My work recieved a call saying I'm going to be served for bank account fraud.  My brother, ex-wife and
daughter also recieved calls from this person...she said her name was Stacey Murphy.  She got
my family all worried that I am gonna be arrested.  This is not right!

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Well "Bruce", if the callers from this number are legitimate, then yes. A notice of validation will have been sent. I seriously doubt that a single piece of mail has EVER been sent out by this (your) outfit. If a lawsuit was being pursued, then the bottom-feeders from this number wouldn't be calling. Nor would a "process server" be calling. A licensed & bonded process server, or a deputy sheriff, would simply be serving the summons.
Don't try to play here "Bruce". We know all the tricks being used by the fraudulent/bogus debt collectors. The regulars here know more about the debt collection industry than you EVER will. We devote a lot of our time to help our fellow human beings from being defrauded by the scum in the fraudulent debt collection racket. I particularly enjoy taking on the clowns employed by the JDBs. I know where they buy their paper, what they pay for it, what it's worth & the types that are employed to try to turn that invalid paper in to a profit. Would you like to debate the matter with me "Bruce"?

It is a valid debt then you should get a validation of debt but if one has been sent and they are taking legal actions then by law they have the right to file a lawsuit. Rather know than not.

Good for you! No debt validation, no debt. It's that simple. Here is what the FTC has to say about fake debt collectors who can't (or won't) validate debts:

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Recieved call from this number stating that they were issuing a summons for bank fraud for a payday loan. I asked for documentation to be sent to me and they refused. I gave no information to them.
