I have received four calls from Ms. Cullpepper herself.  They are messages on my home answering machine.  The first two were for my brother in law.  I called her, said I didn't know him, what's it to her.  The third, is was for my brother in laws brother, yeah that makes sense.  Called her and said stop calling.  Today, she called asking for my sis in law, different side of the family.  None of these people have the same last name as us, or live in the same city.  I love how she claims it was a cell number left with them, my number.  How in the hell do they get my number??  She claims its from her database that shows relatives. WOW.  She asked me if I knew the said name, and I said yes.  But, it doesn't make it ok for her to be calling my number again.  She never asked for the said's name.  Just said, I'll make a note to remove your number.  Oh yeah, thanks a bunch.

Michael Brown has called my home before in the past. He was trying to be threatening and intimidating to my mom, when I got on the phone he hung up like a coward. I called him back and gave him a piece of my mind. I told him, "you sure act like a tough guy on the phone", and he replied that he would come to my home, and that I would "regret it". I didn't care. I gave him my address and welcomed him to try. I have twelve guns in my house, and I was trained to use everyone of them. When I asked him for his address he hung up again.

I looked him up, and his number and his company's address appeared. I called him back again and told him, "maybe in your world you can solve all your problems by just hanging up on someone, but when you piss me off, a phone is not going to silence me!" He replied with, "I want you attorney's name, and I want it now!" I told him, "My attorney's name is Steve Bullock, Attorney General of Montana. You've got a problem? Call him!" He hung up again! What a shocker! F*cking coward.

I called him back for the third time. He told that he was "busy" and I was "harassing" him. I told him the same thing. I told him that I was living my life and that he won't stopping harassing me!! He tried making more threats like, he was going to take away my children. What he doesn't know is that, I don't have children. When I told him that I knew where he worked, he replied, "no you don't!" I told him the address to his company, and the name of the company's president.

He hung up and never called again. He never did try to come to my house and make me "regret it". Michael Brown is a spine-less coward, who hides behind a telephone. He makes empty and ridiculous threats. Mr. Brown was probably a victim of bullying in school and is trying to get back at someone by making others suffer and worry.

I haven't filed a "claim" for anything since 2009 and it was for a cell phone issue.

They'll try to persuade you to pay off old debts using your new credit card, via Western Union wire transfers, bank drafting, debit checks and cash.  They will tell you your credit report will be clean if you just send them the $ MONEY$.
The National Consumer Law Center (NCLC) and the National Association of Consumer Advocates, (NACA) assist attorneys across the country in pursuing agencies and collectors who violate the law and your rights.
Collectors are learning that the phone name they use and the perceived anonymity of hiding behind a telephone can easily be overcome with today's modern technology and investigative techniques.

Some collectors are learning first-hand that they too, can be charged with making threats over the phone and that their employers don't provide bail money or legal representation.

Creditors are increasingly becoming less tolerant of agencies that allow abuse and will drop those that don't comply.

Received a voicemail from Gloria Culpepper that stated she received a claim pertaining to me on her desk and that I needed to call in reference to a claim number about an "urgent situation", but that it was "good news".  Yeah, ok lady, whatever.  I haven't filed any claims and have no reason for anyone to be calling me to collect a debt or pay me out for a credit.  Being as it was an 800 number and she never stated the company she was with I had even more suspicions and searching the internet led to this site and a few others that have been linked.
 So, it looks like the company realized the nasty approach wasn't working and that they might try to get people with honey.  I don't trust them and you shouldn't either, it's the same scum with a new tactic.  I'm not technically classifying my call as debt collection, but from what I've read I bet it is just a tactic to verify numbers they have are current for people so they can get more hooks into you.  If you don't recognize a number, let it ring, if it is important they'll leave a message.  If the message makes no sense, delete it and never call them.

This phone number is using the name Gloria Culpepper now.  I haven't heard from Mr. Brown in a while, but when she calls, she speaks like she is in a panic about missing  your calls.  I paid my bill so I just ignore it.

