Yes - bank accounts are being compromised.  Mine was !!!
They illegally withdrew $$$ from my brand new bank account (not even 2 wks old) - they got a hold of my debit card # - & took out $400. They made it look like it was a payment to Sprint .... I do not have Sprint as my carrier.
I  Immediately Went to my bank - filed a claim against them - got my $ back & a letter from my bank stating that the w/d was unauthorized So I want to know how in the hell they got info on a brand new account... My bank handled the matter & I hope they pursue them legally. These people have got to be stopped ---

Got a call from a woman calling herself Marciane. ... muffled her name so I am not sure but she made sure that when she gave the 800 call back # - it was clear ...
She called from a local #:  805-228-4591
They call from different phone #'s (they have at times called in using my companies # - how in the hell are they able to do that ... they call my work & my cell ... but I never answer. I block all their #'s on my cell & my work VoiceMail does not state my name so they are not sure it is my ext however it does not stop them from calling.

Whether someone owes a debt or not ... these people are rude/nasty/think they are God!!!
If there is a debt owed - the company that made the loan has long ago  charged it off & has claimed on their tax filings for that year. (I am not saying that all cases of not repaying a debt is excusable - but there are times when it is especially when its dealing with a debt collector - they are scavengers).
The collection companies are vultures - they buy a list of OLD debts or buy a list of information & create a debt that is not owed - jack up the balance & then harrass/threaten people to pay.
Often times threatening them with being arrested. They feel they are above the law & can do what ever they please.
It takes time but I report any one of these that I have had to deal with over the past few years.

I personally had a collection company try to collect on a debt I did not owe. Somehow they got a hold of my account info & withdrew funds without my knowledge or consent. I went to my bank & they researched it - discovered it was unauthorized & credited my account. The company that the debt collector claimed to be collecting for, issued me a letter stating that I did not owe the debt.  Recd letter from collection company stating the account is now closed. But now I have to deal with my credit report - fortunately I have the letters to submit to the credit reporting institutions - but still I have to use my valuable time to clear up their mess they created for us!!! Fraud on someone these days is all too common & something needs to be done about it ... So many innocent victims get caught up in this .... Our personal information is no longer secure ... how did that collection company get my bank info on an account that was only open 2 wks ????
Constantly vigilante....

They are still at it, in Florida letters are circulating from Wooten, Benson and Tate.  this is a complete scam, bogus and the aim is to scare you into sending money you do not owe.  What's worse is some people's bank accounts are being COMPROMISED.

I just found out about this today.  I'm going to nail these f'ers.

Ra,
I would check with the outfit named that you supposedly got a loan if you actually got papers itself! The scammers are stooping to some pretty low level stuff and I wouldn't put it past them to send phoney papers out . However, being served with papers, those do not come in the mail, only a server can serve papers. But you never heard of this company and it is the law that they provide you in writing who it is and when this s happened If you got anything in the mail, it should have been legal paper work showing who the loan was originally from/with and all the legal information required by law! So.. Your either trying to play the shill, or just plain messed up on what is what here. Collection agency's do not go to a attorney, they file in court, in which case the papers served would come by a server process. It would have a court date on it..

Please do file reports with the FBI, your state attorney general and Department Of Justice,FTC & FCC..

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."
****************************************
A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I have gotten many calls. They always asked for me to call them back. Never saying who they were. I dont answer numbers I don't know.
Fast forward a couple weeks ago and I get served papers. I never heard of the company before.
I tried calling them to work sonething out and Kevin Emmrich told me he could not because it already went to his attorney.
Kevin did tell me he has been calling me and sent me letters. I have never gotten a letter from the company.
I did ask for a paper proving that he got my loan from someone. He told me I had to ask his attorney for the paperwork.
From what I have ewad his attorneys are just as bad as NCA.

I just now find this interesting. I have already made a couple of payments through NCA for a payday loan. Like an idiot, I just now read very slowly what the letter said. It said that NCA has purchased this payday loan account and has a financial investmentin it. Wow. So I've made a few payments thinking it was paying off my original payday loan. Should I be making any more payments to NCA???

I decided to call this number when one of my co-workers handed me a message that they had called. Well, I had googled it and had all of these posts before I actually called so I called from a blocked number in my office. The person left the name of "Jessica" with the extension of 1273, (just in case any of you would like to call her and help brighten her day) and when she answered, she immediately asked who I was. I responded with, well, you called me, what company are you with. She said she couldn't tell me unless I gave her my information. You can see where this is going.... I told her I couldn't unless she told me the company she was with. At this point she said, "well you can have a nice day then" in a rather rude voice, and hung up.

