatening and polite.   If that fails,   they will not threaten you but if the debt is large enough,  you can look for your name in the newspaper under civil suits.

Actually,  there is no law that forbids debt collectors from attempting to collect a LEGITIMATE debt via the telephone,  without providing written validation.   However,  when the person being called requests written validation,   then they must provide it within 5 days and via  good ole Granny usps mail.

The best thing is the illiterate shill "thinks" they won an argument by their "cut and paste" job.  To bad the shill can read the footnotes to case law to realize that post dated checks for PDL are not covered by bad check or "hot check" statutes.  Problem is these shills don't even have enough of an IQ to feel stupid

Because you are.. a professional deadbeat extortionist stealing from people whom you bully and intimidate. Your kind thinks the world owes you a existence and are too lazy to work at a real job. Prison bars will look good on your kind along with those striped suits, though I think they should send you to Arizona for the pink ones with matching underoo's.

Ok now that you got us told <not amused> Please provide how paying a loan with a check that has nothing but you name account and routing info and no dollar amount is check fraud if you are not able to pay it back? Who even writes checks these days when a person can give out that info by phone or on line. I still have not seen you post that it is against the law to take a loan out if you can not pay it back and the only thing I found is that is a civil matter and that  it is hard to prove fraud on a revolving debt like loans.
