I got a call also it was a recorded machine saying they were from fraud and something.  Saying I was under investigation and I should call to prevent legal action.  HA!  Anything legal is sent in writing and send certified mail.  This a scam for sure.

I was told by a Daniel Hamilton that my social security number was being sued because I didn't pay a cash advance debt.  He asked me if I received any letters stating that I owed money and I said I had not.  I told him it sounded like a scam to me and that I would have my lawyer involved.  He then gave me a reference number and told me to tell my attorney to use that ref. number.  My son called and Mr Hamilton said if my son sent $150.00 that day the matter would be settled.  My son just hung up on him.  I don't know where to take it from here since this was my first call from them.

The actions you describe are illegal and threatening them could land your caller in jail. That tells you they are crooks and frauds and you don't have anything to worry about.

(Unfortunately, they don't have anything to worry about either because they are probably far away overseas where U.S. law enforcement can't reach them.)

Its a scam! File a report with your State Attorney General, the internet crime division, they may want to have a copy of that email (which isn't valid legal proof of any debt btw) Phone,fax nor email are not legal valid proof of a debt by law.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

This people send me a email with my s.s number and date of birth I was freaking out and checked my bank account and saw that the loan they claim I owe them I didn't ever have deposited into my account. I don't know what to do in regards of them having my s.s number??

So, these b*****ds called my job.  Asked for me by name.  Of course I did not tell them I was "HER."  I got them to tell me who they were calling from.  I told them they had the wrong number and to not call this number again.  He was still talking when I hung up on him.  They left a voicemail message on my cell phone last week, two back to back.  I did not respond to it because whatever account they are calling on is super old.  And those accounts I am past due on, I am in close touch with the orignal creditors and have active payment arrangements.  So strange calls like this I don't respond to because I know they are breaking the rules when they say, "we are a law firm and will be forced to start legal action against you..." and do not state what the nature of the call is, the account in reference to, or the creditor.  Be aware of these types of calls.  If you have accounts that have reached their statutes of limitations (check with your state to see what types of accounts are covered).  If the statute of limitations has been reached on accounts DO NOT talk to anyone regarding payment arrangements otherwise the process is believed to be started all over again, which I learned is not necessarily the case.  You should arm yourself with as much information if possible if you find yourself being sued on an account that is over four years old.  

Be warned of those claiming to be debt collectors and/or lawyers contacting you on accounts that are delinquent.  These accounts are purchased and/or sold and tactics are used to scare you into paying them.  However, there are those who will contact you via correspondence and will indicate in their correspondence to you that they are simply attempting to collect on a debt and that you will not be sued and no legal action will come against you for such attempt, which to me is an indication that they know the account they are trying to collect on has reached its statutes of limitations.  

For California, here's what you should know.  Credit card lawsuits are based on breach of contract. The California Statute of Limitations for breach of contract is four (4) years: a party to a contract has four years after the contract is breached to file a lawsuit for damages. Past that, it?s too late.

For several credit cards, however, the statute of limitations is only THREE (3) years! Even better, Debt Buyers often miss the three year deadline and file in the fourth year, which is too late!

If this happens to you, and the account sued upon is a consumer credit card ? that is, not a business card ? they have violated the Fair Debt Collection Practices Act (FDCPA). That gives you the right to counter-sue them in state court, or to file an independent FDCPA lawsuit in federal court for damages, which include attorneys fees spent to defend the state court collection lawsuit. Afer all, you shouldn?t have to pay a lawyer to defend a lawsuit which shouldn?t have been brought in the first place.

If you?d like to know which cards carry three year SOLs, and why, sit in on this phone call with me:

Caller: Mr. Rose. I am being sued for the balance on a card I had with Chase. I know the statute of limitations in California is four years, so?..

Me: Excuse me. It?s three for Chase?

Caller: I thought it was four?

Me: Three. The card agreement used by Chase has a ?choice of law provision? which states that the agreement is govered by Delaware law. Chase is incorporated in Delaware.The Delaware SOL is 3 years.

Caller: Oh? Well here?s my question: The complaint was filed on April 15th. My last payment on the card was January 3rd, three years ago. This March, they talked me into making a good faith payment of $100 which I made on March 15th. Now I feel stupid, because I just found out that the payment starts the SOL all over again. So the lawsuit is timely. Right?

Me: Wrong. The lawsuit is too late. Here?s why: The statute of limitations begins to run from the date a contract is breached. If you stop making payments for a year, and then make another payment, the statute resets. The thinking here is that each payment is an acknowledgement that you owe the money and that you intend to pay. With each payment, the creditor is entitled to assume that you will continue making payments. Why should a creditor be required to sue ? and perhaps, end the payments ? while its expectation is that your payments will continue?

If, however, you stop making payments and three years passes before your next payment, the Statute of Limitations expired before your last payment. Once the statute expires, that?s it. It is not revived by a payment and a subsequent lawsuit will still be time-barred.

So, here, you made your last payment on January 3rd. If that payment satisfied your January due date, then you breached the agreement when you missed your February payment. Thus, the statute expires three years from your February due date, which means it expired prior to your March 15th payment this year. Since dead is dead, your payment did not revive the expired SOL, so the April lawsuit is filed too late.

