To D.OLeary- You should report these jerks to the FTC, the AG in your state, and even the Cleveland BBB in Ohio. They also violated the FDCPA by telling you that the person they called about owed money. Have a tape recorder handy, and if they call again, record them. I don't know what state you live in, but if it is a 1 party state, you can record a phone conversation and not even tell the other person as long as you are part of the conversation. If it is a 2 party, all you have to do is tell them. You do not need their permission. They don't ask for yours, so you don't need theirs. Keep reporting them, and hopefully they will, in time, be shut down for their abusive and illegal tactics.

I received a call today from "Harvey Lebowicz" telling me that he left many messages(I never got any) and I need to call him back ASAP or he is forwarding my file to the city where I live!!  What does this mean?  I have no idea what he is even talking about!!!!  He said he was calling from NES.

This company has been calling my house all week trying to talk to my son.  Today a very rude man threatened to go to my sons work and hand him a summons for a lawsuit.  He was yelling at me and would not tell me what it was about.  I told him he could not talk to me that way. I hung up, he has been calling every few minutes all day.  My son has talked to him, but he is just rude.  The company name is not on anything that my son oues either.

So sorry for the debt collectors, but even if they DID get a judgment from you, SSI, and Disability are protected from garnishment. They can't freeze'em.

Chances are, they won't call back. Do you know how old this debt is? If it's run out of the statute of limitations, tell them to go pound sand. Better yet, send them a letter notifying them that the debt is out of SoL and to cease and desist contacting you. Period.

First of all, you made him mad because legally, he CAN'T tell you what the call's about. That would be a violation of the Fair Debt Collections Practices Act.  And we ALL know how much they hate to violate THAT, right?!  :)

What you can do is mail them a Cease and Desist letter. Do NOT put your BFs name ... do NOT mention him whatsoever. Just give YOUR phone number (since they already have that, anyway), and tell them that they are no longer to contact you. At ALL.

Another thing you can do is politely let them know that further calls from them to you will be taped. Let them know that you WILL be keeping a voice recorder next to your phone just for such occasions.

Also let them know that any further harassment will result in an official complaint being filed with the Better Biz Bureau AND your state's Attorney General's Office. And go ahead and toss the Federal Trade Commission in there, just for kicks! ;)

I got a call from who I will call "Mr. Rude"!!!!!  He yelled and screamed etc..  I want you to know when he was told the person he was calling for was not available, that I assumed they already left for the store, he said I was lieing because he hadn't seen anyone leave the house.  Not only did he say he was watching the house but he was going to send someone to my front door to verify if the person he was asking for was home.  "NO one came while I was there.  Real yelling and screaming JERK!  I am not only going to call the Better Business Bureau and my Attorney but I will be filing a complaint with my local police department and reporting them as a stalker since he said he was watching us.

I received a call yesterday at my place of employment so naturally I didn't pay much attention to how was calling. All I can remember is that he was from National Enterprise Systems. This very ignorant individual went on to tell me that the company that he was representing was going to garnish my wages if I didn't pay up the $900 something dollar immediately and would I be writing a check or paying by credit card. I told him that by neither. He continued to say that it was because of people like myself that the economy was in the situation it was in. Then he continued to tell me that they would probably have to call INS on me so they can revoke my Green Card and have me deported. Has he done his homework I am a United States Citizen of Puerto Rican decent which doesn't require a Green Card. I have never been so upset in my life. So obviously I lost it and cursed like a TRUCK DRIVER and hung up. He proceeded to call my job back again to get the last word in and say pay up you Alien. Even if I had the money to pay this debt I would never ever deal with a company who has employees calling individuals and treating them like this. I too will be submitting my complaint to the better business bureau.

Then today I get a call from a Michael Edwards on my answering machine at work not stating his company name saying that his co-workers have informed him that I have been ducking their calls and that I needed to call him immediately today before 5 PM at 1-800-236-2380 extension 1896. Obviously I will not be making that call.

Received call today from NES and Associates, representative Kathy DeFranco. (At work)  She says that I or my attorney need to contact her at 1-800-236-2380 ext 1159 by noon regarding a complaint that would be sent out through my County Municipal. She then gave the complaint file number.  Didn't say on behalf of who or what this meant.  After reading this site I am not sure weather to call her back or not or to wait and see what happens.

