Called and said they were coming to my work tomorrow to present me with a letter of intent. I called the attorney # left on voice mail, but was taken to a voice mail box and no one would return my call. They also called my mother and threatened to come to her  house. I filed a complaint with the FTC.

I received a call at work from a Mr. Reid who is nothing but a courier asking me to be at work between the hours of 10am and 2pm, I asked what this is about and who is the letter from he told me Carey Law Firm and the number 800-649-8440 and asked me to contact them and asked me not to say how I got their information. Right there a red flag!!! First of all, whoever this Carey Law Firm is, I assume is a debt collector is going against the law and threatening me with a lawsuit.  I checked with the local civil courts in my county and there are no judgements against me.  There are laws debt collector have to follow in order to file a civil suit against you. This supposed law firm are nothing but scumbags.  there is a website called Bud Hibbs, if you provide them with information on a debt collector they will let you know who they are and give advice on how to handle the situation.  I received no correspondence from this law firm whatsoever but I did file a complaint with the FTC and the New york attorney generals office.

I recieved the same letter after threats of coming to my home to serve me with papers. I did reseach on them and found out that the are a collection agency, not a law firm. Although, I did owe money to a pay day loan I didn't recall the exact amount. So, I set a payment agreement with them using a store brought credit card which I will destroy as soon as the last payment is made.

However, I called all the numbers on the letter and from call backs that were left and all phone numbers are not working. Do you know if this(The Carey Law Firm) has been shut down?

Hi, I myself am a bill collector (the nice kind, i swear!) and you do have rights. DO NOT PAY ANYTHING! instead tell them in a calm and cool voice, First and foremost by law you are obligated to provide me information and/or the original contract of this debt" if they refuse to provide you this, they are violating the FDCPA (quote that!) in addition to harrasment. If they threaten to take it or file it in court tell them to do it! believe me,that is just a scare tactic, they are a 3rd party collection agency and only a very very small percentage actually file. tell them they better do it because otherwise that is a threat and they can only threaten you with it if they really intend on doing it. Since they probably won't add that to your complaint to the attorney generals office which you tell them you will be doing! I am also getting these calls but they won't give me information about it and I have no clue what this is!

I received a call from " MR McDuna " who literally harrassed me into coming up with some money in two days.  It was about a debt that was a year old, and this man didn t sound like a nice person from the get go. I should have known better being my gullible self.  MR McDuna continued to warn me that my case would court if i did not pay the 1000.00 within a certain amount of time.  about 2 days.  My intuition told me something was wrong but the scare tactic worked and fear got to me being an upcoming first time father.   I am so mad !   After mr liar couldn t get anywhere with me he started to threaten me some more, saying that he was going to turn it over to the next step .  Then ....

KIM CAROL called me with some stupid comment about Mr McDuna being " new" around here.  I said " Ohhh yeah I can tell " being sarcastic and still gulible.  I was still afraid at this point because I was thinking about m y family more than the reality of the threats.  KIM CAROL said that she would work with me and said that i HAD TO PAY 25 percent in one day.  So stupidly I ran to my poor mother and had her pay 203.00 on a credit card thinking this was absolutely the truth.     Stupid me.   I took the bait of the devil!   The next time that i talked to " KIM CAROL"  it wasn t pretty as I finally was pissed off for real.    Mr McDuna called A G  A I N  obviously not knowing that " KIM CAROL"  has worked something out with me. he had the same threats and began with the same bs speech.  

THEN.....  I was mad ..   Still being my stupid self I called " KIM CAROL " and said "  I will not be paying anything until the end of april because we made an agreement you and I.  I said do not have that man MR  MCDUNA call me again and she said " WHO".   She had no idea who MR MCDUNA was !  So nowI m thinking ok its a big law firm...  but I was still pissed and trying to work it out.   " KIM CAROL" called me again and said that she could work with me still about our agreement etc.  My closing information is this..  I then GOOGLED THE NAME AND PHONE NUMBER 716 748 6063 AND 7 800 649 8440 EX 518 ..  AND BAM GUESS WHAT I FOUND !