There are several things entertaining thing about this. I have the information you all have provided, thank you by the way, and I have no outstanding debts, and the number that they have called is my work number. It was answered, by one of my employees, as I stated earlier, and well, if I didn't mention it, I am a command officer in a metropolitan police department in one of the 10 largest cities in the U.S. I am actually hoping that they call back and threaten to have me arrested for not paying a bogus debt!!!!!

I will keep you posted!!!!!!

Received phone call from this company @ 6:14pm on 2/12/09.  I answered it only because I knew whoever it was, it was illegal for them to "spoof" their caller ID information.  They asked for my husband who was not home, and then asked if I was related to him.  Michelle Fortum (sp?) left the number 800-835-9313 x233 to call her back, she said they were located in Wichita, Kansas.  She informed me she was calling in reference to a Quick911cash.com about a payday loan.

Our bank account was comprised in December of 2007, and this company went haywire running charges daily through my husband's bank account causing hundreds of dollars in bank fees to accumulate.  It was such a mess that he finally ended up closing that account & converting to a cash only basis.  When I explained this to her, she said yeah those companies do that.  I advised her that I lived in Texas and she started laughing and said you're safe then because we can't collect from you.

FYI: If you live in Texas, the only thing employers can garnish from your wages is child support.  The federal govt. can garnish for income tax and student loans, but individual companies cannot garnish for unpaid bills.

Since they broke laws by spoofing their caller ID information, I have reported them to the DNC list and my state Attorney General's office along with the FTC.

Attorney General Darrell McGraw took the extraordinary step today of warning the public about a band of scam artists making threats to consumers who allegedly obtained Internet payday loans in West Virginia and across the nation. The consumers they threaten never obtained a loan at all or paid it off years ago.

Internet payday loans are short-term loans or cash advances, usually for 14 days, made over the Internet via interactive web sites and secured by an agreement authorizing debits of the loan and all fees owed from the consumer?s checking account. These loans typically charge interest rates ranging from 600-800 APR and are unlawful in West Virginia.

The scam artists, who speak English with a foreign accent, call themselves ?U.S. National Bank,? ?Federal Investigation Bureau,? ?United Legal Processing? and numerous other phony names. They refuse to disclose real names and addresses and are believed to be operating ?off the grid? from homes, automobiles, or from off shore locations or foreign countries, including India. Since the scammers have kept themselves purposely well hidden, thus far no law enforcement agencies have succeeded in locating or shutting them down.

The scammers typically pose as law enforcement officers, investigators, lawyers, and bankers and threaten consumers that they will be arrested for ?bank fraud? or other fictitious crimes unless money is wired immediately. They simultaneously scare and confuse consumers by using meaningless legalese gobbledygook phrases such as, ?We are downloading warrants against you? or ?We are filing an affidavit against you.? Consumers who don?t immediately fall for the scam are warned, ?Only God can help you now.?

The scammers almost always call consumers at work several times a day, and tell their supervisors, ?Your employee has committed fraud and is about to be arrested.? Such threats have proven unsettling even to the most savvy consumers and employers who suspect the calls are fraudulent.

Attorney General McGraw stated, ?Ordinarily my office protects consumers from fraudulent activities by seeking injunctions in court. But legal action cannot be taken until the scam artists can be located. Even then, it is unlikely that the persons behind the fraudulent calls and extortionist threats would obey a court order. In this case, the consumer?s best defense is to be armed with the knowledge of the scam so that all demands for money can be resisted, despite the false but scarey threats of arrest.?

McGraw added, ?Because the fraudsters make a special point of calling consumers repeatedly at work, employers must understand that the consumers are innocent victims of a criminal enterprise and cannot stop the calls from coming. I also wish to assure the citizens of West Virginia that my office will continue to do everything possible to locate and shut down the outlaw debt collectors.?

More information about this fraudulent debt collection scheme is available at the Attorney General?s website, www.wvago.gov/internetloanscam. Any consumers who have been threatened by these persons or wish to file a complaint about another consumer matter may do so by calling the Consumer Protection Hot Line, 1-800-368-8808, or by obtaining a complaint form from the Attorney General?s web site.

