You people are seriously mis-interpreting the Fair Debt Collection Practices Act is for THIRD PARTY COLLECTION AGENCIES ONLY!!  The Act does not apply to original creditors like the bank or mortgage company.

Know your facts before you start preaching!

In spite of being informed they can't contact us directly and must contact a lawyer Wells Fargo, which absorbed WF Home Mortgage, continues to call and harass us.

If you are in a similar situation write down the harassers name the time and number they called from and pass it on to your lawyer. They are FDCA abusers and need to get in trouble over this.

You would think Wells Fargo would read the Fair Debt Act (not sure of the exact wording of it).  They would know it is illegal for them to call and hang up!  Also they call like 10 to 15 times a day which is also illegal!  We need to get a class action suit against them for violating the Fair Debt Act!  Then they might get the money owed to them!  I understand that need they  to call and get there money that is owed to them, but do it the legal way!  And STOP harassing people!   STOP calling 10 to 15 times a day and then hang up!  Also leave a message stating the person name, company calling , and a # to call back.  Not this is mrs. xxx call me at 1-800 before 9pm!  I have no idea who the heck you are or who you work for so why should I call you back for all I know its a scam!

Me too.  I have been paying on my home loan for nearly 27 years, and owe almost nothing.  Wells Fargo has begun to call me at work and at home before my loan is due to remind me to pay it.  They have also asked me questions of a personal nature.  If I don't pay the loan by the 15th, I get called at home and at work every day, and no matter what I tell them, my file is never noted, and I have to go to through the same conversation over and over again with whomever calls me.  This has to be an unlawful debt collection practice.

One of their reps explained to me that the payment is due on the 1st, the "grace period" is only for the late payment charge not the actual loan payment.  They will begin calling on the 2nd/3rd of the month and will call every number they have listed on file up to 6 times a day, so if they have multiple numbers on your file EACH number will be called up to the 6 times a day, even on holidays/weekends.  They are told not to leave voice messages since peoples answering machines are not secure and they don't know who may have access to the information. AND they are told not to accept no for a answer when asking for payment over the phone and yes are rude and dare you request a supervisor you will get someone who is ruder than the rep that began the phone call....THEY DO NOT CARE!!!!

WellsFargo, lOl. Just another big bank reaping the rewards of far too restrictions on financial institutions by your local republicans. And watch were going to elect some more, and they've already promised "less regulation". Well I'm not here to point out the stupidity of the people, just to offer some advice about these calls. There are so many options available today to avoid this, and the one I would suggest using immediately is going to your local retailer and purchasing a magic jack. Magic jack is a device that connects to your computer to allow you to make calls, IT SUCKS! But, it has a very understated benefit. Once you setup your m.j. you get a local phone number that has free voice mail. You never have to plug this device in again, and I wouldn't bother, since there calls are so-so, and you need highspeed internet to use it as a phone.... But NOT as a voice mail box. When you make calls to bill collectors use this device or a public phone, and when your asked for your home phone number only give this m.j. number. If you like they'll email you your voicemails in the format of a .wav file.... And the best part, it's only $20/Year! So for less than two dollars a month, you get a local home phone number with voice mail. (JAlli) you don't have to hit the mute button! (Ricky) You don't want to be a shareholder, even to voice your opinion! The other half of what I'd suggest, use a pre-paid phone service like Virgin Mobile, $25/Month with 300 min and unlimited text messaging and internet, they let you setup your phone by web... (1) Goto Kmart or where ever and by a Virgin Mobile prepaid phone marked "Beyond Talk Plans" (2) Create an alias with hotmail, yahoo, whoever... (3) Register your phone by website with your alias information. Note they will know your real identity by your payment method, but will not list your name anywhere with the number because they have to hold your financial records secret... Or at least there suppose to, so option B would be to use pre-paid "top up" cards that can also be purchased by cash along with the phone. With option B, you never give out your real name, which prevents bill collectors from calling you, or at least would make it very difficult.... But one more thing to consider, if you ever call one of these bill collectors by accident (opps forgot and made a payment with my cell) they will know your number, and will call you like before, and as an added bonus, these collectors share contact information. So if one collector has established a way to bug you, you should quit paying on phone and get another! or start ignoring them again Arrrrrrrrrrgggg! Good luck =)

