Postcard received from 1-800-570-1197.  Debt Reduction Program.  Final Notice.  Mailed from ST. Louis, MO.

It is a violation of the Fair Debt Collection Practices Act for a debt collector to send a "POSTCARD" to you regarding your debt.  This company, whatever their name is, has acted unethical and possible illegal by sending a POSTCARD with your information for anyone to see.  Stay away from these types of companies.  

If you are having debt problems, then you are or will soon be hearing from 3rd party debt collectors.

When you receive a letter from a 3rd party debt collector, dispute the debt and ask for verification, in WRITING. Mail it Certified, keeping all paperwork or fax it, and keep fax confirmation.  They have a short amount of time to verify the debt.  Until they PROVE that the debt is yours and the amount and account number is correct, they don't have a case against you.  Until they have proved the debt, it a violation of the FDCPA, (see above) for them to call you or try to collect the debt.  If they sue you, you will have verification that they did not prove the debt and the case will be dismissed.  Debt Collectors will usually not take legal action if you have used these tactics with them.  

If you don't want them to call you, include in the "dispute and verification" letter that you demand that they not call you on your land line or cell phone.  If they do, keep a log of when, who, the number they called from and what was said.  Then contact an attorney that specializes in debt collection law.  There is NO charge for an attorney to help you through this.  There IS a charge if you are sued BY the debt collector.  If you win your case or settlement you will be entitled to a minimum of $1,000.  The debt collector pays the attorney.  

These violations that I am referring to will win you money and will cost you none.  DO NOT allow debt collectors to embarrass you, call your friends and neighbors, call you names, contact you after you have told them not to, call you at work AFTER you have told them to stop.  DO NOT give them your bank account info.  If they threaten to sue you and they don't, then sue them for violating the FDCPA.

If you are sued by the debt collector, go to court.  I recommend paying an attorney to go for you.  Usually in the $500 range for their fee.  If you don't hire an attorney, send in your ANSWER that you dispute the debt and the validity thereof.  This will at least require the DC to prove that you owe the debt, which in most cases they CAN NOT provide proof.  When they show up for court and can't provide proof to the judge, then you will win your case and owe nothing to the DC.  They sue folks all the time and win because folks don't show up and thus, the DC will automatically win.  That's what they are counting on.  

Read up on your rights with DC.  There is so much info and you have plenty of rights.  GET EDUCATED and it will protect you.

They don't know how much debt you have.They sent a letter to my daughter and she has very little debt.

BTW this is a big scam. They don't even have a business name. If you have debt you can't pay off negotiate with your creditors directly.

we didn't received a call but a letter from NATIONAL DEBT SERVICES, my mom received a letter from this company I called and it seems that the phone number is for an answering service company, I ask if they have an address or location she said none. I THINK THIS IS A SCAM!!

Have you found anything else out about this "National Debt Services" since you posted this comment? I received the same letter and spoke to Amanda also. If she is the only one working there, that makes me more leary about it. It does sound too good to be true.

I received a Debt Mediation Notice from this company, also. It has a case number at the top and the same 800 phone number as others have noted. What I want to know is how did they know the approximate amount of my total credit card debt? This is a little scary to me.

below is an excert that I pulled from the FTC web page and is similar to what I was told over the phone.  The FTC says to stay away from places that push debt management plans as your only option even before analyzing your financial situation

The FTC entered into separate settlements with the receivership defendants and each of the individual defendants. The stipulated settlement orders bar the defendants from making false claims for debt negotiation services or any other product or service. The orders require that, prior to enrolling any consumer in a debt negotiation plan, the defendants must clearly disclose that: (1) late fees, penalties, and interest will continue to accrue on the consumer?s debt until the consumer?s creditors accept and receive a settlement; (2) a consumer?s creditors may still sue to collect on the debts and garnish the consumer?s wages; (3) interest rates applicable to the consumer?s debt may increase; (4) any money a consumer saves in negotiating a settlement with a creditor must be treated as income for tax purposes; and (5) a debt settled for less than the full amount owed may result in a negative notation on the consumer?s credit report. The orders also prohibit the defendants from engaging in abusive telemarketing practices, including violations of the National Do Not Call Registry, and require them to comply with the GLB Act.

I called this place and talked to a lady named Amanda.  She said she was out of St. Louis Missouri and told me about a plan to help me out.  I am still very skeptical though.  I didn't have to give any personal info over the phone execpt the amount I want to consolidate and the case number in the letter.  I've been trying to find info about them on-line and through the BBB but have had zero success.  Anyone have any info on this organization?
