I work for an attorney's office that specializes in Debt Harrassment and Consumer Rights against Debt Collectors. They ARE NOT allowed to call your cell phone. It is illegal. Let them know this! Also, I would not pay them unless they send a direct bill to you stating how much you owe! It is a law now that you cannot charge over 5.25% interest either. If they sue you for more than that much interest, it is illegal. They can threaten to take your home and cars and have you put in jail and everything else, but unless they have got a judgment against you in court already, then can do none of the above. Please search Google for a Consumer Advocate in your area. They can help you! You have more rights than these Debt Collector's do, and DON'T let them tell you otherwise. Most of these companies don't even have their contracts anymore, which also makes it illegal for them to sue you! Just make sure to look for a Consumer Advocate! They can help you!

Let me give you the low down.
6.5 years, then your bad credit is gone. It may still be "there", but you cannot be sued for it after that.
Average debt of one credit card sent to a debt collector = $2,500
Cost to file the State, get legal representation, travel, food, etc. just for them to get you in court is way MORE than $2,500. Its a numbers game. A gamble. Your not working, they know it, they wont sue you.
You are working, they dont want to invest $10k to get $2,500 back. Oh yeah, they will whine and say you gotta pay the legal costs. NOT SO, you just go in and say you tried to work out a payment plan and they said you had to pay it all, or that they wouldn't fax you the collection statements, etc. The judge decides, not the agency.
If your 2 years behind, just dont pay them, let them write it off, and sell to the highest bidder. In 3 years, the $2,500 owed, is actually being sold to another collector for like $90 and some change. Those are the aggressive ones, they want your money and want to scare you, but in reality, they cant get crap unless you get all scared and pay them. Then your credit still is set as a write off, and your credit score will NEVER improve because you paid that.
I felt bad I did this with $20k in cards, but after 6.5 years, and my credit is good again, and I see how greedy banks are, they still are making money off of you not paying, so now I dont feel like i ripped someone off, just ripped someone back.

Unscrupulous debt collector, although they will tell you that they are a law office.  They are known for their fraudulent actions against consumers, fraudulent threats, and harassment.  Occasionally send out mass mailings that appear to be court or legal documents, but are completely fraudulent.
There is a class action lawsuit against them in Pennsylvania.
If they harass you, keep a detailed record of ALL their calls and messages, then sue them and report them to the Federal Trade Commission where they already have quite a thick file.

These people are idiots. They keep calling me and saying that I owe a debt of $50,000 and if I don't pay, I'll be taken to court and jailed.

When I ask who I owe this debt to, they will not reveal this information to me and make up excuses as to why they cannot tell me. They always say they will put all the details in writing, but they never do because the truth of the matter is that there is no debt and they are harassing me for no legal reason.

They've called me at least 20 times over the past 3 weeks and still cannot understand that I owe nothing to no-one. Everytime they call, it's a different person asking for the same amount. They don't identify where they're calling from, who they are or where I owe the debt.

If they call again, I'll be reporting them to the DNC and the police for attempted fraud. I just wish they'd grow a brain and attempt their scams elsewhere.

These idiots call on a daily basis.  A pre-recorded message.  Some law firm!  Asking for someone that does not reside at my residence...and is unknown to me.  I have called them and requested to be removed from their calling list stating they have a wrong number...they promised twice to remove number from system...and still have not done so.  It's time to take action and have them fined!  I know they have major lawsuits already pending against them...add me to the list!

My caller advised me to either pay up or they were going to put a lien on my house which is my homestead in the state of texas. i was told that people would come and take pictures and appraisels, I told them if the stepped on my property that they were trespassing and would either get bit or shottake their pick never have heard from them again and no one has come to my house either.

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

I received a call today from (she identified herself as) Ms. Hill from Bronson & Migliaccio, an attorney's office.
I returned the call and she stated that I owed a debt.  I advised her that I have retained an attorney and that I have been advised not to give them any information over the phone that my attorney would be contacting them.  They called my place of business.  Ms. Hill became very rude calling me a liar stating I was just telling her I had an attorney, I advised her that I was doing what I was advised to do by my attorney.  She became argumentative to the point, I had to ask to speak to a supervisor.  At which time I advised him under the Fair Debt collection act they could not call my place of employment.  If you will google the fair debt collection act, it will explain your rights as a debtor.  It came in very handy today.  The supervisor applogized to me, saying he would handle my complaint against Ms. Hill and removed my work number from the data base.

These guys have been harrassing me for months. They keep asking for someone I've never heard of. I have called them at least 2 dozen times to ask them to stop calling me and to let them know there is no such person at my house. So far they have not stopped calling. Whenever I talk to them they deny they are a debt collection agency. They are rude, hang up the phone when I ask to speak to a supervisor, and tell me it's my problem and not theirs. Yesterday they called again, and I asked them to stop harrassing me. The guy on the phone actually had the gall to say I was harrassing them by complaining! He then went on to say that if I have a problem I should talk to the owner. When I asked if he could connect me or give me his number he hung up.

The number they keep calling is my after hours business line. I was on vacation for a week and came back to find that they had completely clogged my answering machine and I didn't get some very important business calls.

I filed a complaint with my state AG's office a while back, but never heard anything.

just so you all know i work at a law firm that does represent collection agencies. they have the right to contact a relative once. they also will sue depending on the laws of the state that you reside in. dont be mislead about people and the non law backgrounds if they are getting verbally abussive u have a claim otherwise be prepared to go to court. you do have the right to request validation of the debt but be prepared to pay the full amount. at that time any settlement talk is off the table.
