Debt Collector
I just got a call from a PI Nathan Lucas pretty much stating all of the same stuff, coming to my house, will go to my place of business, need two forms of ID and a witness. He said if I had questions to call 866-404-9994. He did call from a number in my are code so I called the number back it rang once then hung up. I decided to call the 866 number and ask for Nathan Lucas aka Scott answered and said there was no Nathan there. I started asking him what company they were, where are they located, what type of business do they handle, and He played it off. He said I can't tell you I'm just the secretary he would need to transfer me. He finally said they are EMPIRE ACCOUNT SOLUTIONS. They handle "legal documents." I said what type and he wouldn't answer. I finally said I would not work with a company that no one knows anything about. I said thank you and was about to hang up when he hollered out my real name. I hadn't given my name. I just called him a dumb*** and hung up. Thanks for all your helpful advice now I know how to handle these people. I am proud to say I do not have any warrants for my arrest.

This same company Empire solutions  just called me and said they would come toy home and assess any and all income into the house weather it's my family or not. I live with my Mom and Dad. Said then they would take all incoming and outgoing bills. And assess how much I was GOING TO PAY. ALSO SPOKE OF HAVING ME SERVED LEAGAL PAPERS. It is a bill that I owe. But I don't want to be bullied. Nobody deserves that and it's illegal. How should I address them.

a Mark Brown called my cell and work left msg saying they are sending armed guards to my house to serve me with a summons....called back and spoke to woman...I had to ask her a thousand questions and still wasn't sure what they did...said I owed a company money from 2012 and the reason they mentioned the armed guards is because they have served summons on other people and got shot at..anyway...I told her what they are doing is illegal and that I am reporting them...had the nerve to ask me for a credit or debit card to pay off a debt that I don't owe...

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

One tactic is to ask them if they are licensed to collect debts in your state.    If they say "yes" ask for their name and registration or license number, then check the state atty general's web site in your state and try to look it up and see if it's valid.   My experience is most states have a web sites to check the validity of state-issued licenses.   If they they say "no" or don't answer the question, just say "Bye."

Debt Collector
Nice job, Lois. Really, well done. I'm a federal prosecutor and will add that (1) they cannot serve you at your place of employment unless it is a fully public venue. They absolutely cannot serve on state or federal property under any circumstances. (2) do not EVER give them any credit card, checking account or other financial info over the phone. If you have a legitimate debt THAT IS CURRENT, then they are obligated by state and federal statute to send you a copy of the proof of debt and all related documentation as well as a demand to pay letter-in writing. And (3) if the debt is older than 5 years (3 in some states), it is beyond the applicable statute of limitations and no one can arrest you or even sue you for it. That's precisely why they bought the debt: it was charged off (written off) by the debt holder. Companies like this operate on fear and ignorance and have to use strong arm tactics like criminally harassing phone calls to fool people into paying them a dime. Just. Don't. Do. It. And if they persist, call local law enforcement and report the threats. They come times get idiot "collectors" who go way across the line and physically threaten you and/or your families. That's absolutely criminal and will land their collective a***s in the pokey every time.

Exercise some common sense folks. They're on the phone, calling about a debt that most likely never existed and even if it did, is well beyond the statute of limitations, meaning they can only make threats; there is literally nothing else they can do. They can't even report you to any of the three credit reporting bureaus since the debt is expired. There are literally no consequences. So if you pay and think that's somehow going to help you down the road, you're sadly mistaken since there's no "down the road" period. Sorry to burst your bubbles if you've paid already, but not only did you hand over your cash unnecessarily, you likely just sold your personal info, including banking info, to a bunch more collection agencies. In other words, you've made yourself an easy future mark. Just don't be a chump twice.

That's $300 worth of free legal advice for all.

If they are calling you at work, tell them that their calls are being recorded and tracked and they are harrassing you at place of business and that you will have your employer file a police report and press harrassment charges against them AND that they will go to jail. They are trying stress you out and make you worry that you might get arrested or served papers so that you will cave in and pay them money. They are not legitimate.