If I were a share holder of Wells Fargo I would be pissed When we got our mortgage with them we specificly asked on our application, once again before doc's were drawn, and at closing for our due date to be the 15th of each month as it was with the original company. At closing we when the due date was the 1st we were not going to sign but we were told that we would loose our lock rate and it did not matter because there was a 15 day grace period before anything would happen. Our payment has been made on the 13th of every month for over 4 years. They start calling me on the second of each month, every month since the mortgage began. If they want to waste their resources to have someone call me 16-18 times each month, it's their loss not mine.

I DO NOT have a Wells Fargo Mortgage; recently cancelled a Wells Fargo credit card with a zero balance for 3+ years because they began charging me an 'annual fee'. (Why pay for something I wasn't using and I didn't need the credit from them anyway.) Now we are getting harassing telephone calls about "our home mortgage loan." When I tried calling the number back, it asks for my loan # or SSN. I refuse to give either. I know that when I called in to cancel the credit card, the operator requested to info from me to 'update my records,' to which I replied, "What does it matter? I'm cancelling my credit card. You don't need to 'update my records'." Now getting the harassing phone calls! I just want to talk to a 'human' and get the harassing phone calls stopped!!!!!!!

These jerks, I send in the form to ask them to stop calling me on ANY of my accounts.  They immediately CANCEL my credit card and say the sole reason for doing so is for requesting to not be called!
The WORST part is that they STILL call!  So they hurt my credit, cancel my credit account, we fight over it, and then they start calling again.  I am scared to ask the calls to stop again since they took "revenge" last time!  They told me also that if I set up auto payments any date before the 15th they would not call..that was a lie too.

This is a Wells Fargo number. When I receive a call from an 800 or no ID, I hit the mute button as soon as I pick up the receiver and stay on the line until they hang up. It's evem stopped some of the 800 callers.  I also have my mortgage with Wells Fargo. I never mail my payment in, always pay at the branch across the street. I paid on the 5th and received the call today, the 6th, of course I answered then muted. We need to realize that payment is due on the 1st ane late on the 2nd but late fees are not assessed until the 15th. If you read your contract it states payment is due on the 1st.  No I don't work for Wells Fargo but understand they are a business just like any other, protecting their investment. If you keep up with the job status around the country, those of us that are able to pay our mortgage and not have a forclosure are pretty fortunate.

Watch out on requests for no more calls. I did this on my mortgage and my credit card through Wells Fargo. They still call on the mortgage, but cancelled my actively used credit card without warning.  I asked why they closed the account and they replied, well, you requested no more calls.  Like that is a reason to close my account that I pay all my bills with and not tell me!  It even has a balance.  Now think what that does to my credit.

DON'T USE WELLS FARGO!  GET OUT IF YOU CAN.  They are vindictive and just wrong.

Wells Fargo is calling me and I don't have an account with them!  They are confusing me with a person one street over on EAST ___ (same house number) who's last name rhymes with mine!  The man does not have a listed phone number and rents the house.

Thanks go to those people who explained that I can request a form saying not to contact me by phone.  There is a note in the account saying not to call me, but it hasn't helped.  This has been going on for two years!

Yes, the call came in on June 2nd.

I think if you read the Fair Debt Collection Practices Act ( google it and read it) they can only call you 3 times a week. Also you can tell them you do not want any more phone calls and ask them to mail you the form for that. then after you send it back they can no longer contact you by phone anymore. This is what I finally had to do. At the begining of our loan we set up an automatic payment to come out of our checking account on the 10th of the month and I still got calls wanting to know when the dang payment would be made.

They called my residence once today.  They did not leave a message.  They started calling today, even though my payment is not due until today.  Also, they do not like when you use online banking, which is the way that I have been sending my payments for the past year.

It is Wells Fargo Home Mortgage.  I've had a mortgage with them for years, and my payment is always due the 1st thru the 15th. They have never called me before when making a payment during these dates.  However, now they start calling nonstop on the morning of the 2nd of the month and do not stop until they receive payment.  I have never been late on a payment.  It's borderline harrassment.