I received a call today from(800) 214-7887, but these people used (800) 214-5362 on 5/30, 6/2 and 6/12. They are sneaky.This is a collection agency called Commercial Recovery Systems of Dallas, TX. They are the absolute worst of a bad lot of scum sucking bottom feeders that give cat fish a bad name. The Fair Debt Collection Practices Act (FDCPA) is a joke to these vermin. Download the full 26 pages of the act from the fEDS.

A Mr. Evans called today and said that "he had received my case from a client, a bank, and that the IRS would be involved". No company mentioned. No "purpose to collect a debt" per FDCPA rules. Just a threat.

The stink of this call sent me back to my collection call log. On May 30, 2009 a Marcus Lee called from (214) 324-9575 and said that he was "processing a complaint against me in his department". He called back on 6/2; same threat. On 6/12 he upped the ante by saying that he was with the "Law Enforcement Division of CRS", and that he had a "complaint against me for falsifying information", but he was giving me the "benefit of the doubt". He concluded with "you have been notified".

The fact is, what this crook is doing is illegal -- regardless of whether you owe money or not. Report each of these calls to the following:

1) Since he's using a telephone to threaten you, pass on the information to the FBI at https://tips.fbi.gov

2) Your state's attorney, the contact information for whom is at www.naag.org

3) Your local police. Most police depts will take a report over the phone. Let them know that you're being harassed with threatening phone calls

4) The Federal Trade Commission at https://rn.ftc.gov/pls/dod/wsolcq$.startup?Z_ORG_CODE=PU01

straight off the bat. i do owe money. mr brown is trying to collect for his client mitsubishi. my car was repossessed sold at auction and the balance is an amount my $9 dollar an hour person cannot afford. i've tried to establish a payment plan, but all they want is the full amount... oh wait they reduced it for me, down to only $9,000 (from 12,000+).  again, how can i pay this?

now here comes mr brown (or as i lovingly call him, "dad"), he's been leaving me threatening messages on my cellphone, i hadn't been able to speak with him because i get out of work when he's left his work. today we finally crossed paths, he called me and was surprised i had "the testicular fortitude to pick up the phone", he constantly asked why haven't i paid his client, and i swear every-time i went to answer he kept interrupting me! so then i got heated, he was lecturing me about what i was doing and how i was acting (according to his reasoning), raising his voice speaking with haste as if i slept with his wife.  i asked him to speak to me like a human/man, he said i don't deserve to be spoken to like a man... so i started calling him dad, after every sentence i ended it with dad. the man is a tyrant, i know i owe and i have tried to come to a solution but the options are beyond what i can give and i have to eat... he says i have to find the money, told me to quite wining and grow up! who does he think he is? then he insulted me again by calling himself a christian! he quoted roman!  this is not a christian! he asked why do i choose to insult his client i said im not insulting mitsubishi im insulting you! i said dad im okay with mitsubishi, i have no problem with them but dad, you're very insulting and rude, dad... if you ever have to get on the phone with this human, please call him DAD.

Debt Firms Slammed by Consumer Lawsuits

Debt-collection lawyers are increasingly being hauled into court as defendants in Fair Debt Collection Practices Act lawsuits by debt-burdened consumers who use litigation to fend off creditors.

Lawyers say the statute's vague and broad language opens the door to cases against law firms, and a recent federal court decision that denied litigation immunity to a debt-collection law firm creates even more risk for debt-collection lawyers.

Other factors behind the trend include mistakes in court filings made by debt buyers -- or their lawyers -- who purchase debt from creditors but frequently lack enough information to avoid making false statements in pleadings.

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, which toughened the standards for consumer bankruptcies, is also contributing to the upswing in fair debt litigation because debt holders are seeking other ways to forestall debt collectors.

At least 19 lawsuits against debt-collection lawyers have been filed in states across the nation since March, including Florida, Illinois, Massachusetts, Michigan and New York.