They were trying to threaten and strong arm people just like me with some obvious key words..
1 HOT CHECKS
2 FELONIES
3 COURT
4 FRAUD  ( hahah ..  as these little devils deceive people)

Those words are words that put fear in our hearts as good people because we do not want to be charged with crimes !  I am so pissed..  and I am going to reports these people to every possible agency that i can to ensure that they stop this evil garbage!  They should seriously be in jail for their own deceit

oh i never got 1 letter or e-mail from the carey law firm. and they said i had to pay $500 at once or $200 good faith deposit with a payment plan of $50 a month or i would be brought to court and have to pay there legal fees. please everyone call that number above(nys attorney genral's office) and lets bring down these crooks.

same happend to me i was called by a so-called process server saying he was to come to my house within 72 hours then left me a number and a case number and so i called and got......the carey law firm. and another number from them is 866-499-4041. i contacted the B.B.B. and the next day the new york state attorney's office called me, sent me the complaint forms. the women taking on this case is Karen Davis and her number is 716-853-8416. i encourage all that were scamed by carey law firm to call Mz.Davis at the nys attorney general's office.

This "Law Firm" has been calling my sister and my best friend, saying that there is a civil action being taken against for a pay day loan. The fact that they told my sis and my friend what the "civil action" was about along with the fact that this "Adam" person didn't leave a last name  set off a red flag. My sis happened to have a transcript of the call because she uses vonage. The number they called from was : 1-716-748-6073 and they said to contact "Adam" at: 1-866-499-4041 ext 512. I plan on filing a complaint with the FTC, BBB and the NY State Attorney. Also going to send a cease and desist letter to the "Law Firm".

I received a call everyweek at my job stating from Carey Law Firm and Felony Charges are being brought against me so I said I can make a payment plan she said no we dont payment plans you ahve to pay $400 or $3500 in court fees and payment plans have to be seen in front of a judge....is this crazy has anyone ever really got papers in the mail from court or an officer come to serve them????? Please help!!!!!!

I just got off the phone with a guy by the name of Mr. Donough claiming that if I do not pay 1k he will send my paper to the county clerks office but at the same telling me that he could help me settle for 600 what kind of s*** is that! so I told him to send some thing in writing and he was like no I can send you a settlement offer I said no send me something from the original lender I need proof he said that he didn't have it so I said fine send me the settlement office he said I need you to call me back in 30 minutes it's been 30 minutes and he has not send nothing to me all a scam and they claim they are a law office and they are not !!! do not believe what they say

Also, how could it be a hot check when you've never written an actual check to this place?  Everything is electronic which means anyone could've gotten a hold to your account and created this loan.  
Look up information regarding Mark A Carey Law Firm.  This is seriously a debt collection agency.  Their turn-over rate is sky-rocketing and this firm, Mark Carey himself has a citation.  
Just report these people to the FTC(Fedral Trade Commission) and the BBB (Better Business Burearu).
Keep your cool...it's all good.

Girl please!  Don't let those ppl scare you.  That's their job!  They are trained to use scare tactics to encourage ppl to pay these debts that they've purchased.  I got a call just like that and stupid me answered the phone even though it said "unknown".  They told me that a letter and a package to serve me for court would arrive to my job, plus they'd contact references or whatever.  
So a few days later the lady called me and left a message stating the last 4-digits of a social that isn't mine but supposedly it's my account from 2008.  Whatever!  
Next time they call, tell them to send whatever they need to send and leave it as that.  
The most that could happen is that they'll place it on your credit report after so long of failed attempts to collect.  
So don't worry yourself.  
Now if you've listed references, you bet, they'll call them and harass them too.

There names aren't legit...so don't worry at all.
As of yet, I haven't receivd anymore calls from these people.  I'm so waiting to get a call from them to let them know that their practices aren't legit...such as, threatening people to pay something that may not belong to them and to break down the laws to them.  Since I have this thought on my mind to tell them whenever they call; I'm not receiving any calls from them...lol.  Just Great

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.
