They have been calling me for MONTHS, i just filed a claim with the better business bureau. Hopefully they will stop harassing me !

When I dialed back, it was a bill collections agency.  I thought that I had paid an outstanding balance after moving out of an apartment, and he was calling on that account.  When I checked my bank records, I noticed that the check HAD been canceled, but NOT by the apartment complex.  Now I've got my bank investigating how my check was intercepted.
Fact is, collections agencies are exempt from do-not-call provisions on the basis that they are contracted for work by a company that you have an active business relationship with.

Nope, sorry. The burden lies with the CA and NOT the consumer:

809.  Validation of debts   [15 USC 1692g]

(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, A DEBT COLLECTOR shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing --

(1) the amount of the debt;

(2) the name of the creditor to whom the debt is owed;

(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and

(5) a statement that, upon the consumer's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor.

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

(c) The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer.

If they are trying to collect a debt that supposedly isn't real then it is up to you to prove it. If your name is on the contract and you know you signed it unfortunately you don't have much of a defense.

Here's a thought if they have the wrong number, tell them, if they have the right number than pay your bill or send a letter stating not to call you.  I can not believe you talk about them and then act the way yoy acted w/ foul language etc..no wonder you are getting calls from a collection agency.

Calling lists are for telecommnuications, if you're on a "DO NOT CALL LIST" & still getting called then there must be some reason....call them back & find out why you are receiving these calls. If you have a new number remember that phone numbers are recycled...someone had it before you!

If you got a call from a regular person dialing the wrong number, will you still say to yourself tht you're on the DO NOT CALL LIST?

They don't have to wait. THIS ISN'T CUSTOMER SERVICE. You must understand your account is dictated by the corporate office of the apt complex not HW. It gains interest daily and when you setup the payment plan you agreed to stick with it. There were no "breaks" in between that was agreed to. This is what the client accepted and now you defaulted.

Are you aware of how many people make the same request just like you? They have 100's of thousands of accounts. If they make an exceptuion for you they would have to do that for everyone else. Nothing would ever be collected for their client at that rate.

Look, I know alot of people here including myself might not be "fond" of collection agencies but there are some out there who you can't take lightly. Hunter Warfield deals with apartment and funeral home debt as well as commercial businesses. They are legally hired by the very same companies you did business with (I.E.: Apartment complexes you lived in, funeral home etc) and they DON'T buy the debt for pennies on the dollar like all of you might think.

They are hired to do what their clients tell them to do and that means resolving the debt their clients way NOT yours (ie.: mailing in $25 a month).  This is why majority of the time the apartment complex will send you back to Hunter Warfield to resolve the matter.

Word of advice: DON'T START OUT WITH AN ATTITUDE. MOST OF YOU DO BECAUSE YOU HATE BEING CALLED ABOUT A BILL YOU KNOW YOU LEGALLY OWE.

Alot of you complain about this company and make accusations of rudeness and other claims but the truth is 9 times out of 10 it's the consumer (debtor) who is the cause of the problems like rudeness, yelling, screaming or cursing. EVERYTHING is recorded and monitored there which the reps tell you upfront. It's called the "Mini Miranda". I guarantee you if I had the chance to listen to some of your calls it would reveal the truth that YOU are the cause for the problems of resolving the debt most of the time. Any rep who curses at you would be fired on the spot. When you leave an apartment many times people don't get receipts or the correct documents to make sure they don't owe anything upon vacating the apt. I didn't which made me mad at MYSELF not them.

This type of debt is NOT like a credit card where it gets sold off to different agencies. The burden of proof falls on the person that owes it and if not it is your legal responsiblity to prove it's not owed. Always check the contract or lease that YOU signed. The debt stays at Hunter Warfield until it gets paid either voluntarily by you or involuntarily (i.e.: lawsuit, judgement, garnishment etc). You won't be able to rent another place or buy anything with credit unless this property debt is resolved. Remember there are two sides to every story and all we are hearing is one side until now.

I have been inside the offices of HW to pay a bill and it's a classy place. You would never think it's a collection agency and believe me I have seen some hole in the wall collection places. I use to work for a couple of them. HW looks more like a law office.

My suggestion is to do your research, work out the issue with the company and move on. STOP whining because like I stated before most of the time it's the debtor (YOU) who makes the problem.

FOR THE RECORD: YOU ARE NOT A CUSTOMER. YOU OWE A DEBT.

Customer service is for companies like AT&T, Banks etc who offer products or services they want to sell you in which you are currently doing business with. This is a collection agency who collects a debt that has to be paid by YOU.

Hunter Warfield trying to collect debt from my 22 yo son deployed in Afghan,he set up payment arrangements with his debit card, per his bank they debited his acct same day as pay but too soon so it didn't clear, I calld them to give his checking acct instead to insure payment, told payment arrangement null/void since debit declined and he now owes orig amt w/interest,Tried to talk to manager, told I had 30 seconds to talk, then he hung up on me in 15 sec. These people are stupid & unreasonable. Don't they realize they cant get their bonus in their already small paycheck if they don't work with people who have matured enough to realize debts should be paid and try to do just that!!!

NOT TRUE..here we go again someone quoting a law they don't know.  If a collection agency is asked to stop calling a cell phone and don't it could be a violation.  If they call without the knowledge of whether it is a landline or cell that is not a violation.

They get your numbers off of an application that was filled out for an apartment, if they have the wrong number be smart and answer the call and let them know..it will be removed..