It's a debt collection scam. And all their threats are false and illegal.
This is a very active group of scammers, many of whom are calling from India (and probably other countries) and are in cahoots with a group of American pay day loan scammers. They attempt to extort money from consumers with a myriad of false and illegal threats, and alternately pose as debt collectors, federal and state law enforcement officers, lawyers and bankers. Their trademark is to use meaningless legalese gobblygook phrases like "We are downloading warrants against you" or "We are filing an affidavit against you." Another trademark phrase is to threaten the consumer with something like this ridiculous phrase: "If you don't pay then only God can help you."
Typical of many financial scams of this variety, they usually demand payment via Western Union or MoneyGram or credit card. They use any number of phony names such as US National Bank, Federal Investigation Bureau, US Legal Investigation Bureau, Hopkins Law Office, United Legal Processing, Morgan Associates, United Pay Services, National Processing, White Collar Crime Unit and many more.  These criminals also use many phone numbers from many area codes; they're probably using caller-id spoofing software and/or VoIP to disguise their real location.
The main thing to remember is that anytime someone calls you demanding money to prevent your arrest, or demanding your lawyer's name so they can sue you, it is ALWAYS a scam. No debt collector (let alone criminals posing as debt collectors) has the authority to have anyone arrested for anything. (And it's illegal to them to threaten such a thing.) And since these foreign dirtbags routinely impersonate law enforcement, it's also important to remember that American law enforcement officers aren't in the business of debt collection.  (Debt is a civil, not a criminal, matter.)
The bottom line is, these are criminals trying to steal your money.
A consumer posting a complaint about these same scammers at http://800notes.com/Phone.aspx/1-718-831-7157 notes that 718-831-7157 is associated with an India-based "outsourcing" telephone bank.  Though a reverse search on WhitePages.com shows that 718-831-7157 is an unlisted land line in New York City, information on Debtbuyers.Com shows that that number is used by India-based Intellisourze. (Source: http://www.debtbuyers.com/debtbuyers.asp ) My guess is that it's a VoIP phone number.
This is another piece of the puzzle that fits in perfectly with other information about this scam. There are some reports on 800Notes that have suggested that the crooks behind this offshore scam are also the crooks behind the notorious Bass/Ellis Crosby & Assoc./States Predisposition scams in Florida and Georgia. The interesting thing is that the number of complaints on here about the US National Bank/US Legal Investigation/Federal Investigation scam skyrocketed *after* April 7, 2008 when Florida obtained a $1.3 million judgment against Ted Ellis Crosby, shutdown his operations and barred him from ever conducting debt collections in Florida (Read http://myfloridalegal.com/newsrel.nsf/newsrel ... 5257424005858A6 ) There's certainly a good chance that the crooks placing these calls from India are doing so on behalf of the American crooks behind the Crosby/Bass/States Predisposition scams.

Though scam calls from these crooks have been going on long before May 8, the frequency of complaints about these calls increased considerably after Crosby was shut down in early April.
This is conjecture, but appearances suggest that Crosby and company were originally running a two-pronged payday loan scam operation -- with some calls being made from Jacksonville, Florida and other calls being made from a phone bank in India (and possibly other countries); then, after the Florida Attorney General shut down the Crosby scams in Florida, the Crosby crooks transferred most of their scam efforts to the India phone bank.

If you are targeted by these criminals, be sure to report them to all the following federal and state law enforcement agencies (most of which you can do online or over the phone):
1.    The U.S. Secret Service is responsible for protecting the country's financial infrastructure and payment systems from international and domestic threats. Call or write your local Secret Service field office to alert them to the details of this attempted extortion. The addresses and phone numbers for the local Secret Service field offices are listed at http://www.secretservice.gov/field_offices.shtml or in your phone book.
2.    Alert the FBI at https://tips.fbi.gov Be sure to tell the FBI that you are being targeted by extortionists over the phone. And if the crooks claim to be law enforcement or lawyers, officers of the court or bankers, be sure to include that information in your report.
3.    File a complaint with your local police. Most police departments will take a report over the phone.  Be sure to tell them that you're being targeted by an extortionist and give them all the details.
4.    File a complaint your state's attorney general, the contact information for whom is at www.wvago.gov
5.    File a complaint online with The Federal Trade Commission at https://www.ftccomplaintassistant.gov/FTC_Wizard.aspx?Lang=en
If these crooks call back, promise them nothing, pay them nothing and tell them nothing other than that you know they're a scam and that you've reported them to law enforcement. (And be sure to report them to all the agencies above each time they call you.)

