Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

To report Extortion Scam Operations, file reports with the FBI, your state attorney general and Department Of Justice,CFB,FTC & FCC..

Same thing they continue to call and say I will be arrested tomorrow.  Sounds very very bogus.  I wouldn't worry about it, I believe its a scam.  Very foreign dialect and very rude I highly doubt this is how a business would respond to a debt.  I have had these types of calls from other numbers before and it turned out to be a huge lie.  i believe this people prey upon the less informed.  I have contacted the better business bureau and suggest you do the same.

I received a call from this number saying that they worked for Brumley law firm and I said you do not because I checked your number out on line and no one by your name works at Brumley Law Firm.  This guy had an Indian accent.  He told me i would then be arrested within 24 hours.

I also received a call at work.  And when I pushed back about my legal right for proof of debt they told me good luck and that I would have proof of debt when the local sheriffs office arrested in 3 hours at my place of business.  So I called back and everytime they hung up on me after I pushed for information.  I asked for the guys name and he stated he had given it to me before, then hung up.  Called back and asked for whoever I was speaking to supervsior then got a Ethan Smith who stated that I was going to be arrested.  I said please have Mr. Bruce Brumley call me direct he then got smug and hung up.  Now when I call back they won't answer my calls or automatically hang up.  Guess they don't like when I call them repeatedly!!!

Mr. Brumley, thank you for your post.  I would also suggest you contact the FBI.  This "company" I believe is a call center in the Phillipines.  They called me at my work phone.  I work for the federal government.  SO, essentially they are trying to employ a scam to get money from innocent civilains utilizing federal property.  This is breaking the law.

But than you for taking the time to reassure some people on this post that it is in fact a scam.

When I stated that by law the company was required to provide to me in writing a copy of the debt that was owed and they could not threaten me with coming to my place of employment or suspending my license the smartass asked if I was going to hang up the phone.  I answered yes, if he was not going to provide me with the proper documentation to prove the debt.  This pervert then started to act like we were having phone sex and said "I want to have relations with you....."  I ended the call and told me don't ever call my place of employment or my personal cell phone ever again.

Unfortunately, that's what happens when scammers "spoof" numbers - innocent businesses and people get to field the angry calls from those who've been called and harassed.  If you have a website, you may wish to also add a notice that states that scammers have "spoofed" your phone number for their own nefarious reasons.

I am the Bruce Brumley of Brumley Law Office.

These callers are a scam.    I do not know why they are using my firm's name.    They falsely represent that they are from my law firm.   My firm is not even a collections firm and is a personal injury firm.    To be clear, they are not associated in anyway with my firm.

In past 3 days, several people from all over the country have called my firm saying someone has called them threatening various bogus things on some debt.    The callers attempt to get some people to wire them money to stop arrests or whatever.   I explained to many people that this is scam and I am not associated with it.

I contacted the Topeka Police department as my firm is located in Topeka.   I am also planning on contacting the Kansas Attorney General.   I am told that my law firm is not the only name they are falsely using to try to con people.    Again, my firm is not associated with these people and anyone getting calls from these scammers should take appropriate steps to protect themselves such as not wiring any money, giving any information, contacting your local police department, your bank if they have you bank info, and whatever else is reasonable to protect yourselves.
