these piss-offs were calling me asking 4 some william dude. it got so bad that i changed my voicemail to hey, so,  its livys cell. ok if this is capitol management calling, my name is not William, i have no clue who he is, and i've told u this b4, STOP CALLING ME!!!!!! and if i know u, & it's important, call my house phone, ok say wat u need 2 say @ the beep.    they creep me out sooooo bad.

Inform the caller that personal calls at the workplace are prohibited and if they continue to call a complaint will be filed with the FTC per your rights afforded to you, and your employee, by the Fair Debt Collection Practices Act (FDCPA). Once you have informed a debt collector that such calls are prohibited they are to stop contact, but if they continue to call after being told to stop - file a complaint with the FTC at www.ftc.gov and complete the online complaint form.

Relax...no collection agency has the authority to have anyone arrested for anything. This is a common phony scare tactic used by crooked debt collectors. And the debt collector thug who called you violated several federal debt collection laws with that one call. First of all, it's illegal for them to threaten people with arrest, etc. In fact, they can't legally threaten to do something that they either can't do or have no intention of doing.  Also, they violated the law by discussing your sister's situation with you.

That's just for starters. These people are crooks and, if I were your sister, I'd retain an attorney and pursue civil and criminal penalties. (By the way, there are many attorneys who specialize in fighting crooked debt collectors and work on contingency. I've listed a few links below to the websites of such attorneys.)

Also, Capital Management Services is notorious for these crooked tactics. Here's a link to the website of consumer law attorney Bud Hubbs which contains Bud's report on Capital Management and his advice for dealing with them: http://www.budhibbs.com/debtcollectorpages/capital_management_services.htm   He suggests people who are being harassed by these crooks to record all conversations with them (where legal) and to contact his office for assistance in finding an attorney to deal with them.

i actually talked to a guy that asked for my sister. he said that she had to call him back within 10 minutes and that he was with the city of phoenix in the summons department and that if she didn't call within 10 minutes, they would "process a summons for adjudication (sp?) at 9am in the morning."
i asked what would happen if i couldn't get a hold of her within 10 minutes & he said a summons would be issued and the sheriff would come to her house or her work & serve her a summons.
i asked if she was arrested, or what - thinking that this was a legal matter and not a freaking debt collector - and the guy said to me that "federal law prohibited" him from discussing that with me.
I totally thought that my sister was going to federal prison for something! That guy totally freaked the crap out of me. The fact that he calle from a toll free number and left a different toll free number as his contact number did put enough of a question in my head that i searched the number on the internet & found this page.
Thank goodness for this page! What a underhanded way to go about an already shady job! It should be illegal to use the tactics that this thug tried with me!

That number belongs to Capital Management Services  (www.cms-collect.com). The are a collection agency.  They are not Capital One (but I suppose it's possible Capital One is a client of theirs).
