I received a call from Housing Retention Group, a man named Grant, ext 1390 with a very promising line that they can help us with our mortgage payments, it really sounded to good to be true!  Well he requested all this information from us and then it would go to an underwriter to see what organization we would qualify for.  I was told for a hardship case there are many companies willing to help.  Well the more I thought about this phone conversation out of Orange County California, really, I live in Pennsylvania?  I find it strange!  I called the # back that "Grant" gave and there is nothing even saying on the message of what company I was calling or anything.  It gives a message when you call the operator of this "so called" company that doesn't mention a name of the company, it directly puts you into the voice mail of "Grant" and does not give a last name or anything.  I find that odd!  I checked out the fax # and guess what, it doesn't exist!  I do not want any phone calls from this person any longer and would like to find out how I can report this bogus Housing Retention Group.  I am just lucky that I checked online before anything was faxed to these people.  What is my next step in reporting this person?

I never said "no fees". I said "no upfront fees". Can't you read?
The HRG can charge fees but only AFTER the mod is done.

The meaning of no upfront fee is stated on page 3 of  http://www.ftc.gov/opa/2011/02/pdf/110210mars_homeowners.pdf  that states:
"You don?t have to pay any money until the company delivers the results you want. It?s illegal for a company to charge you a penny until:
1 it?s given you a written offer for a loan modification or other relief from your lender; and
2 you accept the offer. The company also must give you a document from your lender showing the changes to your loan if you decide to accept your lender?s offer. And the company must clearly tell you the total fee it will charge you for its services."

Mr. Élan Booker's "I am with the Housing Retention Group, a direct correspondent of Bank of America and that he was a senior case manager assigned to follow up with me to assist us in our request for a loan modification or catching up our payments" as reported by Kaye on 15 Jan 2013 is hardly just filling out mortgage mod forms. The results that Kaye wants is "a loan modification" and not help with filling out mortgage mod forms.

All "a direct correspondent of Bank of America" means is they correspond with BofA. So what? Does it mean they simply send the documents they fill out to BofA? I'm a direct correspondent of several banks as well, whooptee doo!

Nobody said document preparation is a scam but it is a scam for non-attorneys to charge up front and for HRG to claim it works for the US Gov as reported by Krysta on 21 Dec 2012 above.

Comparing mortgage relief to tax preparation services is comparing apples to oranges. There is no law that forbids my tax preparer from charging me until after I get my tax refund but there *IS* a law called the MARS Rule that forbids non-attorneys from charging homeowners for debt relief services until after the mortgage mod is done (and preparing mortgage mod documents is a "debt relief service"). But it's not just document preparation, is it? Dean Rodriguez says on 3 Jan 2013 above "they said they would be working with the lender" which suggests something beyond simple, hands-off document preparation.

Attorneys have a narrow exemption from the MARS Rule  http://business.ftc.gov/documents/bus77-mortg ... es-rule-lawyers  but "Examples of activities that likely could cause attorneys to lose their exemption include:   ....   Engaging in a widespread telemarketing operation staffed by non-attorneys" would automatically subject HRG's attorneys to the MARS Rule and make them *INELIGIBLE* to charge up front. If non-attorneys telemarket attorney mortgage relief services, then these attorneys may *NOT* charge up front.

HRG's document preparation (attorney or non-attorney) is a scam if they charge up front for it.

Charging up front is not legal. But like anything they don't release documents unless you pay for them. That is common sense. If you were intelligent and read the goverment HUD ( Housing and Urban Devolpment ) website they  RECCOMEND that some people need or required legal services in Judicial states facing forclosure. Or they reccomend you have the paperwork prepared and submitted. HUD even does that too ! wake up people. Did you have a realtor when you bought the house ? get an appraisial ? do you really think banks will do this for free ? Lenders ARE NOT mandated to help you ! think people !  no upfront fee's means they can charge you but not before the work is started. No upfront cost does not mean there is NO cost ! it means you don't pay first ! geezzz.

Document preparation is not a scam morons ! Do you prepare your own taxes and submit them ? Or do you have them prepared by someone who knows taxes and then submit them ? That's document preparation. If you think that's a scam you need to go back to school !

I received several phone calls from the Housing Retention Group from 1-800-805-7780. My agents name is Élan Booker, ext 1567. I have tried to call him back only to get his voice mail. But I noticed when I called, their system does not state the name of the company AT ANY TIME DURING THE ENTIRE PHONE CALL!  Mr. Booker also told me, "I am with the Housing Retention Group, a direct correspondent of Bank of America and that he was a senior case manager assigned to follow up with me to assist us in our request for a loan modification or catching up our payments." I spoke with Fannie Mae. They told me to be very careful. No one can help you with a loan modification except your mortgage company (mine-Bank of America) or Fannie Mae directly. Mr. Booker has never mentioned fees but has set up a phone call with an "underwriter" who should be able to help us. After talking with Fannie Mae-I know I have been made a fool of. I will not take the call from the underwriter and work with Fannie Mae.

The MARS Rule  http://www.ftc.gov/opa/2011/02/pdf/110210mars_homeowners.pdf  says that companies offering mortgage relief services (such as an offer to lower your mortgage payment for a fee) may NOT charge the fee up front, and can only charge the fee after your mortgage modification is done (and this might take several months to achieve during which they may NOT charge you). Attorneys who meet certain criteria described in detail here  http://business.ftc.gov/documents/bus77-mortg ... es-rule-lawyers  are exempt from the MARS Rule and can charge you up front. One criterion is the attorney must be licensed to practise law in your state so call your state's attorney licensing board to find out. If s/he's not licensed, then the MARS Rule says s/he may NOT charge you up front even though s/he is a trained attorney (s/he can still do your mortgage mod, s/he just can't charge up front). If s/he's not licensed but still wants to charge you up front, then it's a SCAM for sure. Beware there have been scams where victims lost up-front money to attorney mortgage mod companies so you have to check the attorney out very carefully.

Both PAM and krysta above state they were asked to pay up front for a non-attorney mortgage mod and this is already ILLEGAL so I strongly advise you to stay away from the Housing Retention Group. Call your state bar (look in local phone book) for a FREE referral to a LOCAL attorney who does mortgage mods. You'll be charged up front but at least you can meet face to face with a legit local attorney who is licensed to practise law in your state and you can also check out his credentials with your state bar. Why risk hiring a SCAMMER?

THIS IS A SCAM.  The FTC's MARS Rule says on page 3 here  http://www.ftc.gov/opa/2011/02/pdf/110210mars_homeowners.pdf  that it is *ILLEGAL* for a company to charge up front for a mortgage mod.
Report to the Internet Crime Complaint Center http://www.ic3.gov/complaint/default.aspx , the Federal Trade Commission https://www.ftccomplaintassistant.gov/ and your state AG http://www.naag.org/current-attorneys-general.php as appropriate.

A domain proxy is simply a front company that the real owner can hide behind.

It is not illegal for a company to help you apply for a HAMP or any other mortgage modification but as of 01/31/2011, it *IS* illegal to charge up front.
The FTC's MARS Rule  http://www.ftc.gov/opa/2011/02/pdf/110210mars_homeowners.pdf  states on page 3 "You don?t have to pay any money until the company delivers the results you want."
Any company that wants you to pay money up front for a mortgage mod is a SCAM.