'A CASE A DAY'

During the past few weeks, Barron, Newburger, Sinsley & Wier has been "pulling in a case a day" to defend a debt-collection law firm, said Manuel H. Newburger, an attorney in the firm's Austin, Texas, office.

"There seems to be no end in sight [to the cases]," said Newburger. "There's an effort by the consumer bar to dictate the manner in which the creditors' bar will represent their clients."

Newburger, who runs a consulting business for the collections industry with one of his firm's Tampa, Fla., lawyers, has also noted an increase in suits since the bankruptcy reform law took effect.

Daniel Edelman, a Chicago plaintiffs lawyer at Edelman, Combs, Latturner & Goodwin who has many fair debt lawsuits against debt collectors and debt-collection law firms, said that the system is "fraught with abuse.

"It's not difficult for someone who wants to comply to stay in the straight and narrow," Edelman said.

Fair debt cases are up because debt collectors are filing cases with inaccurate information or when the debt's statute of limitations has expired, Edelman said.

Debt-collection lawyer Ira Leibsker, who is also president of the 700-member Washington-based National Association of Retail Collection Attorneys, blamed the vague language of the Fair Debt Collection Practices Act and the court's reliance on the standard of whether an unsophisticated debtor would be confused by the debt-collection firm's actions.

"Sometimes courts have to decide if firms are complying or not," Leibsker said.

Leibsker, who is also a an attorney at Chicago-based debt-collection law firm Blatt, Hasenmiller, Leibsker & Moore, said that debtors are also increasingly likely to resist debt collection and be sued by debt collectors.

"Debtors are somewhat creating this marketplace," Leibsker said. "[Debt collectors] have to figure out some way of collecting that debt."

PROVISIONS ARE CLEAR

Plaintiffs lawyer Kenneth Quat of Concord, Mass.-based Quat Law Offices, said provisions in the law concerning litigation, and how debt collectors are to communicate with the debt holder, are clear.

"It's not even a close question," Quat said. "It's an instance of a particular industry not liking the law that's on the books. They still have to follow it."

One of two cases Quat filed in federal court in Massachusetts last month is a potential class action against Boston-based Daniels Law Offices for allegedly violating the fair debt law by tacking on a percentage based on attorney fees before the money was collected and adding the fee to the principal, instead of calculating "reasonable fees" based on the lawyer's time. Socheata Som v. Daniels Law Offices P.C., No. 07-40143 (D. Mass.).

Daniels Law Offices did not respond to a request for an interview.

Another pending case, a potential class action against J.A. Cambece Law Office in Peabody, Mass., revolves around allegedly deceptive and unfair statements in one of the firm's standard dunning letters. Stephen D. Smith v. J.A. Cambece Law Office, No. 07-40144 (D. Mass.).

The Cambece firm's attorney, Kathryn Pieczarka, an associate at Boston-based Lawson & Weitzen, said she couldn't talk about the case before the firm files a response to the complaint, but she said many cases stem from consumers' efforts to avoid debt repayment.

"Plaintiffs' attorneys ... are more often trying to find violations of the Fair Debt Collection Practices Act to get their clients out from under lawful debt-collection activities," Pieczarka said.

THE FTC GETS INVOLVED

The Federal Trade Commission has also picked up on the controversy surrounding the law.

In October, the agency is running its first-ever workshop on the law, which has not had a major overhaul in its 30-year history, to explore whether it is out of step with industry developments.

One issue on the table is whether debt buyers are getting enough information from the original creditors to contact the right people, said Tom Pahl, assistant director in the division of financial practices.

"It's a forward-looking endeavor to figure out what's happening in the marketplace and how we can respond more effectively to those changes," Pahl said.

Following the workshop, the agency is likely to issue a report with recommendations to policymakers, Pahl said.