A Miss Clark called me from this number, had me in tears as she threatened to freeze my SSI checks if I didn't give her $900.00 IMMEDIATELY.  She then got my 72 year old Mother on the phone and threatened her.  She was asked to call us back in 5 minutes.  During that 5 minutes, I called my attorney, who was out the office said to tell her that on my attorneys advise they would have to wait for tomorrow for anything to happen.  She agreed to this (suddenly very pleasant)and I will discuss this with my attorney in the morning.  We will wait and see if she calls me back!

I received a call from a "Harvey" telling me that I had a debt that needed to be collected and that he needed a payment of $5,000 in order to work with the company. I informed him that if I had that kind of money, he wouldn't be calling me. He preceded to start harassing my parents demanding that they pay him money. He has been nothing but rude and unhelpful with this matter stating the "I should call a rich uncle because everyone has one of those" or the company will sue me. I informed Mr Harvey that if the company is going to sue me, then they can sue me. If he calls again, I will inform him of the cease and desist letter I have sent the company and I will record any future conversations for use in court. I do plan on suing for harassment. This company has gone too far!

Jamie- First, let me say do not let these pricks stress you out. They use the method of threats and intimidation to try to get you to pay some ridiculous amount. What you need to realize is that they cannot garnish your wages without a court order.They teach their collectors to call and threaten to sue and garnish your wages and to be as obnoxious and intimidating as possible. They bank on the fact that most consumers do not know their rights, and then they call and try to force you into paying. They make all kinds of threats. They say they will sue, have you arrested, garnish your wages, take all your money, take your house, blah blah blah. I have researched the Fair Debt Collection Practices Act and know what my rights are.They cannot just garnish your wages. They have to sue first and a judge has to order the garnishment. If these losers do not own the debt and are merely working for some other creditor, they do not have the right to sue. What you need to do is to send these a**holes a cease and desist letter. Tell them that they are not to call you at home, cell, work, or any other number and that all further communication is to be in writing only. Tell them that since they know how to contact you they are not to contact any 3rd parties, such as other family members. Tell them they are to validate the debt, and to provide proof that they have the right to collect. They are to send something with your signature to prove that the debt is yours and who the original creditor is and the date of the last activity of the debt. Send this letter CERTIFIED MAIL RETURN RECEIPT so that you have proof that it was received. DO NOT TALK TO THESE LOSERS AND IF YOU DO, RECORD THEM IF YOU CAN. The Attorney general in your state can tell you what the laws are in your state for recording phone calls. Document any time they call, who you spoke to, where they called, and anything that was said. Save all messages on your answering machine and take pictures of your caller ID. After they receive the letter, if they continue to call they are in violation of the FDCPA and you can sue them for $1000 per violation. Do not admit to the debt or make any payments until they have provided proof of debt. If the statute of limitations has run out in your state, do not pay a dime or it will reinstate the debt. These jerks make a living out of threats and intimidation and it is my personal goal to have them shut down. Report them to the FTC and the attorney general in your state every time they call, threaten you or become abusive. And try not to let them stress you out. Take care of yourself first and don't worry about lining the pocket of some low-life bottom feeder from this abusive collection agency.

I recieved a call from the so-called National Enterprize Systems from A Kathy Defranco (Fake name I'm sure) She was looking for relatives of mine and was extremely rude and obnoxious kept asking me if I was the person she was looking for after I told her no. She said she was retained and that the person she was looking for has not paid their bill. She kept telling me the phone call was being recorded. Why she was talking so rudely on a recording was beyond me and didnt do anything for her case and didnt endear me to want to help her rude self at all. These people need to get better training and I plan to report them to any agency I can . They need to be put out of business.

Stated that he had been trying to get a hold of me for the past few days (this was a lie, as I haven't received any calls or messages this week). These jerks just called me.  It showed up as Unavailable and I wish I had recorded the call as they violated at least 3 aspects of the FDCPA in less than 5 minutes.  Pretending to be lawyers, threatening to have me arrested for refusing to show up at the fake court date set for August 10th.  I am really hoping they call back so I can record it and sue their sorry "company".

Just received yet another call from Harvey Liebowitz... same threats as others listed here; he has a file of mine on his desk, I owe him money and he wants to help me before a lawsuit ensues I called him and requested he stop calling me.  I told him if he has a legitimate issue with me he can submit it to me inwriting and and that any further phone calls from him will be recorded and reported.

