Kraft is a attorney who handles alot of different collections agencys and one is EOS/CCA which handles AT&T. I filed a lawsuit on Orange County Superior Court in California and received a settlement agreement with Kraft. His law firm Kraft Law Firm has a website but no fax number. His direct number is 781-990-0996 and the address he uses is his home, 30 Coach Ln, Westwood, MA 02090, and his email is michael@kraftlawfirm.com

File a small claims and have there agent for service served in your state. Just check corp online records for agent for the collections agency that is calling you. For Californa is CT Corp in L.A., CA. Me being a private investigator, proces server and paralegal understand the laws more plus I use to be a collections manager for a law firm. Good Luck

I want to know how they get your cell phone number?  I never give my cell phone number for anything, yet this CCS is calling my cell phone and leaving a message...I'm getting really annoyed.  Is there anyway you can contact your cell phone company and have a number blocked so that they can't contact you or do they use a different number every time to call?  They called me from 1-800-708-6019.  Thanks!

a "violation" of the FDCPA is not made when a company calls you and you fail to notify them in writing with a cease letter?  If you simply complain without doing anything in writing your complaints will be ignored.  

Having a wrong phone number IS NOT a violation, read ALL of the Fair debt collections practices act, not just the parts that suit your complaints.

the do not call registry is for sales calls only.  Collection agencies are not selling anything therefore do not adhere to the do not call registry list.  the telephone numbers they get are from the companies that place accts with them, if you want calls to stop permanently send a cease and decist letter in writing it's the only way to do it, otherwise they are within the law to call again.

Please allow me to educate you on credit reporting re debts. Most of you are wrong but I think my law degree gives me the ability to respond correctly. I am quite familiar with debt collection law.

#1. Debts can only remain on your credit report for 7 years. That is 7 years from the date of last activity which can mean the last payment made but can start again if you admit you owe the debt. If a collection agency gets the debt they cant start the clock all over again unless you admit the debt. Hence why do they call over and over harassing you? Answer is they want you to admit you owe or make a payment then they are good to go. Any debt over 7 years can be disputed and removed or you can sue.

#2. Any debt that is included in a Bankruptcy Chapter 7 can only be reported for 10 years. Anyone who tries to collect a bankrupted debt can be sued if you advise them it was bankrupted and they still try to collect.

#3.Every state has a different Statute of Limitations. These range from 3 to 20 years depending on the type of debt and your state. Most states have an SOL of 7 years or less. Regardless of what your state SOL is, no one can report debts on your credit report that are over 7 years old (see #1). That is because federal law dictates credit reporting. Look it up under FCRA law. You can dispute and sue anyone who tries to keep negative info on your credit report after 7 years. You can also sue the credit reporting agency if they fail to remove this info after you dispute.

Collectors try to prove me wrong because you cant. If you are getting collection attempts that violate these laws then use the law and sue them!

WARNING! Not all debt has a statute of limitations! Also, when the SoL expires, it can be used as a defense to bar collectors from collecting through the courts, however the debt DOES NOT go away! Collectors can still attempt to collect the debt using other legal dunning methods

For instance, there is NO statute of limitations on:

Federal Student Loans;
Most Types of Fines;

Judgments can last up to 20 years and can require the judgment be renewed at a certain point such as the 6-year point.

Generally, the statute of limitations for collecting debts begins the moment you sign a credit contract! However, just about every state has specific rules on the running of the statutory period and some even have provisions to adjust (toll) this period.

Your information is wrong.  There is no statute of limitations on debt, your debt is your debt.  collection accounts that are unpaid stay on your report UNTIL they are paid.  After they are paid in full (don't settle because the remainder stays there forever) the account starts a count down 6yrs and 9mos from the PAYMENT date.  If you don't believe me check the credit bureau they will tell you the same thing.

collection items remain on credit reports indefinitely until they are paid, and then and only then, will they be removed after 6 years and 9mos to be exact.  If the collection item is never paid, it will follow you to your grave.  Best to clear it up and get it over with.

Collection agencies do not fall under the National Do Not Call Registry's restrictions.  Collection Agencies are governed by the FDCPA (Fair Debt Collection Practice Act); therefore, to cease calls, you will need to do the following:

(1) Send a letter to the agency via USPS Certified Mail with Return Receipt to cease calling you.  NOTE: A Cease and Desist is different than this request and may bring on additional and immediate unwanted actions.  Once the agency receives this, they are required by FDCPA to stop calling you, EXCEPT for the following:

I was also getting calls from: 800-419-0724 asking for someone I've never heard of.

I called the number listed earlier: 617-965-2000 twice and both times they couldn't find my phone number. Then I called and had them look up the case #, they then transfered me to the correct department which found my number and deleted it. I hope that worked.

Legally you are not responsible for debts over 7 years old. If you are getting phone calls for debts tht you are not reponsible for then they are simply soliciting to try to get you to volunteer to give them money through harassment. This is not sanctioned by the National Do Not Call Registry. They are buying uncollected debt lists that circulate among this type of company. IF a debt cannot be collected in a certain amount of time the listing is sold again and a new crop of calls comes. You do not have to endure this.

It's a collection company, and all you have to do to get them to stop calling is 1)  pay what you owe  or 2)  call and tell them that they have a wrong number.

They get their contact info from their clients, and if a phone number is wrong (mistakes don't warrant calls to the FCC by the way...you really think the FCC cares if you've done nothing to clear it up yourself?  Please.) they have no way of knowing unless YOU tell them.  Don't whine and say you don't have time to call them.  Just get it done.  My guess is that most of you actually do owe money and are simply annoyed at being held accountable.