A May 9 decision in the 4th U.S. Circuit Court of Appeals denying immunity to Rockville, Md.-based debt-collection law firm Wolpoff & Abramson for claims based on statements made as part of its judicial proceedings has sent shudders throughout the defense bar. The circuit court reversed and remanded a lower court's ruling to dismiss a fair debt case against a debt-collection law firm.

The court rejected the law firm's claim that it was entitled to common law litigation immunity for claims based on its statements during court proceedings. Sayyed v. Wolpoff & Abramson, No. 06-1458 (4th Cir.).

Wolpoff & Abramson first sued Farid Sayyed in state court to collect an unpaid credit card debt. Sayyed then sued the law firm in federal court for violating the fair debt act in its interrogatories and its summary judgment motion.

The debt-collection bar was relying on a couple of district court decisions from the 6th Circuit to claim a broad litigation immunity from the fair debt law for their legal filings, said Arlington, Va., lawyer Ernest Francis, who represented the plaintiff and appellant Farid M. Sayyed.

But Sayyed is consistent with a 6th Circuit decision last year in Todd v. Weltman, Weinberg & Reis Co., 434 F.3d 432 (6th Cir. 2006), Francis said. The Todd ruling said that lawyers filing Fair Debt Collection Practices Act lawsuits don't have the absolute immunity usually granted to witnesses in judicial proceedings. In that case, the debt-collection lawyer had filed an affidavit in state court to garnish property.

"It removes an arrow from the quiver of those defending fair debt cases," Francis said.

MOVING BEYOND 'TODD?'

The Sayyed decision moves beyond Todd, said Bruce Menkes, a Chicago lawyer who chairs the debt collection practices subcommittee within the American Bar Association Section of Business Law.

In Todd, the court said the law firm that tried to garnish the debt holder's account didn't qualify for state court witness immunity because the firm acted as a complaining witness, Menkes said.

Sayyed, on the other hand, said even if the firm had been given general immunity in state court, it wouldn't be a defense in fair debt cases in federal court, Menkes said.

Sayyed is not just a setback for defense lawyers, it will also chill legal representation of creditors, Newburger said. "This is a potentially nuclear explosion for lawyers who do debt-collection work," he said.

Newburger added that most fair debt-collection cases have "technical merit," but an increasing number are filed in federal court after the debtor loses a state court case, solely for attorneys to collect fees.

Living with the Sayyed decision means that more debt-collection lawyers will rely on the bona fide error defense, which is built on unintentional mistakes that occur, despite the debt collector's procedures to avoid them, said Ronald Scott Canter, Wolpoff & Abramson's director of legal compliance.

But it depends upon what kind of mistake and where it happens, Canter said. There's a split in the circuits about whether lawyers can use it for mistakes of law, or when a lawyer makes a legal misjudgment, or just for clerical mistakes, Canter said.

"As a practical matter, lawyers rely on info provided by clients when they file a pleading," Canter said. "The court is saying we can be sued for repeating what our client said."

Yet what exactly constitutes a bona fide error, which is one of the most common fair debt collection defenses, is one of several legal issues still up in the air, Menkes said.

"There's very little agreement as to what qualifies for those measures," Menkes said.

"It's hard to give clients advice."

I have received several calls from a Michael Brown like the ones stated above.  They are very abrupt and threatening and he asks to speak to my attorney every time.  I don't answer the phone for numbers without an id, so he always leaves voice messages. He never says where he is from either. He is a pompous a** that obviously needs something to do.  I am reporting him to the FTC as well.  People like this need to be put out of business.