By all means report these filth to any and all agencies that will accept reports.  Make sure to also contact the Ohio State Attorney General’s Office.  In late July he slapped these pricks with a huge lawsuit for all sorts of illegal tactics and anyone else in any state with a complaint against NES is welcome to add their story.  Complaints can be easily filed online.  We used to get “robo-calls” from them, but these stopped almost to the day the lawsuit was filed.  These bottom-feeders will say anything to scare people into paying and don’t even care if the account is valid.  In our case, the one they were looking for was no relation but with a similar name.  Forceful,informed confrontation is key to getting NES off your back.  Send them a Cease And Desist letter by Certified Mail.  As soon as they realize you know what your rights are under FDCPA and will or better yet, already have reported them to the FTC they will stick their tail between their legs and slink away like the cowardly punks they are.  The Ohio lawsuit is by no means the first for NES, but if enough people and/or the feds get involved it could well prove their last.  Let’s all do our part and help exterminate these vermin.

Today I got a phone call at work from a "David Fox", he told me that I needed to pay twenty five thousand dollars and told me I needed to secure the debt with family, friends, take a personal loan, etc.  After I told him that I didn't have the money (obviously if I did they wouldn't be contacting me), he said he would settle for 2000 dollars immediately and then I would have to pay five hundred dollars a month.  After telling me that he would sue, take my home, my car, and start harassing family members and multiple other threats, I broke under the pressure and set up a payment.  After reading this, I put a stop payment on my checking account and closed the account all together.  Now, I have to go thru the process of re-opening another checking account, and still have to worry about them contacting me because I "agreed" to the debt.  I can't believe I cracked under the pressure, but he told me that if I hung up he would continue to call me at work until it got paid.  I've dealt with other collection agencies, and they were willing to work with me and my financial situation.  He would just not take any less money, and made it sound like he was cutting me a break by making me only pay 2000 dollars.  I am sick over this whole thing, I wished I had read what was written here, otherwise I wouldn't have given him the information.  I know he can't take what I don't have since the account is closed but where do I go from here since I agreed to the debt? Someone please help!

Alyssa- Report this jerk to the FTC and the attorney general in your state. The threats that he made are all violations of the Fair Debt Collection Practices Act and are illegal. Also send a cease and desist letter by cerfified mail and tell them that you are disputing the debt as you were verbally harrassed and threatened and that they are to provide validation of debt. Don't you think it a little strange that on a $25000 debt that they would settle for $2000? They more than likely don't even have proof that the debt is yours, or it is past the statute of limitations for your state, meaning that they can't sue you for it. But, if you make any kind of a payment, it starts all over again, and then they can sue you. IN your cease and desist letter, also state that they are to cease and desist from calling you at home, work, cell, or any 3rd parties, and that they are to communicate in writing only. Tell them that if they continue to call, you will be recording all calls and reporting them and contacting an attorney to sue for harrassment and violations of the FDCPA. This agency is famous for threats and it is time that they were put out of business for good. File complaints for every violation, and document all violations to use in court. you could get $1000 per violation.

Don't sign it or they will have a signature to forge. Keep the taper recorder handy, let them know you are recording,(you don't need their permission), and record every time they call. Take pictures of caller ID, record all messages, and report them. If the harrassment continues, sue them. Check the Statute of limitation in your state. If it is past, you can't be sued, and if they try, it can be dismissed. Do not pay a dime until they have sent validation of debt. Do not let them intimidate you. They ran with their tails between their legs and sent me a letter of apology, like that would make up for their harrassment.Send this letter CERTIFIED MAIL RETURN RECEIPT. and keep copies of letter and receipt to prove they got the letter and to use in court against them.Good luck

Ohio Attorney General suing NES!!!!!! I received an email from the Attorney General's office in Ohio asking for details concerning my experiences I had with various employees of NES.  I had filed complaints with the Ohio BBB and the FTC concerning the abusive and threatening tactics that this company uses, and they are wanting anyone with any complaints about this company to contact their office at 1-800 282-0515. Let's band together to help get this company shut down for good.

I keep getting calls for Morris Thompson and that is not me.  They called today and spoke to my husband and told him that I needed to call them.  I called them from work and they now have my work number.  They verified that I was not the person that they were looking for and said that they would not call again, but can't prevent other companies from calling.  They made it sound as if the debt keeps getting sold over and over again.  I think they are a bunch of liars and when they call again, I will be sure to notify them that I do not owe the debt and if they call me again I will be filing a lawsuit against them.
