You should check out the company that is calling you at http://www.budhibbs.com/ - they are bottom feeders, running from the law at every turn.  They break every federal law in the book and don't give a crap!  They just keep doing it b/c they make more money from innocent victims and can pay outrageous attorney fees and still come out ahead.  Don't talk to them, don't trust a word they say, and most importantly - report them to the FCC immediately!!  They call neighbors, friends, employers, anyone and anyway they can find to harass someone that they just THINK may be the subject of their cheaply bought debt.  Don't entertain a conversation with these people.  They will make your life miserable if allowed the opportunity to do so.

If you do not recognize the caller then simply do not answer.  That goes for Unknown, Toll Free Call, unavailable, or names you do not know.  Don't bother explaining debt, belonged to your deceased love one, or your ex, etc. Or even that they are calling the wrong number, which is my case because they are looking for someone we do not know.  At first I answered a few calls, but when they were all for the same unknown person, we decided not to answer anymore.

And these scumbags also get names from the obituary pages of newspapers or online and start calling family members demanding payment for debts that do not excist.  YES DEBTS THAT DO NOT EXCIST.
THUS COMMITTING SERIOUS CRIMES. They prey on bereaved family members at the worst time and harrass them into paying BOGUS debts.  DO NOT FALL FOR THESE SCAMS.  REPORTS THESE AND OTHER THIEVES TO THE AUTHORITIES IF YOU'VE BEEN A VICTIM.

VERY RUDE!
Ask me about settling my dads business debt simply because I manage his store.
She got very rude in tone  and said I could settle his business debt because I was the manager. I asked her could I settle Ralph Laurens debt since I used to manage one of his stores to.
She got very loud and threatening.

They have been calling me like crazy at my home, my extended family, and have been calling my work nonstop. I have told them to stop calling and to communicate by mail instead. I have yet to receive anything in writing from them and don't even know what debt they are trying to collect. It's either one of two of my old business credit card accounts. I have closed the business and had to get a job elsewhere. I told them if they didn't stop calling me at work that I would get fired and then how would I pay? I would like to pay, but can barely make my house payment right now. They didn't care, they keep calling anyway. They said because it was a business account that they have a right to call me at my work and the FDCPA does not protect me. Is that correct? The business they keep calling me at is not my own and they will get me fired if they keep it up. Today when they called the third time, I did not tell them it was me, just asked if I could take a message. She said her name was Carrie Nembhard 800-889-3023 ext 4313 Case # 14713XXX, that "my name" urgently needed to call them back about a "commercial debt that I owed them." They are not allowed to give out this information are they? Is there anything I can do to protect myself?

These Ediacaran bottom-feeders are the scum of the earth. They are low-life scabs who can't get REAL jobs anywhere else. Look, folks, I think we can all agree that if they had any brains, they wouldn't be doing THIS for a living, right?  :-)

It won't resolve the debt, but will give you (and your family) some peace and quiet, until you and attorney get this matter resolved. I would also copy in the name of your attorney at the bottom of the letter.

If it is out of the statute of limitations for your state, they technically can't as they would risk doing something illegal and getting caught. Doesn't mean they won't try though which would net you about $1000 potentially.

The estate must settle any debts if able to do so. If it can't then they lose. DO NOT let them switch anything to make you personally responsible as you are not as of now unless your name was on the card also.

Even if your father was in debt, that is settled by his estate and can not be sought after from the next of kin. If the estate can not settle the debts, they lose.

extortion
n. obtaining money or property by threat to a victim's property or loved ones, intimidation, or false claim of a right (such as pretending to be an IRS agent). It is a felony in all states, except that a direct threat to harm the victim is usually treated as the crime of robbery. Blackmail is a form of extortion in which the threat is to expose embarrassing, damaging information to family, friends or the public.  See also: blackmail robbery theft.

CEO Matthew Phillips is a loser for allowing his goons to grease their pockets with so many FDCPA violations. This (non-law firm) collection agency appears to be a cesspool of misfits and lawbreakers that prey on consumers with their lawlessness. NEVER give them any information on your bank/credit accounts, or post-dated checks. YOU WILL REGRET IT!!

They called here today for my husband, called them back with the bankruptcy number; but I also keep a list of callers.  Also, I always file a complaint with the ftc and attorney generals office.  Most of these scam debt collectors don't stop after a cease and desist letter, but you'd think they would get the hint...  If enough of us file complaints with the ftc, they'll eventually get fined and stop harasing us and start harassing others.  I'm sure they're lists are only getting bigger with the economy.

An unintelligeable caller who can not enunciate the name of the company called and left a message that insisted we return the call to settle an urgent matter.  I'm not calling someone who can't pronounce my name or the company's name for any reason.  I'm tired of avoiding the phone due to this harrasment.  Unknown name and unknown caller can stay unknown.

My father passed away Jul 15, 2008.

I closed his CHASE VISA account on 7/31/08, gave all my contact information to Chase and asked for the bill to be sent here, to me.

Today I received a call from these folks -- Phillips and Cohen.  The caller had called my mother, who has been divorced from my father for 25 years and is living in another state, trying to find the executor of his estate.  My mother gave her my phone number.

After being told that it would probably be two weeks before any money would be coming their way, the caller tried to collect a (slightly) reduced amount right there on the phone.  She was nice enough, but I had to decide RIGHT NOW whether to accept this "offer to settle OUT OF COURT."  Of course, I said I couldn't decide right then and there; bills were still coming in.

She said maybe she could get me an extension and I could call later that day with a yes or no answer.  I gave her my fax number so she could fax me the "settlement" agreement (mostly because at this point, I wanted to have things in print for later investigation).

Then a "supervisor" got on the phone, trying to confirm my agreement to the settlement.  I said, "I am not agreeing to anything."  Then she said she was confirming the "extension" of the deadline of a decision to 9:00 p.m. Eastern time tonight.  Pffft.

So far, my fax line is silent but my home number has received two fax calls.  LOL.

This all seemed very suspicious to me.  After all, Chase Visa had my contact information!  And it's only been three weeks since I closed the account.

I looked the number and the name of the firm up on the internet and found tons of complaints about them.

I called Chase, and the woman with whom I spoke confirmed that they do turn over accounts of deceased persons to this "firm."  I informed her of the firm's poor reputation and how they made me feel on the phone and told her the story outlined above.  She was sympathetic and concerned and took my contact info so that Chase's "liason" to Phillips Cohen could call me back.

We'll see if I hear from the "liason."  I'm mostly angry because my father was a fine man, always paid his debts, had good credit and was in very good standing with Chase.  He had no relationship with these folks from Phillips Cohen and the implied threat of going to court was just... grrr.

My husband passed away a year and a half ago. I recently received a call from this agency trying to collect money from me for one of my husbands bills.  They offered me a reduced balance if I paid them right now, or it would goto court and be settled there.  Concerned I checked with the company that I had the real bill with, to find out that they never sent the account to collections at all.  Let's say they will get no money from me.
