HOUSTON (KTRK) --
Harris County DA Devon Anderson is warning citizens about a scam being done by people claiming to be from her office.

According to Anderson, criminals claiming to be members of the DA's check fraud division are randomly calling people, telling them they have a bounced check and need to pay the fine with a credit card or risk being arrested.

"Criminals will use any method necessary to steal your credit card information, including impersonating law enforcement personnel," said Anderson in a press release. "Our office will not call you and ask for your credit card information. Never give out your credit card or personal information to anyone who calls asking for it. If you think you are a victim of this scam, please come forward so we can help you and catch the criminals responsible."

According to the DA's office, if someone has a check delinquency, they'll get a letter instructing them to make a payment by cashier's check or money order to the Harris County Restitution Program.

If you think you are a victim of this scam, please call the Harris County District Attorney's Office at 713-755-5800.

Here's an address
4691 Clifton pkwy hamburg NY 14075 which is a house strange I think, google mapped it. They have a website www.williamsonandbrown.com which is owned by a Jonathan Williamson. Website looks very unprofessional for what they seem to claim to be (a law office). Phone number tied to the domain name registration 716 574 5710. They are probably buying old debts even if they are paid and still say you owe. Some may be legitimate debt, some may not, they don't care I'm sure. Good Look!

Actually, JON, what the majority of these type of callers are doing is trying to rob the bank accounts of the people they call.  So who's the criminal now?  If the debt is legit, the collector has to validate it.  People should not be giving their bank account information to strangers over the phone.  Which one do you work for?

"you are probably the idiot. learning and teaching people how to duck and dodge debt for a living" and "now adays people seem to think they are entitled to things they have never earned ... Anyone who disagrees with that is a low life who probably dosn't have a significant other because you drive a bycicle you stole or living under a bridge ducking your debt" are all false assertions. Got any proof?

In recent years, third party debt collectors have been buying up old debt for pennies on the dollar and telemarketing collection calls to debtors to get what they can from their "investment". This old debt is sometimes legit, sometimes not (expired statute of limitations for example). In parallel, scammers have also been making extortion calls, sometimes to debtors using bought/stolen/phished loan data who may or may not have already paid off their debt, sometimes to random people, while pretending to be legit debt collectors. Problem is, both employ similar tactics to scare debtors/victims into paying legit/fake debts. If you don't have debt, you know for sure your caller is a scammer. If you have debt, you have to figure out whether it is a legit third party collector or a scammer -- not a comfortable position to be in but here's how you can perhaps tell the difference:

The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. A 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector and not an owner and must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm
You can tape phone calls per your state law described here http://www.fairdebtforconsumers.com/Recording-Laws-Summaries.html
You can tape, then sue collectors (google "fdcpa attorney") for violations described in sections 805, 806, and 807, per section 813 of the FDCPA.
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.
Read useful debt-collection FAQs from the FTC here http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm

Be aware that scammers are using bought/hacked/phished loan application data to extort payments for fictitious debts from victims and victims' families and friends.

Report to the Internet Crime Complaint Center http://www.ic3.gov/complaint/default.aspx , the Federal Communications Commission http://esupport.fcc.gov/complaints.htm , the Federal Trade Commission https://www.ftccomplaintassistant.gov/ and your state AG http://www.naag.org/current-attorneys-general.php as appropriate.

What victims? I've never collected debt in my life I work for a debt consolidation company and had a client having an issue at this purticular #. Which is not so special either but i'm just saying back in my day people paid what they borrowed. And now adays people seem to think they are entitled to things they have never earned. I also believe that there is a number of shady collectors in this world but look what these certain individuals have been reduced to saying to people just to get them to repay a lone. Anyone who disagrees with that is a low life who probably dosn't have a significant other because you drive a bycicle you stole or living under a bridge ducking your debt. people filing bankruptcy and using debt / credit counseling services have much more dignity than most people on here at least do things the right way. And this will be my last post and my last time on here so don't even bother replying.

I had a missed call from these  a** clowns today stating that they had sent out a package to my house and to my work address.  Also said that I needed to contact them with my correct info and address.....really?  How are you going to send a package to my home and work address if you need me to verify the address.  I actually spoke w/ someone at Williamson and Brown once and they said they had sent me numerous letters and emails on an old pay day loan.....WRONG.  I don't have an old payday loan AND have NEVER gotten any emails or letters from these people.

Hello All,

Williamson and Brown LLC, is a Collection Agencies, address is P.O. BOX 64 Hamburg, NY 14075 Office Phone (214) 628-0930. I'm not sure why they are calling my home for one of my relatatives.  I will be writting and calling them back to ask them to remove my number from there database.  I do not owe a debt so why would they be calling me for someone else.  When I called back with the case number that they had left on my home voice mail they put me on hold for about 5mins then they transferred me to someone that could not find no record of the case number.  I will be reporting this company to the BBB, Better Business Bureau.  I feel that if they are trying to collect a debt they need to at least call the correct person whom they are trying to collect the debt from.

This is yet another scam claiming that you owe an outstanding Pay Day Loan.  They are not valid and they are not legal.  The FBI is aware of this as well.  If you go to the FBI website, there is a whole write up on it and you can file an online complaint against these fools.  I just did and I recommend you do too so they can be investigated and prosecuted. We have not fallen for their tricks, but I am sure that is some poor person out there who they have scared half to death into paying something that they do not owe.  Report them!!!
