I got a call from them several times while I was at work. The third time I waited through the full automated message to get the call back number. They called themselves HW & Associates, said they needed to speak with "this person" (but never EVER mentioned who the person was) immediately to resolve the legal issue, if we were not that person he wanted to remove the name from their list and to call 855-209-3594

The first time I called it rang once, someone picked up the line and hung it right back up.
The second time I called it rang once and I was disconnected again.
The third time a woman answered (no name given, just "...hello?"), and I asked if this was HW & Associates. She said it wasn't, so I told her that I had now received a call three times with an automated message giving me THIS NUMBER, so someone's using their telephone number and I'm ready for the calls to stop.

She immediately called back and asked for my supervisor because I threatened her. I told her I didn't threaten her, I simply asked her to stop calling. She went on a tangent about how this was a law office and that it was being recorded. (Sidenote: I don't believe anyone can record telephone calls without informing the other party, except in the case of a judge authorizing any kind of phone tap, but I really don't know.) So I told her I'd go grab my supervisor and I put her on hold. I pulled my boss out of a meeting with the OWNERS OF OUR COMPANY, to explain the situation and give him the call. When he took her off hold, she had hung up. So he called them back. God knows what he told her.

So this woman and her fake company have been spamming my work with telephone calls, I return the call and ask her to refrain from calling back, and she tries to get me fired for "threatening" her??
I call bull. Spam the f*** out of this number.

This is not a law office it is a collection agency,  there was an on line add requesting the finest collection pond scum call them at 716-332-1643 for a collection job, the real name of this fly by night operation is HW Capital and they are located at 2190 Marina Dr Hamburg, NY 14075 and the owner is Mark Lesinski per NY Sec of State filing date 5/11/2012 SOS filing# 4244429.  As a collection agency they have no ability to process serve nor could they afford to file law suits, they are just using illegal scare tactics that violate the FDCPA as well as numerous state laws

It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Got a call from this number, said she is from H and W Associates (hogan and wienburg again) and that I have pending legal action aGainst me for check fraud. Said I need to call immediately to give a statement or resolve this matter out of court.  I'm thinking of sending this to a lawyer as I am getting several of these calls a day. I am saving all the recorded messages threatening legal action so the lawyer can prove that they violated the fair trade practices act.

They've left many messages on my phone as well about upcoming court dates, serving me papers at work, and needing to discuss "page 15" with me before court proceedings.  How does one report this scam and put a stop to this constant harassment? It looks as though there are enough people to make a case against them and stop them for good.

This number keeps calling me saying that they dropped off papers at my work that a superviser signed for or residence and need to discuss page 15 before our hearing. First off I own my own business and NO papers came and nobody went to my house. what the hell is this?? I know I owe money from a stupid internet loan from 2007 but I dont know of having a court date for it.

Nothing,I did the same thing read your laws carefully.Check cashing places can't presue it through a court of law as a bad check because they're considered as a LOAN!Thats why they threaten people,trying to force them to pay up.

Amy,  next time   tell them that you will not discuss it over the phone.  Ask them The actual Legal name of their business,  what their regular business phone number is, and  their physical and mailing address.  Tell them that you need verifiable proof and validation of their claim,  as well as that of the original owner of the debt and the original amount of the check.. Validation must include the date of the alleged  returned check and a copy. (if in fact it does exist, check your states Statute of Limitation for returned checks.  Most states it is only 2-3 years that they can legally collect on them or prosecute.)  My guess is that it is something that doesn't even exist,  or maybe their has been a past issue,  and they are going to do a little zombie debt collection thru intimidation.
When you request validation,  they have 5 days to send it to you.    You have 30 days to dispute it.  Once it is disputed,  they can not legally call you or attempt collections.  They either have to follow up and take you to court.  Odds are,  once you dispute it,  you wont hear from them again.

Last time Mr. Hogan called, this time was Ms. Wineburg. And just by magic the date Mr Hogan referenced for court has come and gone and now Ms. Wineburg is citing a different date for court to take place. I happen to know there is no court date since I have not been served and there would be no time for me to answer based on the date she has referenced (only a couple days away). So, since yall want a statement, here is one, you will never swindle, scare, or bully a dime out of me! Put that in your court papers, idiots.

Mr Hogan, called and left a message saying he wants to get a statement for a court case scheduled for and gave the date. I tried to call the number back but says all circuits are busy. I am smarter than the average bear and happen to know that if there really was a court hearing scheduled for such and such a date, you would not be calling to get a statement from me, second, you would have to actually serve me with documents! Move your little scam on, because it won't work with me!