By the way, here's just a small sample of numbers used by this particular group of scammers. Read the reports and you'll see the same pattern time and again -- phony organization names, thick foreign accents, and oddly worded threats that are so melodramatic and ridiculous that it's laughable:

Scam alert: Bogus debt collectors
By Leslie McFadden ? Bankrate.com
Monday, Aug. 3
Posted 2 p.m.
Bankrate reporter Leslie McFadden contributed this entry.
This scam isn't technically about credit cards, but it is scary enough to post a warning. The Better Business Bureau issued an alert today saying consumers across the country are getting phone calls from bogus debt collectors claiming default on a payday loan. Of course, the consumer needs to pay a large fee to avoid arrest -- as much as $1,000.
The caller poses as a lawyer, and may threaten extradition to face trial if the consumer doesn't pay up immediately.
What makes these calls alarming -- and perhaps convincing -- is that the perpetrators reference the consumer's personal information, such as the person's Social Security number, driver's license number, previous bank account numbers, home address -- even personal references.
"The amount of information they have is really troubling," says BBB spokeswoman Alison Southwick. She adds that the amount of data points to a possible security breach.
Spread the word to your friends and family: Don't give out personal or financial information to an unknown caller. Scammers can spoof Caller ID to display different numbers, so trust your instincts over technology.
The BBB offers these tips:
?    Ask the debt collector to provide official documentation which substantiates the debt.
?    Do not provide or confirm any bank account, credit card or other personal information over the phone until you have confirmed the legitimacy of the call.
?    File a complaint with the Federal Trade Commission online if the caller is abusive, uses threats or otherwise violates federal telemarketing laws or the Fair Debt Collection Practices Act.

Received a phone call from a Steve Barber at my place of employment which is a school.  I asked for his phone number and he refused to give it to me unless I made a payment arrangement with him.  I refused and told him I could talk.  He finally gave it to me and said he would wait for me to call him during my break.  He also refused to give me his fax number. He was very insistant but I just hung up on him..

THIS NUMBER CALLED AND THREATENED ME THAT IF I DIDN'T MAKE PAYMENT WITHIN 7-10 BUSINESS DAYS THAT THEY WERE GOING TO SUE ME. I LAUGHED AT HER AND SAID, "GOOD LUCK SQUEEZING BLOOD FROM A TURNIP!" SHE GOT MAD AND STARTED THREATENING ME AGAIN. I LAUGHED AND TOLD HER TO GO FOR IT AND STOP CALLING ME. OF COURSE, SHE CALLED AGAIN THE NEXT DAY BUT I DIDN'T ANSWER. THANKS FOR ALL YOUR INFO ON HOW TO STOP THEM FROM HARRASSING ME.

Debt Collector
I was out of the office when Charlie at extension 800/835-9313 called and left his number.  I googled the number and it's National Credit Adjusters again, harassing me at work.  I'm keeping a written record by time and date of when this company calls me.  They also use 800/542-1048 and there's an extremely rude woman who called 3 times within 5 minutes (she was so rude I hung up on her) and demanded to talk to my manager.  He isn't impressed with them either, so my job's not in danger but he may also file a complaint with the FCC, the Kansas and Iowa attorney general, and contact an attorney, as I intend to do.  If you can, people, try to record any calls you get from them.  Here's how to tell this is a scam.  One caller will say you owe a certain amount.  The next caller will give a different amount, maybe higher, maybe lower, and the third one's ammount will be different from the first two.

Debt Collector
I was totally harrassed and disrespected by an employee and his supervisor Jeff Kinney about a bill that was not mine.  They somehow got my work # and totally harrased and threatened me. asked to speak with my manager, my payroll department. they threatened they would continue to call my office # and that it was legal for them to do so. They would not listen to my dispute and reality that it wasn't my account. I asked for something in writing and they refused.

Bud Says                         Consumer Comments Below

What would you think when you return a call to: 800-835-9313 and the idiots at the other end in (Hutchinson, KS) will not identify themselves, yet threaten you with legal actions when you don't even know who they are?

This one is National Credit Adjusters.

DON'T waste your time calling them back, they aren't worth it. Agency owner Mark L. Huston must REALLY be embarrassed by his workers, otherwise why would they refuse to give even the most trivial of information?

Show Mark Huston and all of the trash working for him that we consumers are NOT into playing games with his sleazy debt collectors. Fax him the FREE cease-comm letter so he can NEVER contact you again. His fax number is: 620-664-5947

Mark Huston is a scavenger debt buyer, which makes him a gambler He is betting that he can buy old debts for pennies, then harass you into paying him dollars.

CAUTION: I recommend you NEVER disclose your bank account or credit card information to a debt collector, as you risk them emptying your account, or maxing out your credit card. If you feel they are reporting on your credit bureau files in error or need assistance in dealing with them, email  the details w/your location.  Assistance and referral to a consumer legal specialist may be available.

DON'T ADMIT YOU ARE THE PERSON OR ANYTHING TO THESE CLOWNS! THEY ARE JERKS AND BUY OLD ACCOUNTS AND RE-AGED THEM!! HANG UP!SEND THEM A CEASE AND DESIST LETTER
