Gosh another company looking for my dead wife!!  HEY SHE'S DEAD BURIED gone for 3 years now. Estate is closed and MD law says any debt over 3 years old is uncollectable.  BUT nobody will answer phone anyway its a second home!!!  WAIT UNTIL they file their court stuff I GOT THEM for FRAUD!!!!  I'll be sueing KEEP CALLING see what happens!!!  :-)

Your first mistake was trusting that these frauds are for real!  If a debt has gone beyound the statute of limitations, you have no moral nor legal responsibility to pay it because the CC company has written it off as a bad debt, and you paid for it when you paid your taxes!  Don't ever respond to bottom feeders like these people!  They are no better than people from Nigeria who send you emails telling you that you have a wealthy family member who passed away and left you a million dollars and if you give them your bank account number, they'll wire the money to your account.  Don't ever be fooled again because if the majority of these leeches starve, unscrupulous lawyers will stop creating boilerrooms for these people to work in.

It could be worse. You could have a jerk who is running a collection agency out of his house. He gets his jollies by keeping an eye on me, when I leave my house and when I return, when I choose to sit out in the sun on my front porch, or in the back yard. Just to let me know that he is aware of where I am, no sooner do I get back into the house then the telephone rings, and it is from one of his cover numbers/agencies. Of course I do not pick up the call. My heart goes out to all those poor souls who have to be on the receiving end of his tender ministrations through his collection agency.

Nope, it was already charged off and the company took it off their taxes.  Nothing is owed since it was likely an account charging interest rates above what is legally allowed.  I love how female dogs like you come on here trying to shame people into paying something that has been written off on the original creditor's taxes. They turn around and sell the account to bottom feeders like yourself and then you try and make people feel bad and GIVE you their money.  Here's a suggestion for you, why don't you go out and make money at something that will allow you to move up to working with better people, say like prostitution, or the manufacturing and marketing of meth!

Hi Ellen - I was sued by Asset Acceptance also.  I hired consumer lawyer Jason Shear, Esq. in Amherst, New York.  We got the debt collection case brought against me by Asset Acceptance dismissed!

Ellen,  you may want to contact a local civil attorney on this.  Depending on how old the debt is and when the last activity was,  it may be Time Barred by the statute of limitations in your state.  Most civil attorneys will advise you,  at little or no cost,  and provide representation should it come to that.  Asset Acceptance is like many other collections companies,  in that they buy old outdated debt for almost nothing with hopes of collecting huge amounts.  They will not have legal validation of the debt and depend on you not asking for written validation and not showing up in court.    Talk to a local civil attorney....Many times a simple letter by them can eliminate the problem.

My husband and I are paying off our debts little by little (both working full times jobs and im in school) we are good people and work hard. This worthless group of idiots somehow contacted my husband and I at our hotel room while we were out of town for a funeral! How is this even legal? Then when I asked the young lady what the phone call was regarding, she has nerve to tell me its a "personal business matter"! I know they are scammers. They had the nerve to send me a letter alleging I owe them over $1250 but for a one time payment of $129, the matter would be considered settled. Tell me what honest company does business that way. And to top it off they wouldn't say what the alleged debt is for. I never take their calls. You don't have to talk to them. They sent the letter on official looking "company" stationery and think a person will be fooled or intimidated by that. They are so clueless.

Let me guess, you've been relying solely on verbal demands. The more you argue on the phone, the more you are painted as a liar. To the junk debt collector, only three responses are acceptable:

- "Yes, it's me you want."
- "The person you want has been hiding from you in my closet."
- "I make the payment to what name again?"

To a ''not me'' case I always recommend putting the agency on notice, just as you would if you were the target and the debt claim was invalid. Send a cease-comm notice via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft one. This will set a legal landmine, as such a notice is ignored at their peril.

This can also help pull the agency under the shadow of TCPA, which carries treble damages for ''willful'' violation. It should also be noted that the FDCPA covers you as the non-debtor for abusive and harassing behavior, meaning you should document all collection calls with care.

How about you collection trolls read the laws your industry must follow rather than the crib sheet you got from "compliance training"? This tired song of "Pay Youse Bills" is predicated on faulty assumptions that all debt is voluntary, all lenders are honest, all debtors are thieves, and all collection tactics are justified. You slept through the grade school class where one is taught that "all general statements are false".

Corrections:
- An account marked "charge off" does not equal "sold". It may also be assigned to a third party collector while retained by the lender.
- Currently the junk debt market is fairly saturated, with prices ranging from 03% to 15% of face value. The more an account is passed around, the cheaper it gets, and the more breaks there are in the chain of title. Junk debt collectors have too little skin in the game to worry much about their hostile and lawbreaking habits, particularly given the low numbers of consumers who truly understand and defend their rights.

I keep getting calls for someone who has the same name as me but different ss#/dob etc. I checked my credit report and have nothing past due with a score of 790. I don't know how to convince them to stop calling me, I am not the person they are looking for!!!
