5. On March 12, 2008, the Department conducted an examination of SCS's businessaffairs. As a result of the examination, the Department discovered that SCS and Mr. Bartlett:a. Failed to maintain a positive trust account balance as evidenced by trustshortages during eleven months of the twelve-month review period endingFebruary 28, 2008; specifically:i. Petitioners failed to maintain the trust account by over transferringtrust funds to the operating account to pay company expenses whichcaused company trust shortages;ii. The previous exam also noted small trust shortages; andiii. However, Petitioners deposited $100,000.00 to the trust account inearly March, 2008, to cure the trust shortage.6. Based upon the above findings, the Department issued and served upon SCS andMr. Bartlett, an Order to Cease and Desist; Notice of Opportunity For Hearing; Consent to Entry ofOrder ("Cease and Desist Order") on August 28,2008.7. On September 4, 2008, the Department received Petitioners' request for a hearing toappeal the Cease and Desist Order.CONCLUSIONS OF LAW8. Pursuant to A.R.S. §§ 32-1001, et seq., the Superintendent has the authority and theduty to regulate all persons engaged in the collection agency business and with the enforcement ofstatutes, rules, and regulations relating to collection agencies.9. By the conduct set forth above, SCS and Mr. Bartlett violated the following:a. They are the rudest people you will deal with. First time they called from a restricted number and asked me to pay a hospital debt with a credit card that's been closed for 2 years. Said they sent a letter that I never got and threatened my credit.

I called and paid the hospital instead of them and they refused to believe that I paid them. It took over a month to get a letter from them showing it was paid.

I made arrangements and any other collection agency will stop the calls but not these fools. they claim it is an automated response.

They just called for a co-worker of mine, when I asked in regards to what, they said a "personal matter" and left an account number. The lady was rude too!

This is a debt collection agency that is calling about the debts of a dead relative of mine.

I absolutely refuse to pay the debts of dead relative.

They can take their bill and stick it up where the sun doesn't shine.

I'm going to file a complaint against them with The Arizona Department of Financial Institutions which governs collection agencies in Arizona.  It is part of the Arizona Attorney General's Office.

this number called and I looked it up to see who it was.  They left no message.  Finding reports that these people are POSING as a collection agency and they have had criminal charges against them in the past.

It's driving me CRAZy!!! This number calls all day and night, nobody ever says anything and they never leave a message.

a recording claims to be looking for someone named Kelly.  I press option 4 to indicate that I'm not her and I continue to receive calls daily

Machine which states that it is a call for somebody else. Does give the option to press 4 if that person does not live here, but this is the second call, so far.

I am not sure who these people are but they have to be the rudest people I have ever dealt with and do not appreciate getting automated voicemail messages on my cell phone!
