Code $24-5-0.5-4(c). against Sunstar Travel and Tours, Inc., is a Florida corporation whose principal place of business is 1123 E. Altamonte Drive, Altamonte Springs, Florida and Tropical Travel Marketing, Inc., a Florida corporation whose principal place of business is 1450 Eden Drive, Deltona, Florida 32725. Both companies also do business as SS Travel and Tours, S-Star Travel and Tour, and Vacation Clearance Center. Also named in the Lawsuit is Joseph D. Hanna, president of Sunstar Travel and Tours, Inc and, Louis Quiles, president of Tropical Travel Marketing, Inc.

The lawsuit alleges that from on or before January 3, 2007 to and including the present date, Defendants sent or caused to be sent at least 129 facsimiles to Indiana telephone numbers.
Said facsimiles were unsolicited advertisements, as defined by Ind. Code $24-5-0.5-2(13).Said unsolicited advertisements were sent for the purpose of soliciting the sale of property, goods or services, specifically, travel or vacation packages or services. Said unsolicited advertisements were sent by telephone facsimile machine as defined by Ind. Code $ 24-5-0.5-2(a)(12). Defendants knowingly or intentionally sent said unsolicited advertisements or caused said unsolicited advertisements to be sent. Defendants had direct personal participation in or personally authorized the sending of said unsolicited advertisements. Defendants did not have an established business relationship with the recipients of said unsolicited advertisements. Said facsimiles did not contain in a margin at the top or bottom of each transmitted page or on the first page of each transmission, an identification of the business, other entity, or individual sending the message, and the telephone number of the sending machine or of such business, other entity, or individual.

Sunstar Travel and Tours, Inc. did not obtain a certificate of authority from the Indiana Secretary of State prior to transacting business in Indiana, and does not presently have a certificate of authority to transact business in Indiana. Tropical Travel Marketing, Inc. did not obtain a certificate of authority from the Indiana Secretary of State prior to transacting business in Indiana, and does not presently have a certificate of authority to transact business in Indiana. Pursuant to Ind. Code $ 23-1-49-2(d), a foreign corporation is liable for a civil penalty of not more than ten thousand dollars ($10,000.00) if it transacts business in Indiana without a certificate of authority.

WHEREFORE, the Plaintiff, State of Indiana, requests that the Court enter Judgment against the Defendants, as follows: Permanently enjoining the Defendants, their agents, representatives,

It was made to my attention this was listed here, I am the Customer Service Manager and the person above Richard Hertz is only someone that is on here to cause a problem with our company and is giving out incomplete and false information. First of all, our record with the BBB is remarkable since we have been in business since 1992 and have only a handful of complaints which KEEP IN MIND HAVE ALL BEEN RESOLVED. We travel 200-300 clients per WEEK, which is approx. 13,000 per year and over 200,000 clients in our history! So, 58 complaints from 200K is .029%... Thanks Mr. Hertz for bringing that ouy! THAT IS A COMPLIMENT! Second, the case regarding ADVERTISING PRACTICES not our company, in Indiana is still pending and I have already proven that our company did not send these faxes they accused us of, and that our company was set up, but that is not to be discussed until after this is resolved which I can assure you will be in our favor. Our company is in excellent standing with the State and with all organizations we are involved in.
I read many items here and many have nothing to do with our company. I see health care, mortgage, roofers, construction, etc.. WE ARE A FULL SERVICE TRAVEL AGENCY AND HAVE NOTHING TO DO WITH THESE PEOPLE.. Understand, for those who do not understand how the system works and wishes to make accusations, The deletion numbers are designated to the advertising agencies. They have many companies that they advertise for. WHOEVER is advertising THAT DAY from whatever particular list they are using, will be directed to use a certain DELETION NUMBER, Just because we use it today, they can have another client using it tomorrow.. same number, but different list used. Common practice. Do not associate all of these companies as one. THEY ARE NOT. You will know that you are dealing with our company if you ask to be deleted because we issue a deletion confirmation number, if they did not, ask for one, and that is how we know what is deleted. We can actually trace each number by the day it was done and who deleted it by knowing this number. Do not mistake all of the travel fliers you get as being the same company, WE ARE NOT.. we are ONE office and ONE LOCATION and have no other connection to any other travel company. We will gladly remove any number that is requested.
Again, our record speaks for it self. If you have questions, you may direct them at my by calling the correct number on your document. My suggestion is that if you get fliers from other companies, call directly to the number listed and ask to be deleted. That is if you are confused or do not understand how the deletion system works.
Our company has been a valued seller of travel for a long time and we have put thousands of people on fantastic vacations throughout the years.

In addition to my above comments, I just want to make it clear that Louis Quiles and Tropical Travel Marketing have NOTHING TO DO WITH THIS COMPANY. They were an independant agent working with us in the past but are responsible for their own activities and actions. This company has since closed its doors and no longer operates. Our company is and has proven that we are a great company and have followed all laws, regulations and activities.

Fax for reservation vacation

My fax machine always tells me that in Canada it is illegal to not place fax number on the fax that is being sent out. Is this true?

Okay folks... for all you people who just hate getting these annoying fax scams you simply do this: Bombard their 800 booking number with crank calls by using a pay phone somewhere. It used to be that you could direct dial an 800 number without having to put money in the pay phone. Not sure if that still works but hell, it'd be worth a few quarters just to tie up their staff with BS phone calls for a while. It also costs THEM money every time somebody calls the 800#. And NEVER, EVER waste your time with opt-out numbers. They are 100% USELESS unless they are a legit fax marketing company (which is very rare these days!)

Yep, sounds like the same guy I had. I called and asked to have a "confirmation" number checked to which he said he needed the fax number. What the f*** are the "confirmation" numbers for then? Anyways, when I pressed to have the confirmation number checked, he said almost the same thing..."You Canadians are all ......." I gave up then and there and hung up on him. I think his name is Jay Hammond, but I could be wrong on that. Bottom line...these guys do not care about anything except getting their hands on your MONEY! DO not purchase packages from them. He even tried to tell me they have only been in business since January and it must have been a different company. What a load of BS as I have faxes from Oct 15 2008 and they are all the same.