Caller: Fantastic ! So I don?t have to Answer the Complaint because it?s too late. Right?

Me: Not so. You still must file a formal response to the Complaint. Here?s where it gets a little tricky: You must include in your Answer the specific pleading that Plaintiff ? the one who sued you ? Violated the Statute of Limitations.This is known as an ?affirmative defense?. You MUST plead this specific defense in your Answer OR your SOL defense is WAIVED, LOST! gone forever, ka-put. So Answer the Complaint and include SOL as an affirmative defense. And, if the credit card was for personal use, talk to a lawyer about filing an FDCPA lawsuit against the Plaintiff.

Caller: Thanks MR. Rose. You?re WONDERFUL!

Me: Aw?shucks!

Check with your state on the SOL, and check with the state where the account originated as well.  You'd be surprised at how many laws are broken to collect on SOL expired accounts.

I get a call every day from the above listed telephone number daily.  They harass me daily calling between 18 and 42 times a day.  They have threatened to slaughter me in front of my family.  I do not know how they even know that.  I am sick I am on disability I get 500.00 dollars a month.  My son has some autism, we do not receive any government assistance for him we have great health insurance. I am having surgery tomorrow, kidneys are not well diabeties. Severe diabetic neropathy and nerve damage.  I have a nother problem because of the 20 types of medication I take just to survive I do not appreciate this aggravatin.  I can not change my phone number too many doctors call me on this line. Any suggestions.  I had to close my bank account and right now one of these people opened a pay pal account in my name and now I am fighting them it was not me who opened that account.  I am so sick of them threatening me.  Thank you Kendra

Here are some things you can do to protect yourself:

1) Determine if the debt is actually yours
2) If the debt is yours, determine how old it is and check with your state's statutes of limitation and what it covers.
3) Do not discuss any payment plans with them because they will never go away.
4) Ask them to send you the debt in writing to verify who the original creditor is, the debt amount, account information, etc. If they beat around the bush, or just refuse to comply, end discussions with them and report them to your State Attorney General
5) Report them to your State Attorney General
6) If they are calling constantly, get their contact information and send them a certified letter asking them to stop
7) They are not allowed to threaten you with jail or harm against you or your family
8) Log the date and time, and who you spoke to each time they call.  Keep a running record until they stop calling, but do not throw it away, you never know when you may need to refer to it.
9) And if you make any payment arrangement with them (God I hope you don't/didn't), DO NOT do it through Western Union.  Be sure you have verified the original creditor first.  If they cannot provide this information to you, they are not who they say they are.

If they are saying they are lawyers and are not actually lawyers, they are breaking the law and as a consumer you have rights.  A lot of us have fallen on hard times.  It is by no fault of our own that we find ourselves in situations where we cannot pay our bills.  Sh*t happens!  What will happen is even on old accounts that have reached their statutes of limitations, collectors buy these accounts and use every scam tactic in the book to get you to pay them.  Protect yourself on all levels and know your rights.

I received a call from the same number twice, with the same threats.  I know I have paid the creditor they are speaking of, so I figure they are just some terrorists trying to get money.  I am so sick of this.  I get calls from what sounds like the same people with different numbers.  The last call came from someone saying they are an investigator in Fraud Division of Nationwide Check Processing.

got two calls from this number saying they are from US Department of Fraud and I will be held liable for 'serious issues" regarding a James Patton.  I had been getting text messages from this company for James Patton telling him his loan was ready.  what a bunch of b***s***.  I AM calling the US Dept of Fraud tomorrow morning and reporting them.  Suggest everyone else does as well.

I just received the same thing saying they are from US Legal Support based out of Tampa, FL. But with a little research you will see that yes the number is out of Tampa but the actual website has nothing to do with it. I have never ever taken out a loan from Cash Advance America in my life. This is 100% a SCAM. Do not give anything to them.

I got a call from Daniel Hamilton stating the same information as written above-that I had taken out a payday loan and owe money in lieu of $598.00 from a company called Cash Advance America. He said I would be subpoena for me if I don't make payment arrangements. They claimed the company Cash Advance America has tried to withdraw money from my back several times and the withdrawals were denied. I checked with my bank and they reassurd me no type of withdrawal has occurred. BEWARE THIS IS A SCAM!!!! Please report them!!!

I received 2 phone calls from this number, first time asking for a James Carter and second time for a Nathaniel Brown. The messages I received said it was from the US department of fraud and investigation and that serious allegations were being held against james and nathaniel and to return the call. I called back to be hung up on. So I called agan saying they had the wrong number. Then this guy calls me back and I politely tell him he has the wrong number, and he says f*** you and hangs up on me!!! This is some sort of scam and this guy is unbelievably rude and his English sucks. He needs to get up out our country and go back to where he came from!

Yes I got a call from this number stating that Daniel Hamilton is a lawyer from a law firm called US Legal Support in Tampa Florida threatening that I owe a payday loan and if I don't pay there will be a subpoena for me.  They say the company is Cash Advance America.  This is a scam and I need some advice.
