Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

First day they called at my job while they asked my co worker some questions about me. I don't know where I can file sue them to give all information to my co worker. They knew that I'm a hearing impaired.  They do same things to call my job other days. My worker already told them that I can't hear. So they gave me a numbers to call. There has no answer 3-4 times. Strange. . I think they are fraud. Please help me to find what numbers to call and file sue them to give all information.  If they find out that I'm hearing impaired and they have my email to conservative instead telling them which isn't their business. . I informed them the perso they are looking for is not me , this is not the first time you have contacted me, and do not call me any longer. I will start keeping a log and reporting these people. I am tired of being harassed.

Yea they called my job asked for me. Told me I took oout a loan. I did NOT. Then told me they had my bank account number and info that the money was deposited into. The account was in my name. But was strictly for a benifit I started for my friends daughter. Whom has leukimia. The mother no longer my frien used all my info and didn't pay the loan off or the over draft fees. I spent over a month planning and collecting donations for her 18 month old daughter and thendonated over 18 hours working the benifit the entier day. Raised her over 2000.00 and then I find out about this needless to say I ehave to pay it or press charge. I wish it was aeasier decision to make. As a mother I wouldn't want to be away from my sick baby I just don't know what to do anymore

It may bear reminding here that United Cash Loans should be immune from FDCPA claims as an original creditor. It would be covered only if contact is made under a different name, such as the other PDL shop names said to be at the same Indian tribe address, AmeriLoan and USFastCash. You'll have to fight back with your state laws, such as anything which covers deceptive business practice, licensing, or registration. A precious few states (California, Florida, Pennsylvania) have collection practice laws which apply to original creditors.

Your reading of the FDCPA is faulty. 805(b) only addresses "communication with third parties", specifically disclosure and discussion of debt to the wrong person. The term "communicate" is given this limited meaning in 803(2). The only place employers are mentioned is in the section just prior, 805(a)(3), which permits debt collectors to call PoE absent any contrary instruction or indication that those calls are unwelcome.

What that means is calling the employer is just peachy so long as no other part of the FDCPA is violated. Workplace calls are of course favorite avenues of abuse for trashy collection agencies, whose reps are likely to mouth off, reveal debt details, create annoying call patterns, and/or refuse to stop calling when asked. As often happens in this Act, the agency's conduct counts for a lot more than the mere attempt at contact.

There is no argument with your other points. I do caution that a full cease-comm letter is a poor choice unless the debt claim is false, names someone else, or cannot legally be collected. A dispute notice is best for anything "in stat" or for which any liability may exist. The same letter can set contact restrictions, the phrase "all phone calls are inconvenient" being a popular choice. I also disagree with making threats and quoting laws. The phone bullies see those in the mail every day and are not intimidated until a real summons shows up. If they want to keep denying your rights, let them build their own coffins.

I don't give a damn what the small print says . . . Section 805, sibsection (b) of the Fair Debt Collection Practices Act is clear and unambiguous. UCL CANNOT call your employer without your permission, CANNOT call your home or cel phone number before 8:00 a.m. local time or after 9:00 p.m. local time. If they do not comply with the FDCPA on this, they can be SUED for unlawful harassment and intimidation.

I just sent UCL a cease-and-desist letter becauwee they illegally called my employer twice. In my letter, I gave UCL firm warning that any further calls will be regarded as unlawful harassment and intimidation and that legal action will be taken against them. No one -- not even Indian reservations -- is above federal law, especially when it comes to electronic communications, which is the EXCLUSIVE regulatory province of the federal government.

You really have to know what your legal rights are and invoke them FORCEFULLY.

They keep saying that i owe them money and i don't. They have threatened to take money out of my account, and they had information on me they should not have and don't know how they got it. I called my bank and they said we have to change your account, so i did. These people have caused me a lot of trouble and i still get calls from them 5 or more times a day. This is really irritating.

I recieved a call from United Cash stating that they have 3 law suits against me for unpaid loan. I did not recieve a loan from this company. When asked when did I borrow, they hung up and from there I have not been able to get back in touch. Now when I recieve calls they are just holding the phone.  I ve researched that this company is on an Indian reservation and is not subject to US laws. What other resort do I have to stop calls and correct their system?