I have been receiving calls from a Michael Brown since last summer.  He doesn't state what company he works for and sounds threatning when leaving a message.  I don't know anyone named Michael Brown, so I refuse to return the call.  This went on at least once a week for about 3 months.  Then, right before Christmas, I get a call from an unidentified male who leaves a message stating that this is my final notice and he needs to speak to my attorney right now.  He left no name and no company name, just a threat.  Again, I have yet to speak with this person because he refuses to leave a message stating what I consider pertinent information.  ie. his name, his company and what his call is in reference to.  Today, I get a call and again I am left a message telling me this is my FINAL NOTICE (this would be one of many final notices he's calling about) and that I need to contact him at this number 1-800-214-7480 right now so he can serve me with notification of a ruling against my 2007 income.  Then he closes by saying, "Good luck to you, you're going to need it".  First off, I haven't worked in over 4 years...I'm a full time Mom.  Second, if he was truly legitimate, wouldn't he have that information already??? And third, Never Ever threaten me in any form or warn me of "impending doom" if I don't respond to what I only know as an invisible, no-name individual.  I'm reporting this entire incident to every single website linked in the comments that others have left.  I've also filed a police report with this number listed as the harrassing/threatning individual.  This is what I was told by local law enforcement (including the local FBI)...DO NOT RETURN THIS MAN'S CALLS...he will only verbally abuse you...he will not explain why he is calling and harrassing and threatning you...he will not tell you what company he represents...he cannot under any circumstances travel to your home and place you under arrest unless he is an officer of the law and has made arrangements with YOUR local law enforcement to enter their jurisdiction which requires a lot of paperwork and would probably only be deemed necessary if you were listed on the FBI's Top Ten Most Wanted...REPORT HIM to the FTC and DO NOT TRY TO ENGAGE HIM IN ANY TYPE OF CONVERSATION...they'll handle it.

**MR BROWN OR WHOMEVER THE HELL YOU ARE...I sincerely hope that you are reading this and feeling pretty good about yourself and your mafia style tactics in being nothing more than a simple, uneducated bill collector. People like you are a dime a dozen in this day and age.  You're a prime example of what happens when a grade school education goes wrong...your family must be proud that you graduated from kindergarten after only 5 attempts.  The manner in which you are attempting to contact people for whatever reason is UNLAWFUL.  It is not unlawful however to have personal information sent to a collection agency whether it be right or wrong information.  You have picked the wrong people to harass this time...your 15 minutes of "fame" are much more likely to be served in some type of cell than any of us will.  Your tactics are such a prime example of what's known as "phone warrior" or "little man's disease".  We all feel inadequate in some way but abusing other people won't make you a bigger man.

I have been trying to call Rev Care since before Christmas, and have had no luck. They state that they are closed.
I decided to call the business that sent me to Rev Care and they informed me that Rev Care closed their doors right before Christmas!
Is Rev Care a ligit company???

MR. BROWN CALLED MY HOME AND I ANSWERED.  HE RFUSED TOTELL ME WHAT THIS IS ABOUT BUT THAT HE WOULD TALK TO MY ATTORNEY. I TOLD HIM I DON'T HAVE AN ATTORNEY. HE SAID I BETTER GET ONE. I TOLD HIM I WOULD ONLY NEED AN ATTORNEY AFTER I GOT THREW  WHIPPING HIS A**. HE HUNG UP.

Mr. Brown called my home and left a voice mail stating I will be arrested and detained. I called him back and asked what on earth this is about. He refused to tell me. Stated he will tell me when I am in my cell. I told him he must be a nut.  He cursed me. Called me several racial slurs. I told him I was tape recording this call. He told me I better "erase" the recording and hope he did not have me "prosecuted to the fullest extent of the law for wiretapping"... I laughed and he cursed me more. I hung up.

After a little Googling, I found a website that indicates that "RevCare" is just an alias for Merchants Recovery Services, Inc.:

I would give you a hug if I could!!  You are the best for posting this. NOW please lets ALL contact this company, the FTC, FBI, etc.......... I was being hounded by a Don Wilson with RevCare months ago about a bill I did not owe. I sent him a cease and desist letter because I truly did not owe the amount he was demanding. He stopped. Now this man Brown has called me. I intend to  pursue this because I have some very interesting tape recorded copnversations and voice mails from him...
